A thought or two on the Lakin Case

Here's an odd thought -

Since it looks like the Hemenway's are up to their neck in this,it seems to me what we might be looking at is an attempt to replay "Hollister v 'Soetoro'", without Berg and with an active duty person rather than retired.

Having an active duty plaintiff would be more immediate than a retired "subject to recall" plaintiff. And the sanctions were upheld on the 22nd of March - a day before "safeguardourconstitution.com" was registered.

We've already seen among Lakin's "proof" some recycled Berg claims - the Anabaptist minister's claim, the edited Sarah Obama "interview", among others. We're not seeing the de Vattelist stuff (never Berg's thing), nor are we seeing the Indonesian citizenship thing (yet), but we're seeing a lot of other stuff that's a carry over from Berg's cases.

And the "report" from Farah's Western Journalism Center" is a lot of Berg rehash (DHHL, Polarik's claims, etc.), but little from other birthers - and Hollister v 'Soetoro' was mostly Berg legal DNA even during the appeals (while Hemenway commented on Dr. Orly's cases, he never really used any of her claims - and despite Dr. Orly's statements, it doesn't seem like any partnership between the two of them happened. However, at the time Dr. Orly was courting active duty personnel for her cases).

The more I look at this, the more I'm seeing an attempt to re-argue Hollister v 'Soetoro', but using an active duty plaintiff rather than a retired one. If that's the case, Hemenway may be opening himself up to further sanctions down the road.

The other thing I'd like to note, which I touched on briefly before.

It's a matter of faith among the birthers that a "Certificate of Live Birth" (such as what Obama's campaign scanned and placed on line) is somehow not a "real" birth certificate. We've seen the hair-splitting between "Certificate" and "Certification", and birthers like Miki Booth dismissing the Obama COLB.

"Just as a tea-party convention crowd gathered to discuss strategy for the movement, one woman stepped forward to the microphone – holding up two Hawaiian long-form birth certificates and a copy of President Obama’s purported short-form certification of live birth – and, referencing the short form, she told the crowd, “This piece of junk is what you get when you don’t have one of these!” "

On the "Safeguard our Constitution" website, Lakin has the following link:

"LTC Lakin’s birth certificate, which includes common, standard information; his hospital and name of attending physician. "

Ignoring the fact that hospital and name of physician are NOT "common standard information", what he presents is a Certificate of Live Birth from the state of Colorado.

In other words a COLB. And one with less information than the "long form" the birthers demand from Obama. Lakin is giving the US Army a "birth certificate" with less information than the "long form vault copy" he demands.

Double Standard much??

In today's dispatches, looks like Lakin has a very familar name running his PR. More of the Fantasy Tiddlywinks League banging the treason drums, while warning their followers away from other wingbats. A questionable analysis from a "therapist", and Dr. Orly continues to beat the ex-equine known as Cook v Good, while getting a response in her quo warranto case. Finally, the Rude Pundit has something to say about Lakin's "patriotism"

30 March - The site "MOMocrats" has more about LCol Terry Lakin and the "American Patriot Foundation". And look, a familar name shows up:

"The contact on the press release, is Margaret Hemenway, one of Smith's former staffers who also worked for NASA and the Department of Defense."

Yep, John Hemenway's daughter, Margaret, who is believed to be the one who introduced Berg to Mr. Hemenway and convinced him to sponsor Berg's "Hollister v "Soetoro" lawsuit.

No WONDER much of Lakin's claims look like warmed over Berg droppings!!!

It also points out:

"American Patriot Foundation was founded by former New Hampshire Senator Bob Smith, who resurfaced last year as Project912's candidate for the Florida Senate seat against Marco Rubio and Charlie Crist. Last Friday, he announced his intention to withdraw from that race."

"It seems suspicious to me that Smith would drop out of the race on Friday, revive his dormant non-profit on Monday, and launch a fund-raising drive to defend a treasonous birther on Tuesday."

There's something that smells really fishy about this one. The website supporting Lakin is a very polished, professional site. Furthermore, one of the "sources" he sites is the WND-ran "Western Journalism Center", and is currently led by "Willie Horton" ad genius Floyd Brown.

Which tells me that this is as planned as Cook's volunteering was. Lakin has made it clear he wasn't going to accept any answer other than "yes" to his claims, and I see his now open defiance as an attempt to use a supposed court martial to play the discovery game.

It's time the military comes down on these bozos. They let Easterling slide. Cook lost his security clearance due to his filing as a CO, but nothing else was done. Rhodes realized that her lawyer was a wackadoodle and bailed before Dr. Orly could do any more harm to the remainder of her military career.

