In today's dispatches, another birther courtroom failure in Hawaii. John Dummett goes to Arizona to kiss Arpaio's ring and screw up legal service. Terry Lakin seems to have fallen further into birtherstan.
Thomas MacLeran throws a fit that his state's Secretary of State won't give in to his demands. Dr. Kate may have let on about who else is part of the "Article II superPAC". Dr. Orly tries to pimp her dead cases as still shambling around.
Thomas MacLeran predicts horror untold unless he's elected supreme overlord. A writer for the fake Examiner goes a pretty good article about the birther wing nuts. Mario Apuzzo loves him some Dred Scott.
Lawrence Sellin predicts gloom, doom, and race wars. Leo Donofrio shows some sanity. Zampolit Haskins tries to convince the party faithful that he's really doing something, honest. And we have a birther forum that doesn't even make an attempt to hide their subhuman racist ignorance.
9 December - And another birther lawsuit in Hawaii, this the quaintly named "Wolf v Fuddy" is dismissed, according to birther report and "Obama Ballot Challenge" (and Zampolit Dean Haskins doing the reporting.)
"In case you all haven't heard, Wolf v. Fuddy was dismissed on the basis of the plaintiff not being a relative of Obama, so the DOH cannot allow him to see the birth certificate (surprise!). The attorney, John Carroll, told me that he is filing an immediate motion for reconsideration, as the judge completely ignored the statute that they argued removes the familial requirement in cases of fraud. They are already set to be back in court on Dec.27, so he is getting his motion for reconsideration filed in time for it to be heard then."
This was brought forth by one William Wolf of New Jersey. Most of the complaint (birther report scribed, sorry) boils down to "The long form was a definite fraud, therefore we have the right to look at the original to prove it's a fraud".
(Scribd link to birther report's copy of the ruling here. Apologies for the link)
"And the court respectfully finds and concludes that Chapter 338-18(b) prohibits the plaintiff from continuing to prosecute this action, and under no circumstances or set of facts can the plaintiff prevail on the plaintiff's prayer to obtain the original certificate of live birth, or to obtain access to the certificate of live birth under these circumstances. So for these and any other good cause shown in the record, the court will respectfully grant the motion to dismiss.
The court will ask counsel for the defense to prepare an appropriate order. Findings and fact and conclusions of law are not necessary. The court will elect under Rule 52, not to make findings and fact and conclusions of law.
I state these matters for the record so that there is a record of this court's thinking in the event that this matter goes up on appeal. I have not addressed all of the issues to the level of specificity that I would have this served as a written finding or conclusion of the court, but I did want to give counsel some sense of what this court's thinking was because I'm sure the respective clients will be curious."
Further more:
"MS. NAGAMINE: One question, Your Honor. Is the complaint dismissed with prejudice?
THE COURT: The complaint is dismissed with prejudice, yes.
MS. NAGAMINE: Thank you."
Get the feeling Hawaii is getting fed up?? I wonder if this was the super secret, can't fail lawsuit Haskins was playing coy about a few weeks ago?
And needless to say, the birtherstani are upset
"Anonymous said… Hawaii courts are run by the local Japanese yakuza. Don't expect intellect or justice in the Hawaii courts. The local yakuza know the mistake that has been made in this case, but they also know that the State of Hawaii cannot willingly divulge the treasonous truth on this matter, as it will reflect VERY badly on the State.Hawaii Local

"California birther/dualer/doubter said…[Reply] Saska, I thought the same thing. I, too, hope that the conservatives and patriots will rise to the occasion and finally root out the godless termites undermining our nation when the long overdue time comes. December 10, 2011 4:22 PM"
"Anonymous said…. Off topic, but look at the pic of Obama for this article. This is not the same guy as in the college photos. The college student has African lips. This president, Obama, has Arabic lips. Why does everyone see the two as one and the same? The nose is different, too, but supposedly he had a nose job to explain that difference. So where did you plan to get that military equipment?? Your birther wet dream of a military coup?
