Weekends in birtherstan, and we have a new "Great Moments" video to share. Dr. Orly's Quo Warranto loss is commented on further, while her Cavity Creeps wonder why she's not involved in Lakin's case. Lakin's supporters and attprney bear some investigating of their own. Dr. Orly thinks the laws in Arizona mean that President Obama can now be arrested in that state and deported. Cook v Good gets denied - again. The Tea Party has some people that aren't wrapped very tightly. Salon reports that there's more rumours about Obama than Bush, while the Fantasy Tiddlywinkers are thinking Lakin's case is part of a Super Secret Military Plan to oust Obama. And Dr. Orly's campaign site now gets the "malware and redirect warning" flag.
18 April - Part one of an animated version of Dr. Orly's appearance in Brockhausen v Andrade(Scibd link), (When Dr. Orly appeared to represent Jody Brockhausen on 23 Jan. 2009.)
This gives us an early peek into Dr. Orly's future courtroom behaviour.
22 April - Dr. Orly's Quo Warranto loss gets commented over at "Lowering the Bar"
"Among other things, Taitz has had trouble proving that she has standing to pursue these cases, mainly because she doesn't. This latest effort involved a "writ of quo warranto." There is such a thing, and it can in fact be used to inquire as to the authority by which a public office is held. But as the court held, the statutes clearly state that only the Attorney General or a U.S. Attorney can pursue such a lawsuit without leave of court, and therein lies the problem for the private lawyer-dentists of our nation."
And ends with:
"Sooner or later, Taitz's unbroken string of losses may get so long that it will embarrass her online law school, but for now she continues to be listed on its roll of "honored graduates." I express no opinion about her skill in dentistry, but have not been impressed by her legal arguments."
23 April - From Dr. Orly's Dental Den o' Treason. (malware and redirect warning)
"Edward Paard
April 23rd, 2010 @ 3:08 pm
Dear Secretary of States Dr. Orly Taitz -
I am concerns that the attorneys in the miltary trial of Col. Dr. Terri Lakin has not been coming to you for help and advice.
No other attorney has your record of getting the army to be backing down and not taking patriots like Capt, Easterling and LCol. Cook. To not be making use of you and your talents is criminal.
Please, I asking this if you, to file a friend of the court briefing and ask that you be allowed to defend this brave patriot Col. Dr. Lakin and make sure the army backs down on him as well. Failing that, please file a brief with the courts with all your documentation about the usurper and his crimes, and show Col. Dr. Lakin his best chance to gain his freedom and the downfall of the usurper is being in your capable hands."
While the comment is funny, Dr. Orly's response is even funnier:
"dr_taitz@(redacted)
April 23rd, 2010 @ 3:51 pm
Lt. Col Lakin is part of the military, he will be tried by the military court. I am not licensed there. I don’t believe that Mr. Hemenway will be representing him there either. It is my understanding that his defense will be provided by a JAG officer"
Well, being in the military didn't stop Dr. Orly from representing Maj Cook and Capt. Rhodes. And it's not like the whole "not being licenced there" has ever stopped her in the past.
But that being said, I have to say it's funny she's not trying to shoehorn her way into this case. I wonder if a certain Moldavian-born attention whore is miffed they went with another Orange County attorney rather than her?
23 April - From Raw Story, more questionable connections with Lakin and some of his supporters.
"The most recent endorsement of Lt. Col. Terry Lakin's claim that no orders issued by the US military are legitimate because President Barack Obama is not a native-born American citizen comes from Maj. Gen. (ret.) Paul Vallely, who stated in a radio interview featured on Friday by the conservative website WorldNetDaily that he believes Lakin has "a valid point."
"I think many in the military -- and many out of the military -- question the natural-birth status of Barack Obama," Vallely remarked. "I'm not convinced that he is [a natural-born citizen]."
Some of you might notice the name Paul Vallely......
"Vallely's participation brings a new dimension to the case, however. His words may appear to carry more weight because he is a former military officer, but they also raise certain suspicions because of his extensive history of involvement in propaganda operations.
Vallely first came to prominence as the co-author of "From PSYOP to Mindwar: The Psychology of Victory" (1980) which advocated "the deliberate, aggressive convincing of all participants in a war that we will win that war."
Since retiring from the Army in 1991, he has served as a military analyst for Fox News, and he was named by The New York Times in 2008 as a participant in a Pentagon propaganda operation which covertly employed retired officers to support the Bush administration's war on terror.
Vallely is also known for his claim that he had heard Joseph Wilson boasting in 2002 that his wife, Valerie Plame, was a CIA officer -- well before she was outed by Robert Novak. Wilson ultimately threatened to sue both Vallely and WorldNetDaily unless the claim was retracted.
And finally, Vallely spent much of 2003 insisting that Saddam Hussein's weapons of mass destruction had been smuggled out of Iraq prior to the war and hidden in Syria. He is also a long-time advocate of regime change in Iran and a supporter of the terrorist group Mujahedeen e-Khalq (MEK)."
So another right-wing operative is involved in the Lakin case, along with Hemenway, Jensen, Corsi, and Farah.
Something about this stinks to high heaven of ratfucking.
23 April - Fox News comments on Lakin's court martial plans as well.
"A decorated Army doctor who defied orders to deploy to Afghanistan in order to use his court-martial to determine whether President Obama was born in the United States has chosen the wrong venue to make his case, military lawyers told FoxNews.com."
In a word, duh.
“It is a matter of common sense that he would be allowed to put on a defense that explains why he did what he did,” says Alan Keyes, a former Republican presidential candidate who supports the move and once ran against Obama in Illinois.
“And that means he would be allowed to conduct an investigation that would establish his reason.”
So Keyes thinks Lakin can get the holy grail of discovery. Those in the reality-based community though.....
"One military attorney said Lakin had advice from a lawyer, Paul Rolf Jensen, but that Jensen had “only three months' experience in military law as a clerk in the 1980s” and was not an expert in military law. Jensen did not return a phone call seeking comment, but military experts called Lakin's effort a tragedy and waste.
“He is likely to lose everything and accomplish nothing,” one attorney lamented. “No military judge will say that (obtaining documents) of the president is necessary to prove the charges,” said Philip D. Cave, a Washington attorney and director of the National Institute of Military Justice.
Cave said that the validity of Lakin's orders, under military law, does not depend on the president but on the chain of command. “He will be convicted and is in jeopardy of dismissal,” he said.
Dismissal, for a military officer, is the same as a dishonorable discharge for an enlisted servicemember."
And the article ends with:
"Gary Myers, a former military lawyer who now heads a Washington firm specializing in military law, says he "just shook my head" when he heard about the case “I think [Lakin] is out of his mind” for thinking he could challenge the president this way, he said.
“It is grandstanding.”
It is indeed.
And look at the stupidity in the comments!