Lakin did the 138 route. He didn't like the answers he got. He's openly attacked both the CinC and the Army Chief of Staff.

At this point, the Army should say "look, you can resign your commission now, keep whatever benefits you've earned, go into civilian practice. Or you can play this reindeer game, get court martialed, lose your benefits, lose your ability to practice medicine, and get a free transfer to a military prison, The choice is yours".

Dispatches from Birtherstan - for 30 March 2010

In today's dispatches, we have an new military officer in violation of the UCMJ by publically going birther. The bloom is off the rose between CEL3 and Lucas Smith. Dr. Orly gets fawned over by the UK Independent. Obama discusses the Tea Partiers, Off-Shore Jobs Campbell is rehashing old scary stories, LaRouche is warning about assassination, and Lame Cherry needs a better quality of tinfoil.

29 March - Well now, is the bloom off the rose that was the friendship between convicted forger Lucas Smith and disbarred felon Charles E. Lincoln, III??

Agreed, if CEL3 continues, there should be no problems with the bank or HOA successfully evicting her.

He then includes this email from a "Melissa Shepherd" to CEL3

What I said was it was good to see three men sitting around my dining room that were helping me without some sort of agenda. THIS IS NOT A mixed signal. This is a statement of relief that WOW there are some gentlemen in the world not going to take advantage of someone they are helping out. When in reality, as you and Peyton so politely told me that it is even exchange for having possession of the unit. Or does your memory fail you?"

Dispatches from Birtherstan - for 27-29 March 2010

In today's dispatches, Dr. Orly has gone to openly threatening government officials if she doesn't get her way, while attempting to play leech with state Attorney Generals. The Fantasy Tiddlywinks League is whining that our elected officials won't take them seriously, while warning their followers against other fake grand juries. The monkeys at Larry Wells primate cage are openly discussing "why haven't we had a military coup or even better, an assassination attempt?". While back on planet Earth, some real representatives are getting real assassination threats. Dr. Orly loves free speech - provided that people only say good things about her, otherwise she's all for soviet-style threats and censorship. And the Pest and eFail really needs to study the US Constitution a bit better.

22 March - In the appeal of Keyes/Barnett/Drake v Obama, Dr. Orly sends a letter to the court.

"I am in receipt of your letter from 03.03.10., reference S9H: AD2135 and I respectfully appeal your denial of disclosure of information under FOIA 5 USC 552 (b)(6) and I demand an administrative hearing within 30 days for the following reasons:"

Always a good start, to make demands.

"If you, as a Social Security officer, upon receiving such information, are refusing to act and prosecute, you become complicit and subject to criminal liability for aiding and abetting of felonies, subornation of felonies and under RICO."

And then to follow up with threats. Thereby insuring that the next letter from Social Security will be telling her to direct all future letters to their legal staff.

Basically she's demanding that the Social Security Administration break the law and give her information she has no legal right to. And threatening them with legal action if they don't do their bidding. It should come as no surprise that such actions are a violation of State Bar of California Rules of Professional Conduct.

Dispatches from Birtherstan - for 26 March 2010

Things have been quiet in Birtherstan of late. Which is not to say all's quiet elsewhere.

You have Joseph Farah pushing for a two-state solution for the United States, because trying to work out common ground is harder than secession. Tea Bagger tactics, calls for revolution, and political hatred are right out on display at Fox News. Dr. Orly tries to hang on the coat tails of the state Attorney Generals, while the Fantasy Tiddlywinks League tries to expand their scope to include fake grand juries against other targets as well. "Conservative Monster" shows their true racist colors, while Apuzzo serves up the same de Vattelist drivel. And some scary road rage to boot.

25 March - Joseph Farah of World Nut Daily thinks secession is a pretty good idea.

"But this idea of a two-state solution is growing on me.

Not for the Middle East, mind you – but for the United States of America.

America has not been more divided and polarized by fundamentally conflicting worldviews since the War Between the States."

And largely due to the efforts of people like Joseph Farah too.

But, just like the Muslims in the Middle East, who don't care about playing by the rules and don't mind using force to get their way, neither do those in America who are statists. "

Nice little ethic slur there.

Statism only works by bleeding people, preying on them, leeching off them, coercing them, taxing them and oppressing them. I see a couple glaring holes in Farah's logic there.

The first is the assumption that people who believe like him are the "productive people". I've encountered this before from the far right - the idea that those who don't believe as they do don't work, don't pay taxes, etc. Which is news to a lot of people like, oh, myself.

