30 August - Today is Dr. Orly's birthday. And as a present, Judge Royce Lamberth issues a Memorandum and two orders.
08/30/2011 33 MEMORANDUM OPINION. Signed by Chief Judge Royce C. Lamberth on August 30, 2011. (lcrcl2) (Entered: 08/30/2011)
(Scribd link here)
"Before the Court is defendant’s Motion for Summary Judgment [21]. Upon consideration of defendant’s motion, plaintiff’s opposition [31], the reply thereto [32], the entire record herein, and the applicable law, the Court will grant summary judgment in defendant’s favor for the reasons set forth below."
Goes to get popcorn, as this should be good......
"Ever persistent, plaintiff has once again come before this Court in an effort to uncover “the biggest cover up in the history of this nation.” Pl.’s Opp’n to Mot. for Summ. J. 20 [31]. She believes that the President is using a “fraudulently obtained” social security number and that the Social Security Administration—among other agencies—is involved in a scheme to “cover[] up social security fraud, IRS fraud, elections fraud and possibly treason” committed by the President. Id. at 5–6, 13. As her numerous filings with the Court demonstrate, plaintiff will stop at nothing to get to the bottom of this alleged conspiracy. Unfortunately for plaintiff, today is not her lucky day."
LAUGH!!!!!!
"Indeed, plaintiff makes no secret of her intention to use the redacted Form SS-5 to identify the holder of social security number xxx-xx-4425—or, as plaintiff puts it, to confirm her suspicion that the President is fraudulently using that number.
Plaintiff’s allegation that the requested Form SS-5 is associated with a public official does not diminish the privacy interest at stake here. Even if plaintiff’s allegation were true, an individual’s status as a public official does not, as plaintiff contends, “make exemption 6 irrelevant to him and his vital records.” Pl.’s Opp’n to Mot. for Summ. J. 18 [31]. “Individuals do not waive all privacy interests . . . simply by taking an oath of public office.” Lissner v. U.S. Customs Serv., 241 F.3d 1220, 1223 (9th Cir. 2001); see also Nix v. United States, 572 F.2d 998, 1006 (4th Cir. 1978) (explaining that public servants are not “stripped of every vestige of personal privacy,” particularly where the release of identifying information could “subject them to harassment and annoyance in the conduct of their official duties”); Kidd v. Dept. of Justice, 362 F. Supp. 2d 291, 297 (D.D.C. 2005)"
The screeching from the nitrous queen must be hitting the supersonics around now.
"But plaintiff’s unsubstantiated allegations, without more, do not persuade the Court that the requested information “would likely disclose” official misconduct, id., and thus do not affect the calculus here.
On the other side of the ledger, plaintiff has identified no legitimate public interest that disclosure of government records would result in a clearly unwarranted invasion of privacy, the relevant public interest to be weighed against the privacy interest is the extent to which disclosure would contribute to “public understanding of the operations or activities of the government.” Nat’l Ass’n of Home Builders v. Norton, 309 F.3d 26, 33 (D.C. Cir. 2002)
*chuckle*
"And plaintiff—for all her allegations—has produced no “evidence that would warrant a belief by a reasonable person that the alleged government impropriety might have occurred.” Nat’l Archives and Records Admin. v. Favish, 541 U.S. 157, 174 (2004). Her vehement allegations of fraud consist of mere “bare suspicion[s]” and thus fail to satisfy the public interest standard required under FOIA"
Can we say "fail" again???
"4 Plaintiff submits the Selective Service registration acknowledgment form associated with security number xxx-xx-4425, Pl.’s Opp’n to Mot. for Summ. J. Ex. 1 [31], which apparently is “readily available on the world wide web.” Pl.’s Am. Compl. 3 [3]. She argues that this form establishes that the President is fraudulently using social security number xxx-xx-4425, Pl.’s Opp’n to Mot. for Summ. J. 13 [31], and that the Selective Service and the SSA are “engaged in a cover up” of his fraud. Pl.’s Am. Compl. 3 [3]. The Selective Service does not release registration acknowledgment forms to the public; only a registrant himself can request proof of his registration. See Registration Information, http://www.sss.gov/ack.htm. The Court can only conclude that plaintiff has submitted a form that some individual obtained through a false request and subsequently posted online."
(Snip)
