In today's dispatches, we have the "Western Center for Journalism quoting one of the more persistent - and incorrect - gadflies in birtherstan. Anti-semite Andy Martin continues to pimp his campaign for president. New Hampshire has a short-lived birther bill of their own, while further commentary on Georgia's birther bill confirms it's Constitutional failure.
James O'Keefe is still making videos, and World Nut Daily is still lying about them. Former Congressgopher Fred Grandy's wife seems to be sailing on the S.S. Birther. The Daily Show has fun with the birthers. Professional Seditionist Sharon Rondeau writes about Pam Barnett's crying over the Obama cooties in her case against Damon Dunn. Dr. Kate has Kerchner and Apuzzo on to talk about why they're right and real legal scholars and Constitutional experts are wrong.
Meanwhile Dr. Kate also shows her complete lack of understanding of the Constitution, not to mention lack of research skills and lack of connection with reality. President Obama himself states - again - that he was born in Hawaii. Damon Dunn's attorneys file a rebuttal to Dr. Orly's latest attempts that boil down to "why does this woman have a license to practice law??" "Ulsterman" is still writing fiction, as does the Pest and eFail in their latest fact and logic-free, sedition-filled slam against union workers.
And many of you have noticed the new layout of "Bad Fiction". It's the first step of several planned updates to make things easier for my readers.
2 March - "Floyd", at the World Nut Daily - affiliated "Western Center for Journalism". (it's unknown if the "Floyd" in question is it's director, infamous GOP dirty trickster Floyd Brown), shows their journalistic skill by reprinting an article from unlicenced "pastoral counselor" Sam Sewell.
"The lawsuits have presented a bewildering array of claims, including, among others, that: Obama was born, not in Hawaii, but Kenya; if he was born abroad, his mother, an American citizen, was legally too young to confer that citizenship on him at birth; the Hawaiian short-form certification of birth published on the Obama website is a forgery; that short-form certification could have been legally issued in 1961 to certify a birth occurring elsewhere than Hawaii; Obama is ineligible because, wherever he was born, he had dual-citizenship since his father was a British citizen and the British Nationality Act of 1948 made his son a British citizen at birth; Obama identified himself as a foreign student at Occidental College, Columbia University, and Harvard Law School; when Obama traveled to Pakistan in 1981, he did so on an Indonesian passport at a time when Indonesian law forbade dual citizenship, etc., etc."
And none of those lawsuits have ever brought forward any facts or credible evidence to support any of the claims they made. The "forgery" claims come from several disreputable sources with no forensic background and are completely based off of the JPEG published rather than the actual document. And under both US and Indonesian law, there was no way for Obama to be granted Indonesian citizenship as a child.
In short, the claims in these court cases have never had the slightest amount of credible evidence to support or prove the case.
"There is no reason to analyze those lawsuits here in detail. Their lack of success cannot be ascribed simply to a hyper-technical evasion of judicial responsibility."
No, it can be ascribed to the above mentioned complete lack of credible evidence and the instability of the plaintiffs filing said cases.
"On the other hand, it is fair to say that the Obama controversy involves significant issues of fact and law that deserve some sort of official resolution."
You mean like the State of Hawaii confirming that Obama was born in that state?? Been there, done that.
"I suggest no conclusion as to whether Obama is eligible or not. But the citizens whom the media and political pundits dismiss as "birthers" have raised legitimate questions. That legitimacy is fueled by Obama''s curious, even bizarre, refusal to consent to the release of the relevant records. "
Funny, he's published a copy of his State of Hawaii COLB, the State of Hawaii has repeatedly verified they hold a copy of his birth certificate, and his name appears in the birth index records. In other words, he's provided more than enough evidence to show that yes, he was born in the State of Hawaii.
"The power to investigate can be exercised by a House committee provided that the investigation is within that committee''s authorization as determined by the House. An investigation into Obama''s eligibility by a committee or subcommittee of the House could have several legitimate objectives, including among others:
1. To ascertain the facts, compelling by subpoena the production of all the available records relevant to Obama''s eligibility, including the complete Hawaiian records of his birth; his passport records to ascertain whether he traveled to Pakistan in 1981 on an American or other passport; the records from Occidental College, Columbia University and Harvard Law School to determine whether Obama described himself as a foreign student; and such other records as may be relevant. The disclosure of such information to the public would be an appropriate exercise of Congress'' "informing function."