9 December - Professional seditionist Sharon Rondeau publishes a puff piece about John Dummett's kowtowing to Joe Arpaio and his failed attempt to do proper service in his lawsuit.
"Dummett and Van Irion, founder of Liberty Legal Foundation, have partnered in filing a lawsuit against the Democrat National Committee to stay the nomination of Obama as its candidate for the presidential election.
“Our meeting with Sheriff Arpaio was scheduled for 1:30 in the afternoon, and the Tea Party meeting was at 6:30 that evening. We got to Joe Arpaio’s office, and his secretary met us at the door. She said, ‘Ladies and gentlemen, I’m sorry to tell you, but the sheriff can give you only 20 minutes of his time.’ We were more than happy with that. Well, we got to his office, and he had the lead investigator of his 300-man posse there. It’s called the Cold Case Posse. Several other investigators assigned to the case were there as well. Arpaio was intrigued by Van Irion’s and my approach of going after the DNC and not attacking Barack Obama or asking any court to decide Obama’s eligibility. The idea blew them away. It went over so well that he got several other members in there. He took copies of everything, including the complaint , and we discussed all of the issues. He told us things that I still have to hold in confidentiality. I can say, because it has already been released to the press and I can verify it, that he will produce a report in February, and it will be devastating. I can’t say what it is, but I know what it is.”
When we asked Dummett if the “devastating” part of Arpaio’s future report was communicated in written or verbal form, he was not at liberty to answer.
Instead of being there for only 20 minutes, we were there speaking with him for an hour and a half. I was then asked to be an expert witness on the birth certificate issue, and I agreed to do that.”
So let me get this straight. Arapaio tells Corsi and the rest of the press his "cold case posse" investigation is "ongoing" and he can't comment on it at this time. Yet Dummett waltzes in, and not only does Arpaio blab out all the stuff he's supposedly found out, but asks Dummett to be part of the posse???
You could use this claim for fertilizer, it's so full of crap.
"I figured out that the birth certificate Obama presented was a phony right after I saw it, because I understand how Adobe works because I have to use that and the applications which I built for the state of California."
If that was the case, maybe you would know that Adobe is a COMPANY and not an application. Something that almost any IT professional who knew what they were talking about would know from the start.
"There is no doubt in my mind that we will be successful. I believe that Sheriff Joe is doing this for the people of Maricopa County, which he represents, as he should be. He is the only law enforcement official who has actually stood up and done something about the eligibility issue. He told me, ‘I owe the people of Maricopa County the truth. Where there’s smoke, there’s fire.’ If it benefits the rest of the United States, fine, but his primary concern was with the people of Maricopa County. Who wouldn’t want a sheriff like that?"
You mean a racist reactionary who ignores sex crimes against children that are reported in his county??
"We were talking about impeachment and why that is not something we want to do with Barack Obama, and here’s the reason why: I’m a scholar, but not in constitutional law; my degree is in archaeology and history. "
I thought you were an IT professional??
And "archaeology and history" eh? Sounds like Charles E. Lincoln, III…..
"The next morning, we headed over to the DNC at around 9:00. We walked into the office; there was an older guy playing video games. There was a bearded individual whom we approached and asked if he worked for the organization, and he said “yes.” So we served him the papers. My wife was filming the whole time, and he said, “Well, she’s filming.” And the guy asked, “Well, am I being served?” and we said, “We’re serving the Democrat Party. Make sure you get this to your superiors.” And he said, “What’s entailed in the suit?” and we said, “Please read it; everything is in there; make sure to get it to your superiors.”
A lot of people don’t understand that the server doesn’t have to put it in your hand. You don’t have to take exact possession of it. A lot of people think that if they refuse to touch it or they throw it on the ground, they haven’t been served. That is not the law. Once an officer of the court, which Van is, handed it to them, they had been served.