The second is the fact that most of the so-called "red states" where many of Farah's supporters come from take more money from the federal government than they pay in taxes. (Alaska is particularly good at sucking on the federal government's teat like this, getting $1.81 back for each dollar paid in taxes, all the while cutting those big oil revenue checks to their residents.) In any case, it seems like if those states were full of the "productive people", wouldn't that be reversed, and the taxes in those states going towards the "blue state parasites" instead??

It's not so much that these people want a "second American Revolution".

They want a second Confederacy.

Birtherstan shows that Vogon poetry ranks up there with stupidity as their leading export. The GOP continues a downward spiral into insanity. AFA officials join the revolution crazy train, while Dr. Orly's campaign site goes live and lies. Lame Cherry needs to up their meds, Dr. Orly thinks that state Attorney Generals are riding her coattails. And the inmates at Larry Wells primate cage continues to fling poo.

12 March - At Charles Tanz's discount poetry, an ode to Dr. Orly. With such lines like":

"I am proud to be a Birther!
Obama is a big Usurper.
Our Lawyer is Dr. Orly Taitz,
We’ll take back the United States!

We fight for the Constitution.
So there won’t be a Revolution.

22 March - Disturbing article by James Zogby.

"The idea that the minority party represents the "will of the people" (not some of the people, but "the people") is the seedling of a totalitarian mindset. In this mindset -- democracy doesn't matter, ideas are not to be discussed, and opposing views are not to respected. What matters is that they alone have truth, they alone are metaphysically connected to the "mind of the people" can interpret their will, and because they have truth and speak for the people, others represent a threat and must be silenced and stopped.

This was a major concern last summer as violent demonstrators disrupted "town meetings" -- with angry chanting mobs claiming to represent the "will of the people" arrayed against the elected Congresspeople and their constituents who had freely assembled to discuss issues. The mobs didn't come to discuss or even debate. They were mobilized to disrupt discussion and silence debate.

Listening to the rhetorical excesses of last summer's demonstrators, or those who mobilized to chant slurs at Democrats over the weekend, or to the radio and TV personalities who incite with hate and fear ("that we are losing our country"), or the GOP Congressional leadership who charge much the same and incite in similar ways -- I hear echoes of last century's history. The behavior fits a frightening pattern and ought to be of concern. "

Which is why showing the lies of the birthers and the like to the light of day is needed in the poisonous climate that has replaced political discourse in this country.

Recovering from the project that ate my brain, and a busy weekend of family time. Because family is far more important to me than what a group of paranoid conspiracy nutters are doing other than walking upright and flinging poo.

In birtherstan, Mr. Manning tells us his real witnesses for his fake trial. Rachel Maddow helps Dr. Orly (chuckle). The Pest and eFail finds a new internet "expert". Dr. Orly files an amended complaint that states (among other things) she's her own worst enemy. Off Shore Jobs Bob goes on a jihad against health care, verdict and sanctions are upheld in Hollister v "Soetoro", and William Connerat doesn't understand the word "dismissed"

16 March - Well, Mr. Manning sure seems to be optimistic about their pretend trial at Columbia. even going so far as to give a list of "witnesses" to be "subpoena".

He gives the names of what he considers will be "hostile witnesses", (by which I suspect he means won't show or respond to his pretend "subpoena". Marcus Brauchli, Condoleezza Rice, Dr Zbigniew Brzezinski, George Stephanopoulos, Phil Boerner, Michael Ira Sovern, Wayne Allyn Root, Sohale Siddiqui, Douglas A Chalmers, Andrew Nathan, James W Mortley, Richard Pious, and Flora S Davidson are on that list. He's also got a list of "secret" witnesses who supposedly won't be released until closer to the trial.

Of course, if those "subpoenas" look real, then Mr. Manning is going to be in Very Big Trouble indeed. Quite illegal, that is....

19 March - Rachel Maddow is nice enough to come up with a campaign ad for Dr. Orly.

A mini update today, as I have a work project that's eating my brain and taking 95% of my attention. Needless to say, more proof this blog is NOT being bankrolled by George Soros.

17 March - Debra Bowen uses Dr. Orly's campaign for her own fund-raising.

Orly Taitz’ candidacy would be amusing if it weren’t so serious. Her primary reason for running is to challenge President Obama’s citizenship and invalidate the 2008 election. In fact, Taitz has sued Debra twice to try to invalidate Obama’s victory.