Why does Barry Obama, Barry Soetoro, Barack Soetoro, Barry Dunham, and Barack Dunham have the same cert of live birth as his sister? We know she was born in Kenya. Any one could call a newspaper to announce a birth. What did they not have phones in Kenya. The real question is WHY THE HECK DOES HE REFUSE TO DISPEL ALL THIS NON-SENSE AND PRODUCE THE DOCUMENT ALREADY! i also want to see his grades from school mostly his math grades because his math does not add up!

"dutchmen26
I really have to say it has taken guts for Lt Col Lakin to stand up for his belief which I believe to be true in every aspect about Obama. OBAMA is NOT a legal president until he proves beyond a doubt that he was a Natural Born citizen of the United States of America and should be removed from office unless he can, completely and honestly, prove his birth citizenship in the United States of America. I do think the Lt Col Lakin is taking the wrong avenue to get Obama to prove he was eligible, but I admire him for his stand. I wish him good luck. Having said this, I do believe that he is wrong in how he is attempting to get Obama to prove his citizenship. His approach can only hurt him and for that he will pay for this mistake for the rest of his life. Those of us who believe Obama is not a legitimate president need to band together and get this man removed ASAP.

"Band together", eh??
Damn, there's a LOT of stupid in those comments.
23 April - More stupidity from Dr Orly (malware and redirect warning)
"WHAT IS THE BEAUTY OF AZ TWIN LAWS?
Posted on | April 23, 2010 | 5 Comments
The beauty of AZ twin laws, is that not only Obama will not be re-elected, but he can be arrested as an illegal alien and deported back to Kenya.
That is, after he is criminally prosecuted and serves time for the Social Security fraud."
Someone needs to switch to a better grade of nitrous.
23 April - David Weigel at the Washington Post suggests the reason Lakin is doing this is more for the publicity than anything.
"Safeguard Our Constitution is the site collecting the newest info on the case -- that's where I grabbed this charging document. But we've now seen a number of soldiers do this, and last year we saw Capt. Connie Rhodes try a similar thing, get punished, and make a celebrity out of her lawyer -- none other than Orly Taitz. Larkin's case isn't going to change anything more important than the pecking order of birther attorneys and the destination for birthers' donation checks."
And in comments:
"Yes, the mainstream media was complicit in making this the most non-vetted president in our history.
I'd like to see his scholastic records because I believe obama has been affirmative-actioned into everything he has ever gotten.