"As with the registration acknowledgement form discussed above, the Court can only conclude that plaintiff has submitted a page that some individual obtained under false pretenses—that is, by representing himself as the President’s employer. The Court notes that both documents submitted by plaintiff are incomplete; the address on the registration acknowledgment form and the employer identification number on the SSNVS page have been blacked out, further confirming the documents’ fraudulent origins. For all of these reasons, the Court will disregard both documents as well as any arguments made in reliance on them."
Laughs at the swipe at Hollister AND the fact the court took note the documents were illegally obtained.
"Plaintiff challenges no other aspect of the SSA’s response to her FOIA request. Accordingly, the Court finds that defendant is entitled to summary judgment in this case.
IV. CONCLUSION
For the reasons discussed above, defendant’s Motion for Summary Judgment [21] will be granted. A separate Order consistent with this Memorandum Opinion shall issue this date.
Signed by Royce C. Lamberth, Chief Judge, on August 30, 2011."
Happy Birthday Orly.
"08/30/2011 34 ORDER granting 21[RECAP] defendant's Motion for Summary Judgment. Signed by Chief Judge Royce C. Lamberth on August 30, 2011. (lcrcl2) (Entered: 08/30/2011)"
(Scribd link here)
"ORDER
Upon consideration of defendant’s Motion for Summary Judgment [21], plaintiff’s opposition [31], the reply thereto [32], the entire record herein, and the applicable law, and for the reasons set forth in the Court’s Memorandum Opinion issued this date, it is hereb yORDERED that defendant’s Motion for Summary Judgment [21] is GRANTED.Final judgment is hereby entered for defendant, dismissing this case with prejudice.
SO ORDERED.
Signed by Royce C. Lamberth, Chief Judge, on August 30, 2011."
"08/30/2011 35 ORDER denying 12 Motion to Compel; denying 18 Motion to Strike; denying 19 Motion for Clarification; denying 20 Motion for Default Judgment; and denying 22 Motion to Compel. Signed by Chief Judge Royce C. Lamberth on August 30, 2011. (lcrcl2) (Entered: 08/30/2011)"
(Scribd link here)
"ORDER
Before the Court are several pending motions, all of which will be denied for the reasons set forth below."
*Chuckle*
"For the reasons set forth in the Court’s Memorandum Opinion issued this date, the Court finds that plaintiff has failed to establish a claim or right to relief, and thus is not entitled a default judgment in this case.
Furthermore, “[d]efault judgments are not favored by modern courts,” particularly where such judgments are “unwarranted by the facts.”"
*CHUCKLE*
"Finally, plaintiff’s Motion [22] to Compel asks the Court to compel compliance with a Rule 45 subpoena issued by plaintiff to the Director of Health for the State of Hawaii. The subpoena seeks access to the original long-form birth certificate issued to the President in 1961. The requested birth certificate has nothing to do with this case, which relates to plaintiff’s FOIA request for various documents in the possession of the SSA. Inspection of the birth certificate would resolve none of the issues before this Court. Accordingly, plaintiff’s Motion [22] to Compel is DENIED.
SO ORDERED.
Signed by Royce C. Lamberth, Chief Judge, on August 30, 2011."
LAUGH!!!!!!!!!
So much for her improperly-issued subpoena. Wonder if the court in Hawaii will take note.....
30 August - And Dr. Orly responds to her birthday present. (malware and redirect warning)
"Today in the morning I was supposed to have a phone conference with judge Susan Oke-Malloy, who supervises the magistrate judge Puglisi. Yesterday I got a phone call from the assistant of the judge, telling me the conference call will be postponed to 5:15 CA time (at that time it would be too late to mail or Fedex anything for August 31 filing deadline."
Oh shucky darn??
"I had a bad filling right then and there."
I suspect not as bad as the fillings your patients get while sitting in the Dental Chair o' Luv.
" today Lamberth granted the motion by the Department of Justice to deny my freedom of information request. Next move by the regime will be assertion by judge Oke Mulloy, that actions by Lamberth will makke the HI case moot."
Ya think??
"Well, not so fast…"
Like little things along the lines of "facts", "reality", "court rulings" and the like will stop Dr. Orly's jihad??
"I was prepared, as I was prepared to the stonewalling in HI. "
You made up new lies to throw at the court???
"New moves are coming, new earth shattering evidence is coming, Obama and his regime will not come out of this smelling like a rose
stay tuned…"
"......any day now.......any day now......any day now.......any day now......any day now.......any day now......any day now.......any day now......"