Oh, what a surprise, the same crap the birthers have been demanding since the summer of 2008.
7 March - Anti-semitic internet outhouse Andy Martin certainly does like pimping himself, as his latest press release shows.
"...unlike Mike Huckabee or other Republican presidentials that afterwards have to eat their words, Martin made no mistakes. Andy defended his views to the point that the liberal San Francisco audience started tilting in favor of his conservative views."
I suspect it was more people calling in to harass the wackadoodle.
"(Brian Copeland Show March 6th)(when posted by the station on its web site)"
He does know that Brian Copeland is a comedian, right?
"And now you know the rest of the story: why Barack Obama is afraid of Andy Martin as the Republican Party’s presidential candidate in 2012."
Yeah, I'm sure he laughs himself to sleep every night at the thought.
8 March - New Hampshire may have a birther bill of their own.
"Election Law Chairman David Bates said Tuesday that his committee will consider amending a bill Wednesday to require candidates to provide a birth certificate and affidavit swearing they're old enough and lived in the United States for 14 years as called for in the U.S. Constitution before being allowed to file to be on New Hampshire's presidential primary ballot.
Bates, a Windham Republican, said he does not want people to think this is aimed at President Barack Obama and may seek to make the effective date in 2013. Some have raised questions about whether Obama was born in this country."
8 March - Far-right propagandist James O'Keefe catches NPR Sr. Vice President of Development Ron Schiller and his coworker Betsy Liley on video. And they're less than impressed by the birtherstani.
"Our coverage, if you look at our coverage, you would say that science coverage has accepted that climate change is happening and we're covering it. But in politics, our Washington desk, might actually cover it should it resurface as a political issue...this debate."
"So it's more complicated than saying, 'Where was Obama born?' In Hawaii or not? Is he an American citizen or not?" she asks. Ms. Liley then describes the birthers as conservatives.
"We're not covering the birthers. We are not covering them. There's a whole movement within the conservative group about questioning something that Obama has said as fact, 'I was born in Hawaii, when it was the United States.' The group that questions this, some of whom are commentators...I don't know any who are Democrats, but they are primarily conservative commentators and people who follow them question if Obama is [a citizen]," she further explains.
"I think the challenge in our society now is that we are questioning facts. It's not opinions we are debating. I mean, what are the facts? Is the world flat? Is that the next question we're going to debate?" Ms. Liley wonders.
Mr. Schiller chimes in later saying, "The main point here is that it is not our responsibility to present the opinion of a non-scientist through our science desk. All educated scientists accept that climate change as fact. On the political side, however, where it is not accepted as fact, and the fact that debate is happening is news and it's really important news. And our point of view requires that we cover that debate, if for no other reason than to have Americans understand there are still people who believe that it is not fact."
8 March - Former Iowa Congressman Fred Grandy is off the radio in Washington DC.
"Former Iowa Congressman and “The Love Boat” actor Fred Grandy is no longer serving as a radio host for Washington, D.C.,-based WMAL.
Grandy and his wife, Catherine Mann-Grandy (known as “Mrs. Fred” when she appeared on the show), had used their program for the past several months “to warn about the spread of radical Islam at home and abroad,” according to a quote Grandy provided to London’s Daily Mail. Although the station says Grandy resigned, the host contends that he was forced to leave."
O RLY?? And why else??
"In addition to theorizing how Muslims plan to harm the U.S., Catherine also noted her agreement with the “birther” movement, which believes that President Barack Obama is foreign born."
Oh well. Maybe he can get together with Victoria Jackson and work on the revival of their acting careers.
8 March - The Daily Show's Jon Stewart pokes fun at the birthers among other targets.
8 March - Remember Pam Barnett throwing a fit because the judge assigned to Barnett v Dunn had been appointed by Obama, and she didn't want Obama cooties on her case??
Well, professional seditionist Sharon Rondeau pens her usual tripe in the Pest and eFail, this time on Barnett's tantrum.
"Originally Judge Carter had stated that Obama’s constitutional eligibility needed to be determined and that there “would be no dismissals on procedural issues,” Carter later reversed himself and dismissed Barnett v. Obama on October 29, 2009. At the beginning of that month, he had hired a clerk from the law firm which had represented Obama in other lawsuits filed against him alleging his ineligibility."
