And 2010 draws to a close, with the Birtherstani's over two year long temper tantrum showing no signs of ending anytime soon. We've seen cases filed and dismissed. Calls for coups, treason, and rebellion. Paranoid and wingbat conspiracies. Lies, damn lies, and complete bulldada. Rallies and fake trials that draw under 100 people. And in a first, people jailed due to acting upon the birther mythos.
And in all of that, Obama is still President, and is likely to continue as such at least until his first term is completed. And barring changes in the economy or a credible challenger, is likely to win a second term.
According to Gallup, at 703 days into their first terms, approval ratings for the last twelve Presidents were:

GW Bush - 63%
Clinton - 40%
GHW Bush - 58%
Reagan - 37%
Carter - 50%
Ford - n/a
Nixon - 56%
Johnson - 65%
Kennedy - 74%
Eisenhower - 70%

So as you see, Obama's ratings aren't much different from Reagan or Clinton's. And while Carter and GHW Bush both had higher ratings, neither went on to a second term. GW Bush was still on the crest of the post 9-11 wave at that point in his Presidency as well.
But facts and logic have never been the birther stock in trade. To their point of view, the complaint is why hasn't Obama been frog-marched out of the White House in chains, to await prison or execution???

Ostensibly, their positions derive from a good faith belief that Lakin predicated his refusal to obey a direct order, on their shared understanding that Barack Obama, elected President in 2008, is nonetheless Constitutionally ineligible to be his Commander in Chief. Even so, the blind zealous demonstration of support they publicly maintain for Mr. Lakin’s case, if real, only makes sense if they failed to subject his conduct to a reasonable analysis under the applicable law. But they also aimed vituperative darts at the military tribunal, which only makes sense if they blindly ignored the court’s enumerated invitations to Defendant to perfect his case. Only, as usual in these situations, that is, whenever someone publicly questions Obama’s Article II, section 1 eligibility to be President in a forum not designed to entertain such fancy; they adopted the demeanor of spoiled children who in effect supplant reason with holding their collective breath.

27 December - The Knoxville News Sentinel reports on Darren Huff's probation and bond problems.
"Mackie agreed to allow Huff to go free pending trial as long as he wore an ankle bracelet to monitor his movements. Huff later told U.S. Magistrate Judge Bruce Guyton that his job as a landscaper required that he wear boots over which an ankle bracelet would not fit. Guyton, in turn, agreed to let Huff go free without the monitoring device.
Mackie is now alleging that Huff tricked Guyton and his pre-trial supervision officer, claiming employment at an landscaping firm while actually taking a job at a T-shirt shop.
"The government submits that (Huff) has engaged in what amounts to a 'bait and switch' conduct, which has had the effect of evading the original terms of his pretrial release," Mackie wrote.
Mackie is asking Guyton to either jail Huff pending trial or force him to wear the ankle bracelet. Huff's defense team has not yet filed a response. Guyton has set a hearing on the issue next week."

"A friend of Obama’s parents since before the future president was born, Abercrombie is looking for ways to release more information about Obama’s birth in an attempt to quiet the birthers.
Hawaiian law prohibits the public release of a certified birth certificate. Obama has released what the law allows, a “certification of live birth.” The state’s health director has said she verified the original birth record, and the birth was announced in two newspapers in 1961.

"If Lakin felt strongly about this issue, he could have resigned his commission, joined his "birther" group, moved to Hawaii, opened an office and tried to practice medicine where he could have access to the hospital where Obama says he was born. Instead, Lakin will serve six months in a military prison, lose his rank and forfeit 17 years and benefits of active service.
Lakin claimed to have done some soul searching about whether to disobey orders. Well, evidently not enough. With only three years to full retirement and a strong chance at a promotion, he could have run for Congress and really expressed himself about the next presidential election. Now his complaints about taking orders from a military police guard who happens to be a private will fall on deaf ears."
30 December - World Nut Daily writes about the upcoming dismissal of Hollister v "Soetoro" at the Supreme Court level.
"Another legal challenge to Barack Obama's eligibility to occupy the White House has been docketed for consideration before the U.S. Supreme Court, and the plaintiff this time formally is asking that the justices appointed by Obama, the "respondent" in the case, be excluded.
"There is a widespread perception among 'conservative' media figures such as Rush Limbaugh and Mark Levin that judicial appointments have been made by the respondent Obama with the expectation of favors in return. This has combined with a campaign of ridicule and 'unthinkability' on these serious issues led by the press spokesman of the respondent Obama among others," said a "motion to recuse" submitted by attorneys working on behalf of Gregory S. Hollister, a retired military officer.
The motion cites Elena Kagan and Sonia Sotomayor, both of whom were awarded the lifetime tenure positions on probably the most influential court in the world by Obama."

"Thus, it is not hyperbole to state that the entire rule of law based on the Constitution is at issue. Moreover, it would indicate that the respondent Obama ran for the office of president knowing that his eligibility was at the very least in question," it continued."
Funny how the courts kept saying "no" then. And also funny how Berg's involvement in this case has mysteriously vanished from the birtherstani records.....
"At the time of the birth of the respondent Obama in 1961 as alleged, Congress had … the Immigration and Naturalization Act of 1952.