We can’t let fringe conspiracy theorists use this office to get a foot in the door and undermine our democracy.

Debra’s opponents are well connected, and have the ability to raise large sums of money from across the country. We must make sure she has the resources to beat them.

Needless to say, Dr. Orly has her nose out of joint (malware and redirect warning)

"Dr. Ron Polarik" (Ph.D. in bullshitology) makes a reappearance in birtherstan. The media reports on the Hawaiian vexatious requester bill. CEL3 comments on the 11th circuit court's decision on Dr. Orly - and makes an interesting claim of his own. And it looks like Dr. Orly's on the primary ballot in California.

28 February - Some people can't seem to stay away. Like infamous "document expert "Dr. Ron Polarik", Ph.D. in Bullshitology, who is still preaching to the birther faithful.

"Ann1 says, “The COLB IS a birth certificate. It is the only birth certificate that Hawaii issues.”

A one-sided JPG image IS NOT a birth certificate, anymore than a one-sided image IS Da Vinci’s Mona Lisa, or a one-sided image IS a VISA card, or a one-sided image IS a passport, or a one-sided image IS a TV set."

Yes, but nobody ever said that Obama used the IMAGE of the COLB for registration purposes. To claim or believe that would be very stupid indeed.

"Next time a cop pulls you over and asks for your license and registration, hand him your Iphone and tell him, “It’s online and there’s an APP for that.”

This is no more ridiculous than claiming a one-sided, or multi-side, JPG image IS a birth certificate."

Except "Polarik" seems to be claiming just that.

"There is also, no reason or justification whatsoever, for NOT spending $10 to get a paper COLB and then presenting it on the Senate floor, to his fellow Senators, as McCain did in April 2008."

More like there is no reason or justification TO do just that.

"As far as, “Why didn’t the lawyers pounce on this fact and make factcheck produce the UPI article or at least try to find it themselves?, the answer is that all of the eligibility lawyers had zero interest in anything other than Obama’s “long-form CertificatE of Birth.” I know because I begged them to do it."

And look where it got them - and you. Losses in court for them, and dismissals of "junk science" for you.

9 March - Oh look. Polarik. Again. This time at "Citizen" Larry Wells.

Except you've never proven the physical COLB was forged. You've never proven the COLB image was forged. You've never proven a single solitary thing you've claimed, and never provided any proof that you have any of the training or background you claimed as well.

In short, there's more evidence that Obama was born in Hawaii and that the COLB posted was a scan of an official State of Hawaii document, then there is for the training and background of "Dr. Ron Polarik".

"Yet another Obot planting bogus information to prove that conservatives are more stupid and gullible than are liberals."

Certainly the birthers have shown an amazing ability to believe ANYTHING.

Dispatches from Birtherstan - for 16 March 2010

In today's dispatches, Ken Cuccinelli needs a tomato juice bath or some nature's miracle, as he's covered in birther. Many of the birthers are screaming about Dr. Orly being forced to be responsible for her actions. And we have a new lawsuit that's pretty much every birther conspiracy theory distilled down to 67 pages.

15 March - Looks like Virginia Attorney General Ken Cuccinelli needs to bathe in tomato juice or something. Because he's now trying to get the smell of birther off of him.

"I absolutely believe that President Obama was born in the United States. I don't buy into the claims that he wasn't. On the recording, I was asked a hypothetical legal question, and I gave a hypothetical legal answer in response," Cuccinelli said in a press release this afternoon. "As I said previously, this issue was not a part of my campaign, and it is not part of what I am doing now as attorney general."

He's going to burn out his transmission throwing it into reverse that hard.

"Cuccinelli now appears to have gone from saying that the idea of Obama being born in Kenya "doesn't seem beyond the realm of possibility," to saying he "absolutely" believes that Obama was born in the United States, and that he doesn't buy into claims to the contrary."

"It was all hypothetical! I'm not a birther, really I'm not!!

Better get the tomato juice ready.

16 March - "MinutemanCDC_SC" takes some time out of threatening Judge Lamberth's grandchildren to give his opinion on Dr. Orly being told no by the 11th Circuit court of appeals.

Atty. Orly Taitz should have standing for damages suffered when District Judge Clay Land sanctioned her $20,000 for "bringing frivolous lawsuits" on behalf of military personnel who want their chain of command validated including the Commander-in-Chief.

$20,000 looked like cruel and unusual punishment for doing the right thing, but it could turn out to be the key to the lock on the courts."

Except it looks like that key has no chance of fitting any locks on any court.