Racist much??
23 April - From the docket on the Cook v Good appeal:
"04/23/2010 Appellant's motion for reconsideration of this Court's February 26, 2010 order is DENIED. JLE/SFB No
04/23/2010 MOT2 (Notice of court action) issued. c:Eric Fleisig-Greene; c:Mark B. Stern; c:Orly Taitz No "
Next stop, SCOTUS ??
23 April - Note to the Tea Party. When one asks you questions, death threats isn't a good answer and incoherent screaming - unless you WANT to make your movement look worse than it does.
And I'm not sure your fellow USMC veterans would agree with you about closing the VA and going to "charity hospitals"......
23 April - Dr. Orly contaminates the region I was born in.
"Leading "birther" activist Orly Taitz will make a brief Yuba County appearance Saturday, to speak at the Yuba County Republican Party's candidates forum in Marysville.
Taitz, who will appear from noon to 1 p.m., has filed several legal actions suggesting President Barack Obama should be turned out of office because he wasn't born in the United States, making him ineligible to hold the post. All of her suits have so far been dismissed, and at least one judge has warned Taitz she could lose her legal license if she continues to file such suits."
23 April - And this is interesting. J.L. Bell at Salon does a bit of research into rumours about Obama. And the results??
"It struck me I was seeing a lot more rumors about President Obama, and a lot more false rumors, than I remembered from earlier years. So I ran the numbers, as of this week.
After eight years in the White House (with Snopes.com around all that time), George W. Bush has been the subject of 47 internet rumors. After less than two years in office, Barack Obama has been the subject of 87, or nearly twice as many.
Even more telling is the relative accuracy of those stories. For Bush, 20 rumors, or 43%, are true. Only 17, or 36%, are false. The remainder are of mixed veracity (4), undetermined (4), or unclassifiable (2).
In contrast, for Obama only 8 of the 87 rumors, or 9%, are true, and a whopping 59, or 68%, are whoppers. There are 17 of mixed veracity and 3 undetermined."
24 April - CAAFlog comments on the Fox News report
"Here’s a link to a Fox News report quoting Phil Cave, David Price, and Gary Myers stating that the military judge in the Lakin case won’t authorize discovery of documents concerning President Obama’s constitutional eligibility because such documents aren’t relevant to the missing movement and orders violation charges LTC Lakin now faces."
This doesn't seem to be sitting well with the birthers, who leave their droppings behind in comments:
"billvanallen says:

No discovery is needed from Obama, BO is not “grandfathered” into POTUS/CINC eligibility by the explicit language of the US Constitution and since BO’s father (BO Sr.) was never a US citizen, BO is not a nbc (natural born citizen) eligible to be POTUS/CINC.
Case closed other than affirming the language of the US constitution that Lakin swore to protect and defend against all enemies foreign and domestic."

Current Minister of Lands in the Kenyan Government Declares Obama “was born here in Kenya” and Is Not a “native American”"
Of course, Kerchner's case is still in appeals, but it doesn't seem like the people at CAAFlog are buying it:
" Dwight Sullivan says: April 24, 2010 at 11:45 amI wonder in how many other contexts you’d be willing to accept a statement of a Kenyan official with no apparent knowledge of the matter he’s discussing over two statements issued by the relevant official of a U.S. state government that she has personally seen the relevant documentation."
Ow.

" gorefan says: April 24, 2010 at 12:22 pmI always find it interesting, that the birthers are wiling to take the words of a foreign politician without question, but reject the words of American politicians and officials. Weird, and somewhat unAmerican."
OW!! But very true. The birthers usually seem to be more patriotic about Indonesia or Kenya than the US, considering the weight they give those nations laws.....
" Anonymous says: April 24, 2010 at 12:36 pmI spent some time on his website, after which, I burned my eyes for the stupidity contained within, but they actually quote Dred Scott as well as some French writer from the 1750s as proof positive that it’s all about who your daddy is.
Doesn’t matter if you are born here, doesn’t matter if your mom is a citizen, if your dad isn’t a natural born citizen, then you aren’t.
So does make one wonder why they even care about a birth certificate, or what they expect to discover since even if the President proved he was born in Hawaii, it wouldn’t matter to them."
The fact that Mario Apuzzo cites Dred Scott says volumes about his real reasons.
" Anonymous says: April 24, 2010 at 4:43 pmCDR K (or is it KKK) and his subversive birther bunch are probably AQUSA (al quaeda in the USA-affiliated. " Anonymous says: April 24, 2010 at 5:33 pmI’m curious Bill, since LTC LAkin can’t follow orders because they are all illegitimate since President Obama is illegitimate, is he also refusing to accept his military pay since that also flows from an illegitimate budget signed by an illegitimate President?
Why does he even show up to work at all since any order to do so is also illegitimate?
Why does he follow some orders but not follow the order to deploy?"
*chuckle* Why indeed.
Oh, and look at THIS one!
" CDR Kerchner says:

Obama maybe a “Citizen of the U.S.” (he obtained that by marrying Michelle) but he is not a “natural born Citizen of the U.S.” as is required by Article II, Section 1, Clause 5."
Wait a minute.
It’s been a part of birther theology for sometime that a woman automatically loses her US citizenship when she marries a non-US citizen (look at Philip Berg’s claims that Stanley Ann Dunham lost her citizenship upon marriage to Lolo Soetoro)
If that’s the case, then by his logic Michelle Obama lost her US citizenship, because, after all, the birthers seem to believe US citizenship is so fragile that anything can take it away. And you do claim that Obama has that evil British/Kenyan citizenship from his father that is just so powerful it stops US citizenship dead in it’s tracks.
Unless, of course, this is just more nonsensical chatter from the birthers to try and create more categories of US citizenship than really exist, in an attempt to explain away that someone they don’t like is in the White House being President.
" smokin' joe says: April 24, 2010 at 5:45 pm (Quote)LTC Lakin, if you are out there, read the above posts. These are the people you have associated with.
No amount of facts, law, or reasoning will ever convince them. They are in denial. Your court-martial advances their cause in only one way. It gives them publicity. It will not, no matter what anyone has told you, ever prove or disprove what anything about the President’s birth.
They will not be there for you when you go down.
In a few years, they will fade, and won’t even be a footnot in history.
Your choices, however, while adding nothing to their cause, will have profound effects on you. There will be a reckoning for what you have already done, but you can still limit the damage.
Please reconsider, and bring no further shame to the Army."
Too late for that. Lakin has made his bed, he now must lie in it.
24 April - Well now, a post in the Fantasy Tiddlywinks Super Secret Clubhouse says that maybe Lakin's claims is part of a conspiracy from the "Guardians of the Free Republics" because, hey, didn't they say the military was behind them??
"Floridafree
#2 Fri Apr 23, 2010 8:15 pm
Here is a thought maybe way off in left field but I'm going to say my thoughts. The Guardians have said all along they want to Restore America "peacefully'. If Barry Soetoro is just yanked out of the White House by the military there may be a problem with his supporters uprising."
Yeah, 63+ million voters having their voted nullified in a military coup could make people cranky - including those in the military who donated to Obama.
"The Guardians claim that the military is already on board."
We haven't seen military actions against the Governors the Guardians "fired", have we??
"O.K. now lets look at LTC Lakins case what if the military along with the guardians are planning to use this case to EXPOSE the truth behind Barry Soetoro..."
"O.K., now what if Superman teamed up with Spiderman and made a raid on the White House together to remove Barry Soetoro??"
Hey, it's about as likely to come true as "Flordiafree's" version.
"...think about it of Soetoro is exposed in a court of law (discovery)"
Ah yes, the birther holy grail of discovery again.
"...then the Senate will have no choice to act and then Barry Soetoro is removed LAWFULLY"
Or, is more likely, in the unlikely event that discovery on Obama's birth certificate is granted, the court accepts the State-certified COLB and Lakin is up shit creek without a paddle.
"...under the organic Constitution"
As opposed to a synthetic or additive-laden Constitution?? What about a free-range Constitution??
"Just maybe the military is staging this trial knowing full well that discovery will lead to a peaceful removal of the biggest thorn in their side Barry Soetoro."
And just maybe your parents weren't brother and sister after all, knowing full well that their knocking boots would lead to someone who wasn't given into spewing paranoid conspiracy blather.
"Dream maybe but it would not be the first time that something was stages in order to produce and end result int the favor of those who wanted to effect change"
Staged like "we have evidence that Saddam Hussein has weapons of mass destruction" ?? Or staged as in the Gleiwitz incident ??

