In the latest reports from Birtherstan, Mario Apuzzo appeals and Dr. Orly gets a "case dismissed" rock in her trick or treat bag, courtesy of Judge Carter. The Fantasy Tiddlywinks League has jumped on the military coup bandwagon, the Associated Press says "Nope, not our article, Bill O'Reilly gets on the bad side of the birtherstani, Stefan Cook has a new civilian job at Gitmo. James Manning goes over the top and says "If we let Obama live, America dies...", and Gary Kreep is less than thrilled by what Dr. Orly did to their case.

27 October - Sure enough, an appeal has been filed in Kerchner v Obama.

"Recently, the Hon. Jerome B. Simandle decided the Kerchner case, granting the defendants’ motion to dismiss the case. As I explained, through the dismissal, Judge Simandle avoided having to reach the merits of the question of whether Obama is an Article II “natural born Citizen” and eligible for the Office of President and Commander in Chief."

I suspect it was more he thought your theory was a complete load of hooey and dismissed it like the earlier birther cases.

"It is important to understand that the Court did not rule in the Kerchner case that Obama has conclusively proven that he was born in Hawaii."

They didn't need to, the State of Hawaii has confirmed it on several occasions.

"It is also important to understand that the Court did not rule that Obama is an Article II “natural born Citizen.”

They didn't need to, over 200 years of US law, case law, and court rulings have pretty much stated that a "Natural Born" citizen is a citizen at birth.

No, but they can dismiss or reject based on the merits of the argument.\

Isn't that the same court of appeal that Berg is appealing the first Berg v Obama case in?

Judge Carter has made a ruling in Keyes/Barnett v Obama today, regarding the DoJ and Defendant's Motion to Dismiss the case.

I think this is the legal argument known as "you snooze, you lose"

James Manning, the "ATLAHWorldwide" African-American minister so beloved by the birthers, has been in the birther movement for a while. A Hillary Clinton supporter, he once said Obama's father was "a-whoring for a trashy white woman" and called Obama a "Long-legged Mack Daddy". Considering that he seems to have some distaste for non-Blacks, I suspect his hatred of Obama is race-based as well. One of the things he's said before is Obama isn't a "real black man" because he "didn't come out of the American Slave experience and could not qualify for reparations".

But he managed to outdo himself in his 16 October video where he's calling for a million members to do a "work stoppage" and boycotts against Obama supporters.

And maybe just a bit more than simple stoppages and boycotts......

Seems to me a pretty direct threat.

And in the latest reports from Birtherstan, Snopes comments on the Kenya article, the DoJ asks Judge Carter to take note of Judge Simandle's order, Lucas Smith claims that Dr. Orly has gotten into CEL3's legal briefs and he in turn is filling her cavities, World Nut Daily tries to help Kreep get bucks, the birthers get punked, Lil' Davy-Crockett has extra servings of treason-berries, CEL3 tries to get Dr. Orly in on his mortgage scams, with predictable results. The Pest and eFail is showing its true-colours (White sheets and White hoods mainly), Dr. Orly tries threatening the media, the We The People Tax Cheats are having cash-flow problems, Berg seems to have a problem with the truth, and Scientific American discusses why the birthers are batshit crazy and unwilling to face reality.

19 October - Snopes weighs in on the East Africa Daily Standard article as well.

"Claim: A June 2004 Associated Press article identified Barack Obama as "Kenyan-born."

FALSE"

And:

Bad Movie Review - The Harrad Experiment

There's a few movies in my Bad Movie collection that have been waiting, like spores of anthrax, waiting to inflict themselves on my memories. When the movie is based on a book I've read, it makes the experience even more questionable. When the movie is based on a book with a cult following, well…….

In 1966, Robert Rimmer released a book called "The Harrad Experiment". This is considered by some to be an early book on the subject of open sexuality and non-monogamy. I remember reading it in my late teens - early 20's. And thinking it was moderately preachy and dull then. When I read it a decade or so later, I had much the same reaction.

So the question becomes how does the 1973 movie cook the book down to 93 minutes? The answer, poorly.

The movie starts with a young woman in a heavy coat walking though an open gate. She looks at the sign on at the gate - Harrad College. Yep, that must be the right place. She finds her dorm room, drops her bags and slips off her coat, showing the cotton mini-dress she's wearing. She then slips outside and starts to walk around, eventually hugging a huge oak tree.

At that point, you expect the heavens to open and rain down granola.

22 October - Lucas Smith of Fake Kenyan Birth Cerificate 2 fame just posted an affidavit about Dr. Orly. And it's both hysterical and disturbing.