The perfect birthday gift for Orly... yes, indeed! :)

new earth shattering evidence is coming
I bet it will be just as amusing as the old earth shattering evidence.

"And plaintiff—for all her allegations—has produced no “evidence that would warrant a belief by a reasonable person that the alleged government impropriety might have occurred.”
You can bet I'll be posting this in response to the seditious birther nonsense and lies I see posted.

One of the most amazing things about birthers is their ability to tie together things that most people would consider to be evidence in Obama's favor and conclude they are the opposite.
For example, they have his SSN. They obtain his draft registration information (illegally), and it uses...the same number. Every official document they've ever found, has used the same number.
For me, that would be overwhelming evidence that the number probably is his - anecdotal, sure, but certainly none would point to it NOT being his. (If for example his tax returns had one number, the Selective Service another, and the SSNVN another, even were the latter two illegally obtained one might sit up and take notice and think "Wha? That's weird." But they don't (save that recently the SSNVN has said the number is no longer issued, likely because Orly has plastered it everywhere). They all say the same thing. The birther logic seems to be that since every official document found anywhere has the same number, that each additional document showing that he's used that one and only number his entire life is...MORE proof of fraud, which makes zero sense to me. As Patrick says, they add two and two and get rhubarb.

Tarrant, if you use this SS number validator, it says Obama's number is valid:
http://www.ssnvalidator.com/default.aspx?r=nc
I'm not sure how the birthers found a site to say it is not valid, unless their site says that due to Obama being recently issued a new number.
(Ironically, due to misuse and abuse in large part by birthers.)

Well, maybe this was Orly's birthday present instead:

> new earth shattering evidence is coming
Which means either
(a) this announcement is the one and only thing we'll ever hear about this "evidence" (remember Trump and his "investigators" who "can't believe what they're finding"?), or
(b) we'll soon have another birther "expert" coming up with even more nonsensical stuff on WND
Or could it be Orly is dreaming about the latest birther OMG moment, the "let's get Obama's illegal uncle to spill the beans on him"?
> The birther logic seems to be that since every official document found anywhere has the same number, that each additional document showing that he's used that one and only number his entire life is...MORE proof of fraud, which makes zero sense to me.
Yep, but that's conspiracy theory 101. The lack of inconsistencies is proof the conspiracy is covering them up. *duh*
Same with Obama's BC - the fact that he was able to produce one proves that the conspiracy forged one for him, not that he actually has one.
Whatever evidence you bring, the conspiracy theorist doesn't just reject it, he sees it as proof how far the conspiracy goes and how powerful it is ("everyone who watched the NBA finals courtside is part of the conspiracy to hide the fact the Mavs lost, dude, they even forged the live feed using advanced CGI!").

Magic M - Latest I hear, Orly's trying to send her Flying Monkeys to search for Obama's parking tickets from college *rolls eyes* ... as well as those of his 2 african relatives that have been in immigration trouble here in America.
She's really scraping the bottom of the barrel in terms of pathetic, lost causes.

> to search for Obama's parking tickets from college
Maybe that will prove he was driving a car registered in Oklahoma where he never resided? OMFG birther moment!
> She's really scraping the bottom of the barrel in terms of pathetic, lost causes.
Obviously birthers need their regular dosis of "new evil stuff on Obama discovered", no matter how silly, or else the movement is going to melt away.
Remember how well the Pest and eFail is read despite consisting almost entirely of rehashed same-old and whiney letters full of rehashed same-old. At least Orly and WND try to make up some new stuff every now and then.