"I NEED YOUR HELP
Posted on | April 24, 2010 | 1 Comment
Most members of US military are Republicans. I need help spreading my campaign flyers among them, as well as spreading the word about the fact that my opponent Damon Dunn was a registered Democrat in FL and that he became a Republican only last year and tried to destroy his prior voting registration record by calling the registrar of voters in Duval County FL and asking to delete it from the database"
It's an interesting claim, but unsupported by reality. According to the Military Times:
"An exclusive survey of some 1,800 active-duty troops shows the percentage of self-identified Republicans has decreased by one-third since 2004, from 60 percent to 41 percent, while the percentage of self-identified independents has nearly doubled to 32 percent during the same period. These career-oriented officers and mid-grade and senior enlisted members are still far more conservative than liberal, but they are less likely today to identify with the GOP, the survey shows.
Much of the shift appears to have occurred only very recently, with the percentage of troops identifying themselves as Republican dropping nine percentage points from 2008 to 2009 and the percentage of those calling themselves independents increasing 10 points over the same period."
And again, active duty military donated 3:1 to Obama over McCain in the general election, (Obama came in 2nd in primary donations behind Ron Paul)
What a surprise, Dr. Orly is wrong or lying. Again.
25 April - "Dr. Conspiracy" at obamaconspiracy.org gives us his "birthers' dozen" as to what he sees is wrong with the birther movement.
"I think pretty much all the birthers exemplify what is so wrong with the birther movement. Here is my “birthers’ dozen”.1. Birthers are unwilling to accept compelling evidence that contradicts their conspiracies.
2. Birthers are willing to accept unverifiable assertions from questionable sources as sound when it supports their conspiracies.
3. They don’t understand the formal fallacy of affirming the antecedent.
4. They get most of their information second hand and fail to check primary sources. As a result, they work from “facts” that aren’t true.
5. They confuse support for Obama with belief that Obama is eligible for president, therefore they assume that every one who disagrees with them does so for the purpose of advancing Obama.
6. They trust advocates that agree with them, treating them as objective sources. The reject non-advocate experts, treating them as biased sources.
7. They believe just about any rumor that comes by as long as it is critical of Obama.
8. They claim to be supporting the Constitution, but tend to ignore the Constitution when it doesn’t let them do what they want to. Example is demanding courts hear cases that the Constitution doesn’t give them jurisdiction to hear.
9. They typically claim to know wildly more than they really do.
10. They don’t care much about what a citation really means as long as it seems to support their position out of context or on the surface.
11. They keep repeating discredited theories.
12. They are immune to rational argument."
Pretty much so, yes.
26 April - Talking Points Memo Muckracker reports on Paul Rolf Jensen's past GOP work and anti-gay crusade.
"The attorney driving the story of the Birther Army doctor facing a court martial for refusing orders is a former Republican Hill staffer and current personal injury lawyer who has dabbled in anti-gay activism and reportedly wrote a letter to the FBI tipping off the feds to New York Gov. Eliot Spitzer's use of prostitutes, months before the scandal publicly broke."
Well, yeah. That's what I reported last friday.
(Bold face mine)
"Jensen is a bulldog. A true student of the law. A brilliant litigator. Not adverse to high profile cases and high risk legal strategies," says (Rodger) Stone in an email. He "understand[s] public relations and the damage this case can do to Obama. Won't be adverse to trying to call Obama for testimony."
And that, I suspect is the main goal of this case is. Not that they believe this, but because they're trying to damage Obama.
"In an appearance with Lakin on the G. Gordon Liddy show last week, one of several media appearances, Jensen hinted that he will try to use discovery to compel Obama to release a birth certificate"
"But Bullwinkle, that trick never works!"
"Also like Hemenway, who once filed a complaint against her daughter's first grade teacher because the teacher announced she is a lesbian, Jensen has been involved in anti-gay activism.
Jensen had filed "25 charges of heresy" against other Presbyterians around the country, CNN reported in 2004. The complaints included cases in which pastors officiated over same-sex unions, ordained gay elders, or were themselves gay."
Bigots of a feather, flock together.

All I have to say about the angry tea bagger is Jesus H Christ on a popsicle stick! That guy really needs serious some mental help.
As far as everything else... Orly doesn't need her campaign website since she doesn't have a ghost of a chance in winning. There's no doubt she needs help but not the kind that she's asking for. And all of this Lakin BS. It doesn't amount to a hill of beans. They may think that they'll damage Obama's presidency but it's only hurting the Republicans.