Ah, one of Dr. Orly's classic lies. Judge Carter said if he was only if he was satisfied by the claims that he would agree that eligibility needed to be determined. He wasn't and the case was dismissed.
"However, Barnett told The Post & Email that also at issue was whether or not Dunn had been truthful when he answered the question, “Have you ever registered to vote before?” as “No.” Capt. Barnett stated, “He had lied on his voter registration saying that he had never registered to vote before. "
The question was "if he had ever registered to vote in California". You left the state out.
"I complained to the Secretary of State’s office, which said they wouldn’t do anything about it because ‘it wasn’t proven that he did it maliciously.’” Barnett stated that she notified the California Attorney General’s office about the falsified voter registration form but that they did not respond at all.
“That was the spark that made me decide to follow a lawsuit against her. "
Well, that and the fact you were Dr. Orly's Northern California Campaign Manager.
"Her letter asking Judge Ishii to return her case to Judge Damrell is posted here. However, Judge Ishii refused, stating that the plaintiff “provides no legal grounds to reconsider the propriety of the reassignment.”"
More like "plaintiff is batshit crazy."
And in comments (bold face mine)
Oh look, Padawan Pauly:
"Jedi Pauly says:

This is very significant. Pam Barnett has really got hold of the beast. This issue with the Judge being an Obama appointee is very good as a legal avenue dropped in Barnett’s lap to raise the illegitimacy of Obama. Now if Pamela Barnett could just disabuse herself of the failed Unity Theory regarding Article II “natural born Citizen” and learn about the correct theory of law the Natural Law Theory that I have discovered and been trying to teach everyone then Pamela would really be armed and empowered to take on the system. I wish she would talk to me an let me educate her some."
Translation - "If Pam Barnett would only drop her insane legal conspiracy theory for one that's even more crazy, everything would be fine!"

...Why so many Americans keep calling this smooth-talking street hustler “President” is totally beyond me."
Racist much? And the majority of American voters elected him into office, which is why he's called "President".
"Ed '74 says:

As I understand it, there are 12 states that should have, in place, a law that require proof of eligibility to be president before the 2012 election. If that is true, then Obama will not run again. There is no way he can prove that he is eligible to run. The battle will be won."
Except the slight little fact that several of those bills have died in committee, none have been voted on yet, and the majority are unconstitutional and would not stand up to a challenge.
Next?

None of the states have actually passed a “Barry” bill to force candidates to prove their eligibility before being placed on the ballot, and, according to what I have heard, at least three states, Arizona, Montana and Oklahoma have already dropped or “tabled” their Barry bills. Arizona’s failed to get out of committee when 3 Republicans, one of whom was a sponsor of the bill, refused to vote for it.
I have a feeling there is some strong, “persuation”, going on in every state that is considering a meaningful bill to force candidates to prove their eligibility to drop their efforts.
Every state should be monitored very closely to insure this time that they actually follow the laws and rules they already have on the books. I believe in some cases this would have prevented Barry from getting on the ballot in 2008. I am not certain of that though, because I don’t know what the various state laws and rules currently are.
We cannot depend on new eligibility laws to prevent Barry from usurping a second term though I. of course, hope some states will follow through and sign their Barry bills into law."
Well, at least he's honest that the only intent of these bills is to try and keep Obama off the ballot.

...I cannot begin to fathom why most every judge, politician and government official is so willing to ignore, bend and break the very law and system they have take a solemn oath to uphold, simply to protect that worthless, two-bit fraud currently squatting in We The People’s house. For what all he has done to our great country, he really is a piece human garbage who should be kicked to the curb alongside the many other sacks of trash cluttering up Washington, DC. I think most of them must know in their hearts that something is very wrong and that their precious Pied Piper is actuality an ineligible usurper. Why do they continue tolerate it, many willingly so? May the whole lot of them be given due process and be judiciously trash-compacted into the smallest, dankest, darkest prison cell."
You use those words "due process", I do not think you know what they mean.
"If it is race riots they fear, I say “bring it” for it’s long past time to cleanse ourselves of those who support divisive, thuggish race-based tribalism over melting-pot America’s belief in equal opportunity for all (I say this as a true “Heinz 57″ main-stream American mutt who feels not even the slightest twinge of bogus, so-called white guilt)."