But really and truly, Orly's better in bed than 99% of the much younger girls I've ever met: you name it, hotter, hornier, wetter, tighter, more of a nympho than I've ever met in fact. Her only limitation is on kinkiness: she won't even bite or let me bite her. Maybe that's part of her craziness---she is very straightlaced, conservative, "normal" and forthat reason never "got enough" when she was younger and always had to channel it to other things, and now she's finally cheating on her husband and totally wants to let loose but doesn't quite know how....."

My oatmeal just hit the wall.......

You know, I joked about it. And thank the Gods Lucas Smith has zip credibility, because otherwise my libido would be hiding in the corner screaming.

Still, Dr. Orly has to figure out how to claim Lucas Smith is lying EXCEPT about FKBC2.....

In the last few days over in Birtherstan, we've had a very fake looking "Hawaiian Birth Certificate", AXJ - Cloud City pimps a months old long-since disproven "Kenyan" birth certificate, Dr. Orly appeals her sanctions and tries to up the amount it seems, the plaintiffs in the appeal of Hollister v "Soetoro" are told no, they can't have more time or pages. Scott Easterling got a an "administrative reprimand" for badmouthing his Commander in Chief - but also got recommended for promotion. The judge rules in Kerchner v Obama and says "No, you can't have a lawsuit. not yours". "MissTickly" plays the PUMA playbook and manages to reach "Lame Cherry" levels of insanity. The Pest and eFail is beating the treason drum, Dr. Orly shows no knowledge of how the internet works, and rehashes a months-old conspiracy theory. Oh, and she still doesn't like Muslims much either.

20 October - And we have a new Birth Certificate, this a very pixelated "Certificate of Live Birth" from Hawaii.

I am not a graphic artist or forensic specialist, but right away I'm noticing problems.

Namely big block smudges around most of the name fields.

Then there's line 23, the "Evidence for Delayed Filing or Altercation", which says:

"1. Birthplace: Kenya; Registered Honolulu. HRS 338-17.8 per Grandmother"

First off, it's broken into three separate lines with block spaces around each.

Second off, Hawaiian law §338-17.8, which is the "holy grail" many birthers use to explain away the Hawaiian COLB, was enacted in 1982. From the State of Hawaii website:

"[§338-17.8] Certificates for children born out of State. (a) Upon application of an adult or the legal parents of a minor child, the director of health shall issue a birth certificate for such adult or minor, provided that proof has been submitted to the director of health that the legal parents of such individual while living without the Territory or State of Hawaii had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child.
(b) Proof of legal residency shall be submitted to the director of health in any manner that the director shall deem appropriate. The director of health may also adopt any rules pursuant to chapter 91 that he or she may deem necessary or proper to prevent fraudulent applications for birth certificates and to require any further information or proof of events necessary for completion of a birth certificate.
(c) The fee for each application for registration shall be established by rule adopted pursuant to chapter 91. [L 1982, c 182, §1]"

So what was a law enacted in 1982 doing on a supposed 1961 birth certificate??

It's an even more clumsy fake than the Kenyan ones.

And YET another one bites the dust.....

In United States District Court for the District of New Jersey, a ruling in Kerchner v Obama.

Defendant' motion to dismiss has been granted, docket closed, case dismissed.

Doin' the Birtherstan Rag - Birther Update

Sammie makes up polls, some of Dr. Orly's clients try to invoke RICO, some of the Cavity Creeps indulge in open racism, some birthers are splitting hairs, a reporter for the Africa Standard basically tells the birthers "don't you have anything better to do?", the Fantasy Tiddlywinks League stamps their tiny feet and demands the courts treat them like a REAL jury, CEL3 and Dr. Orly are already making excuses for their upcoming loss, AXJ-Fantasy Island is still either punking the birthers or being REALLY dumb, and The Pest and eFail seems to the the cure to prevent "Civil War II", is...a civil war.

15 October - Sammie Sewell is pimping a Fox News poll that says that;

"43 percent of voters say that they would vote to re-elect President Obama if the 2012 election were held today, down from 52 percent six months ago, from April 22-23, 2009."

If 43 percent of Fox News viewer would vote for Obama, that's not a bad thing considering the crap they spew on a regular basis.

Gallup, BTW, gives the job approval at 56%

"Barack Obama appears to have gotten a slight bounce in support after he was announced as the Nobel Peace Prize winner on Friday. His 56% job approval rating for the last two Gallup Daily tracking updates is up from a term-low 50% as recently as last week, and 53% in the three days before the Nobel winner was announced."