So what's your handle at "Stormfront"??
"If it is utter destruction of the dollar by the Sorros-Saudi cabal that holds them hostage in fearful inaction, then I say I would rather live (or die) as a free sovereign Citizen in abject poverty than squirm under the oppressive thumb of new world order socialism. Is there not one freshman Tea Party Senator or Representative who loves his or her country enough to brave the derision of the regime-stream media and defend the Constitution by demanding and/or instigating investigations of Obama and his enablers? What unbelievable depths of depravity has our once great country fallen to?"
Someone needs to replace their tinfoil, the crazy rays are getting though again.

Lets see where we are now, and lets just get serious for a lousy minute, while we talk about “THE ONE”… the one who has many false SS numbers… the one who has falsified a birth certificate, while hiding his Kenya BC… the one who hides all his historical data from the American people… the one who is trying to demolish the USA by way of Jihad… the one who supports Muslim Terrorists at every opportunity… the one who is trying to introduce Sharia Law into the USA… the one who is intentionally and viciously bankrupting America… the one from ACORN – you know the “Community Organizer”… the one who lost his law license, but hides the reason from us… the one whose Modus Operandi (MO), is via RICO – Racketeer Influenced and Corrupt Organizations… the one who admires, and follows Alinsky, Wright, Ahres, Soros, Chavez, Mao, Ahmadinejad, and other such ilk…the one who was born in Kenya, and pretends to be America’s President… the one who practices taqiyya, because we know he’s really a Muslim… the one who practices dhimmitude on us, because he believes that he has accomplished Jihad victory over us … the very one who doesn’t believe in God, because he thinks he is God."
Wow, I don't think there was a single accurate fact in that word salad.
8 March - Politico reports on New Hampshire's birther bill. And it doesn't seem to be doing well.
"A New Hampshire bill that would have required presidential hopefuls to provide their birth certificate to get on the ballot appears to be dead in the water."
Oops.
"The state House's Election Law Committee voted the bill "inexpedient to legislate" in a unanimous vote. "
Double oops.
"They need to produce a certified copy of the long form of their birth certificate and an affidavit swearing to residency," Republican State Rep. David Bates told the Associated Press."
That sounds familar.
"Bates, who chairs the election law committee, insisted that the measure was not aimed at Obama...."
Why don't I believe him?
"...and backed an amendment that would make the bill effective in January 2013, instead of 60 days after passage."
Okay, one note of sanity.
"This potential amendment could represent a threat to our first-in-the-nation primary as it gives other states reason and desire to try to jump us in line," House Republican Leader D.J. Bettencourt, who opposes the measure, said in a statement.
Bettencourt said the GOP leadership "will strongly oppose this amendment should it reach the House floor. It is unnecessary and detracts from important business, namely our economy."
Triple oops.
8 March - And look how World Nut Daily spins the NPR video, including their use of a video from "Birther Report"
"A top officer for National Public Radio has confirmed that many Americans still question whether Barack Obama is eligible to be president, but that the tax-supported organization just isn't reporting on it."
Because, as the video points out, they deal in facts, not conspiracy theories.
"Liley also cites a "stunning" study revealing that "51 percent of Americans now believe that Obama was not born in the United States."
You mean the study that claimed 51% of REPUBLICANS believed that? Or are you claiming that Republicans are the only real "Americans"???
Lies, damn lies, and World Nut Daily.
9 March - Dr. Kate announces two very special guests, namely Charles Kerchner and DUI attorney Mario Apuzzo. Kerchner and Apuzzo are, of course, the plaintiff and attorney behind the de Vattelist "Kerchner v Obama" case that was rejected at every level up to and including the Supreme Court.
"On March 9, Revolution Radio l welcomes the return of Commander Charles Kerchner (Ret) and Attorney Mario Apuzzo, our long time favorites."
They do like them some failed attorneys, don't they?
"Tonight we will review the implications of the dismissal of the Hollister case, particularly the failure of Justices Sotomayor and Kagan to recuse themselves. In addition, we will discuss the numerous state actions on the eligibility legislation front. Arizona’s effort as well as other states will be compared and contrasted."
And I suspect the fact that these state actions are, to put it bluntly, unconstitutional, will fail to be noted by that crowd.
"The phone line will be open during the second hour of the show for your questions."
As long has one agrees with them 110%. Dissenting voices or people trying to bring facts and reality to bear get booted out of their echo chamber. Only the approved party line for Dr. Kate and the rest of her Comrade Birthers. da?
And in "isn't it ironic":
"Jan
March 9, 2011 at 3:52 am
If you have ever known a pathological liar, what obat says in this video is so typical. They lie so much they believe their own lies and believe you are so stupid you will never catch on."
Funny, when I think of someone who lies "so much they believe their own lies and believe you are so stupid you will never catch on.", I tend to think of Dr. Kate, the crew at the Pest and eFail, and the rest of the birtherstani.
9 March - Dr. Kate shows her understanding of the Constitution is as flawed as her belief that water has memory.
"The Constitutionalists have clearly proven through evidence, argument, and historical research the meaning of “natural born citizen” as stated in Article II, Section 1, Clause 5 of the Constitution."
Well, yes. People who have studied the Constitution, 200+ years of case law and civil code, US law, legal scholars, and the historical basis of our legal code have agreed that a "natural born citizen" is someone who was either born in this country (jus soli) or born outside this country to a citizen parent or parents. (jus sanguinis).
However, some conspiracy crackpots have argued a "blood and soil" belief that demands both citizens be parents, and have based this on an English translation of the work of a Swiss legalist, and ignores not only the fact said translation is ten years newer than the US Constitution, but that the original French makes no such claim. Furthermore, they ignore the references in said work to English civil code (which US legal code is based on), weapons ownership, and the right of the state to kidnap women to continue one's country. Said legal theory has been rejected by every single court that they have attempted to bring it up in.
"It is as plain as day, not a complicated thing. Barry Soetoro Obama may not even be an American citizen."
The State of Hawaii and the Federal Government, not to mention US law, the US legal code, and the US Constitution, seem to disagree with you.
"Further, the Constitutionalists have also proven that there has been coordinated activity to defraud the American public among government agencies, the media, universities across the United States, private citizens, the judiciary, banks and corporations. They have aided and abetted the destruction of the United States through the installation of a foreign usurper who is implementing a foreign agenda. It has been a long time in the making, but the ‘mechanics’ of the usurpation have names attached to them."
No, a group of conspiracy cranks have made a batch of claims about such, but failed to prove a single case.
"If We Are Wrong…
*Why spend the money?
Ignoring the fact that the money spent has been nowhere near the amount the birtherstani claim, there's that whole thing about "having to defend himself against lawsuits from conspiracy nuts and outright racists".
"Why jail Lakin?"
Because he disobeyed (and admitted he had) a direct legal order given him in his immediate chain of command.
"Why dismiss cases?"
Because they have no legal validity or credible evidence to support them?
"Why the murders?"
The link here goes to a birther site that promoted the myth that Obama had "Lt. Quarles Harris" murdered, and ignores the fact that Leiutenant Quarles Harris, Jr. (note the spelling, it's his name, not a rank, he was never in the military) was a petty crook arrested on credit card theft and identity theft charges
"Why go after patriotic Americans?"
Because he hasn't gone after Patriotic Americans. However, a batch of sedition-minded cranks seem to see some deep dark conspiracy where they blame everything on Obama even if it's something as simple as their breakfast cereal going stale.
"Why ‘quietly scrub‘ legal manuals?"
They haven't. Leo Donofrio seems to think he has, but the poker playing sometimes-attorney has a past history that's flakier than French pastry.
"Why have the media go blind for now three years?"
You mean "why hasn't the media ignored the facts and simply parroted birther lies and false claims??"
"Why the feigned stupidity and obtuseness?"
Have to ask Mike Huckabee about that one.
"The flat earth eligibility deniers, ‘conservatives’ in traitors clothes–all communists by proxy–will have to answer to their maker, and will answer to the American people."
Oooh, threaty.
"I laugh when I think of how young these idiots are–Dowd, Cooper, Rove, Brazille, O’Reilly, so many others. They have decades ahead where they will be the scorn of history, of their children and neighbors, of the world… for their role in this deception.
Game over for them."
Oh, O'Reilly and Rove are usually laughed and mocked anyway. But not because they're saying the birtherstani claims are batshit insane - because anyone with a trio of functioning brain cells who isn't blinded by hate can see that much.
"The Supreme Court must not–and will not– be allowed to stand in the shadows having ducked their constitutional responsibility to hear this, and the other eligibility cases. Sotomayor and Kagan should be impeached."
"Wahh! They didn't do what we demanded they do, wahhh!!!"
"Surround the Supreme Court also beginning March 19th! Demand they uphold their oath to the Constitution or step down!"
Let me know if your march reaches the triple digits. And what the Supreme Court police think of your attempt.
"Here are some questions that I am pondering."
"Are you pondering what I'm pondering?"
"I think so Kate, but if they call them sad meals, nobody would buy them!"
"It is clear that this centralized government–and those who have hijacked it–cannot, and will not last. Our real form of government has been so perverted by illegal amendments wrought by scoundrels that only purge of these amendments and individuals, plus a long-term effort, will revive the Republic at the federal government level."
O RLY??
"Do we enable its fall by withholding all federal tax payments, holding strikes, becoming a 1099 employees, just standing down? Do we push them over the edge on our terms?"
Why don't you ask Bob Schultz and the other tax protesters how well that trick works?? Be prepared to take it in the shorts though - the IRS has no sense of humour.
"Is it time to plan the underground railway to restoration of the Republic, or the creation of the Second American Republic?"
No, I think it's time for you to plan to see a good therapist and have your issues treated by a responsible professional.
"No matter what the hype, the NWO will not be able to take this country without a big ass fight. The obots can hide in the FEMA camps while the grown ups take out the NWO."
Funny how the "grownups" in this case are the ones throwing temper tantrums and making stuff up because they can't stand the idea of Obama being President.
"So…the Tree of Liberty is dying and needs water. At the very least we can all start to say ‘no’ in our own way, beginning right now."
Oh, I'll say no alright. No to crazy seditionists who spit on everything this country stand for and preach revolution, sedition, military coups, armed overthrow, and treason.

There is a large article that has been picked up by major news agencies about the FBI watching and arresting anyone involved in the sovereign citizen movement. I have heard that the FBI is watching patriots. Sovereign citizens, militia, birth certificate activists are all being followed and even bugged by law enforcement. "

It is tiring for all of us birthers to have the burden of proof pushed upon us, when in fact it should be on the fraud in the White House."
Except for that minor detail that in the US Justice System, burden of proof rests on the accuser. And so far the birthers have never shown any credible proof or evidence to support their claims.

9 March - President Obama himself makes a comment about the birtherstani.
"While calling for less fighting between Republicans and Democrats, President Obama also sent a message last night to critics -- the so-called birthers -- who say he was not born in the United State (and is therefore ineligible for the presidency).
"I was born in Hawaii, what can I say?" Obama told Democratic donors in Boston. "I can't change those facts."
Obama spoke as a state senator in New Hampshire proposes a bill that would require candidates in party presidential primaries to provide birth certificates and affidavits swearing they are at least 35 years old and have lived in the United States for 14 years."
9 March - PolitiFact Georgia takes a look at Loren Collins' analysis of the Georgia birther bill. And their result is "true".
"Hatfield, a Waycross Republican, said the founders thought that presidents should be born in the United States, their parents should be citizens, and dual citizens should be barred to avoid foreign influence. That’s why the Constitution uses the term "natural born citizen" instead of "citizen."
Under Hatfield’s definition, Obama couldn’t be president. "
So Hatfield is a de Vattelist. Surprise surprise.
"We presented Hatfield’s argument to legal experts on U.S. citizenship. They agreed that Hatfield’s concept of "natural born" citizenship makes little, if any, legal sense.
"If that [the bill] passes in Georgia’s Statehouse, it will be challenged and it will be struck down as unconstitutional. I am 100 percent confident," said Peter Spiro, a Temple University law professor.
Hans von Spakovsky, a senior legal fellow with the conservative Heritage Foundation, said Hatfield’s bill contains a dual-citizenship ban that does not exist in the Constitution.
"It’s trying to add an additional requirement to the eligibility for president," von Spakovsky said.
The concept of "natural born citizen" is more complicated than it seems, scholars said. The founders did not clarify what the term meant, but experts have long interpreted it to refer to those who are U.S. citizens at birth. "
Funny, isn't that what people have been trying to tell the birtherstani for a while now??
"Emory University professor Polly Price explained. The United States adopted the concept of "natural born citizenship" from the English, Price said. For nearly 180 years before the Constitution was drafted, people were natural born citizens of England if they were born on English soil.
This understanding was widely accepted in the U.S. during the colonial period. People born in a colony were considered citizens of that colony, Price said.
"It may be that some of the founders intended to include only birth on U.S. soil as their understanding of ‘natural born citizen’, but it certainly would not have included that their parents also had to be U.S. citizens," Price said.
Collins is right. HB 401 does create eligibility requirements that aren’t in the Constitution. We rule his claim True."
Only because it is true.
Funny how all these legal scholars and law experts all say the same thing, and yet the main legal experts touting the de Vattelist line are a part-time attorney/poker player who claims he's an avatar of God, a DUI expert, and a dentist with a law degree from an unaccredited on-line law school.
9 March - And it looks like New Hampshire's birther bill is DOA.
"A House committee voted 18-0 today to recommend that the full kill a so-called "birther" amendment that would require candidates to present their birth certificates when filing to run for President in the New Hampshire first-in-the-nation primary."
So much for that attempt.
"Proponents then tried to make the bill more palatable by moving the effective date back from 60 days after passage to Jan. 1, 2013 to have it take effect after the primary.
That effort came close, but failed on a 10-8 vote, said House Election Law Committee Chairman David Bates, R-Windham, a supporter of the measure.
Bates said a motion recommending that the House vote to retain the bill - that is, to put off consideration until next year - failed by a wider margin.
At that point, he said, the committee voted unanimously that the House find the bill, which in its original form was unrelated to the "birther" issue, "inexpedient to legislate," which is, in effect, to kill the bill."
One down, several more to go.
9 March - Updates in Dr. Orly's lawsuit against Damon Dunn.
Objection to Taitz' Opposition to Dunn Motion for Judgment on the Pleadings (Scribd link here)
"Contestant's flagrant disregard for the Code of Civil Procedure sections governing service of pleadings and certificates of service, and her disregard of the California Rules of Court related to length of memoranda is without explanation and inexcusable. Due to Contestant's refusal to stay within the bounds of reason for preparation, filing and service of civil motions in this Court, Defendant's counsel's task in replying to Contestant's Opposition has become unreasonably burdened."
Welcome to OrlyLaw 101.
"For these reasons, Defendant requests an order striking Contestant's Opposition in its entirety. In the alternative, Defendants request an order striking all of the pages following the fifteenth page of argument in Contestant's Opposition."
*Snork*
"Contestant's purported "Certificate of Service" fails almost every requirement in section 1013a. Contestant's Certificate:
1. Does not state that Contestant is an active member of the State Bar of California;
2. Does not state that Contestant is not a party to the cause;
3. Does not state the date and place of deposit in the mail;
4. Does not state the name and address of the person served as shown on the envelope;
5. Does not state that the envelope was sealed and deposited in the mail with the postage thereon fully prepaid.
Because Contestant plainly has not maintained "strict compliance" with CCP section 1013a, this Court is without jurisdiction to consider Contestant's Opposition. As a result, the Court should strike the Opposition in its entirety, and grant Defendant's Motion for Judgment on the Pleadings outright."
Ah, but rules are for lesser beings, not Dr. Orly Taitz, super lawyer!!!
"At this time, Contestant's filing and service tactics have become so harassing as to make Defendant's timely reply to Contestant's Opposition nearly impossible."
Which should come as no surprise to anyone who has ever had to deal with Dr. Orly.
"Reply to Opposition to Motion for Judgment on the Pleadings" (Scribd link here)
"Contestant's Opposition is fraught with red herrings, inapplicable citations, and wandering legal arguments. Her Opposition utterly fails to refute Defendant's statute-based contentions that her Election Contest was untimely filed, is now moot, and improperly requests relief not permitted under the Elections Code."
So in other words, standard Dr. Orly.
"Moreover, despite her strenuous protestations otherwise, Contestant does not maintain a cause of action for common law fraud. Not only has Contestant failed to properly allege with the required specificity a cause of action for fraud, she also has wholly ignored the Secretary of State's "Voter Registration Regulations" regulations which address her very grievance -- that Defendant omitted prior out-of-state (and expired) voter registrations on his California voter registration affidavit. Specifically, California Code of Regulations, section 19050.6 (captioned: "Requirements for Valid Registration") states that "[i]f no prior registration is shown [on the voter registration affidavit], it shall be presumed that the person is not registered to vote in California." (Emphasis added.)"
The real problem being, of course, is that Damon Dunn was a black man who failed to step aside so that Dr. Orly could take her rightful place. It all makes perfect sense, assuming you're a nitrous-huffing dolt with rats gnawing on their brainstem and tarantulas glued to your eyelids.
9 March - And "Ulsterman" is still making stuff up.
"But what about a big scandal? What about the big scandal? The one you hinted at several times before?
(Sighs) Yeah…what about it then? You tell me. What about it…
That doesn’t sound too encouraging. So the scandal – it doesn’t exist?"
More than likely, no, no it doesn't.
"Who? Who is taking over for you? Will I have access to their information? I’d be happy to help any way I can."
Maybe Fruity Pebbles can give you better answers than Rice Krispies.
"So you think President Obama should be impeached?
Impeached? -Expletive- no. That’s too good for him. President Obama should be arrested. What’s that word you used a while back – sedition? Well there you go – that pretty much sums up this whole stinking cesspool of a White House right there. Look, I was suspicious of this guy before – but based on what I was told these past few months…the man, those around him (pauses) …this president is the most corrupt thing to have sat in the White House in our lifetimes. Being part of that campaign in 2008…it makes me sick. Do you understand what I’m saying? Sick. To have played any part in getting him elected…Obama isn’t just incompetent…he’s something else. Something worse. I’ve been around a lot of asshole-arrogant politicians. Plenty of those. Even a few outright criminals. This is different. This is a whole other level of corrupt."
Rigggghhhhhht.
9 March - The Pest and eFail doesn't seem to understand the concept of "irony". Or "hypocrisy" for that matter.
"Every day it is more and more obvious that the now fully Marxist/Leninist Democrat Party USA will never accept election results unless their members win. "
This published on a site that refuses to accept the results of the 2008 general election and seeks to overturn those results and the president elected in that race.
"Irrespective of the state of our nation, they are bound and determined to carry on their theft of our goods as their corrupt Unions continue to demand that taxpayers–who earn far less on average than do they–foot the bill for their grotesquely expansive lifestyles. "
Yeah, how dare they demand that everyone - both union and non-union - get a decent living wage and benefits, and be allowed to organize if their workplace is treating them badly. Who do these uppity serfs think they are, human beings??
"Bussed in from other States, Unions take over–as they did in Wisconsin–State Houses, cause damage and leave their trash which can cost taxpayers additional millions of dollars in clean-up. "
You know, if you're going to mindless repeat lies, then at least repeat ones that are a bit easier to disprove. Quote:
"While urging a judge to scale back protests, a state Department of Administration official said the state Capitol sustained $7.5 million in damage. State officials could not immediately provide a basis for the number, and later backtracked from it. The new estimate: $347,500, some 20 times less than the original one. And there are indications that even that could be highThis smells like an effort to pour gas on the anti-protester fire. The claim was ridiculously high. And that gets a Pants on Fire rating."
But we're talking the Pest and eFail, where things like "facts" or "journalism" are considered unneeded and biased.
"In Wisconsin, State Union members (government) make a minimum of 25% more than those in the private sector and, often, salaries and compensation for government Union members exceed double what those in the private sector are paid."
And how much compared to unionized workers in the private sector???
"Note: Although leftists continue to tell us the majority of polled people agree with the Unions’ stance, I seriously doubt taxpayers support the lunacy of being forced to pay others more than they earn for the same types of work."
Translation - "Wahh, the polls don't agree with my opinion, wahhh!!"
"...the war we are now fighting comes from within and appears to have insidiously extended itself firmly into the White House and the other two branches of what was once our government. It is a war We-the-People (the ones who still actually believe in the US Constitution) must win or we will surely die. It’s just that simple and just that dire. And…our time remaining to win it has almost run out."
They are REALLY ratcheting up the sedition of late, aren't they?

Must be the recession that has dried up all the PayPal money. Gotta whip up the faithful. Keep squeezing that SS pension money out of those retirees.