So we walked out, got into my car and were getting ready to head to the airport when I saw out of the corner of my eye three people approach the car. A tall lady started beating on my window and almost broke it, saying, “You can’t serve us. You handed that paper to a volunteer, and that wasn’t legal service!” Van was in the back and he said, “Ma’am, you have been served.” So she took the paper, flopped it on the ground, and walked away.
“Did you get her name?”
No, but we have her on videotape (laughs). They were quite violent about it. It’s a lawsuit; it wasn’t against them; it’s enjoining the DNC not to certify anybody until they come up with the proof. That means anybody, not just Barack Obama, although we know Barack Obama can’t come up with any certification.
First off, the Democratic National Committee is based in Washington DC, not Arizona. The state party is the Arizona Democratic Party.
Second off, Arizona Rules of Civil Procedure, Rule 4.1 (k)
"(k) Service of Summons Upon Corporations, Partnerships or Other Unincorporated Associations. Service upon a domestic or foreign corporation or upon a partnership or other unincorporated association which is subject to suit in a common name, and from which a waiver has not been obtained and filed, shall be effected by delivering a copy of the summons and of the pleading to a partner, an officer, a managing or general agent, or to any other agent authorized by appointment or by law to receive service of process and, if the agent is one authorized by statute to receive service and the statute so requires, by also mailing a copy to the party on whose behalf the agent accepted or received service."
Tossing a copy at an unnamed volunteer and sneering "You've Been Served" isn't proper service.
"“From what I understand, they have 30-45 days to answer our complaint, which includes Pelosi, Wasserman-Schultz, Reid, the DNC and the courts in Washington, DC and Tennessee. "
If you had properly served it and served it to the proper organization, yes.
10 December - The Terry Lakin Action Fund posts a 5 December 2011 interview with Lakin.
(MP3 here)
What's of note is that Lakin seems to be spouting the de Vattelist party line now…..
10 December - At the Pest and eFail, Thomas MacLeran uses the byline "Presidential Candidate Tom MacLeran" rather than his usual "One Pissed-off Vietnam Vet" to publish his snotty email to Tennessee's Secretary of State.
"It has come to my attention your office has posted Barack Obama as the sole Democrat candidate for President on the Tennessee Primary Ballot. This notice is my challenge and request he be removed from our ballot…. "
"….oh, and I want a pony and a red wagon too."
Tennessee State Rep Phillip Johnson also gets an email.
"I am writing to inform you that many representatives from the State of New Hampshire are signing onto a lawsuit that, due to the discovery of evidence pointing to serious felony charges against Barack Obama, is demanding that the evidence be investigated and the appropriate action be taken. "
Yes, nine out of 400, less than 2 percent. And they're getting flack from their own party for playing birther games.
10 December - Dr. Kate crows about the "Article II SuperPAC"
However. she may have just blabbed to the world the OTHER people behind this latest birther fail.
"Founding members of the Article II Super Pac include Helen Tansey of the T-Room, Gary Wilmot, Commander Charles Kerchner, Mario Apuzzo, Captain Pamela Barnett, and many others."
So in other words, the usual gang of idiots.
And the turds in Dr. Kate's punchbowl are thrilled.
"Tenacity
December 10, 2011 at 9:07 am
Dr. Kate, this is excellent. The video “The American People WAKE UP…” is most persuasive.
Might I suggest that the ‘Birther Summit’ change its name to “The Article II Summit”, so that it will be taken just as seriously as the SuperPAC and even draw upon mutual strengths. We do not need to reinforce demonized terminology reducing the legitimacy of Constitutionalism."
Someone in Virginia, Dean Haskins is reading this and going "back off bitch, the birtherpoolza scam is MINE!!"
11 December - Dr. Orly tries to convince her cavity creeps that she's doing something. (malware and redirect warning)
"LIST OF MY LEGAL ACTIONS GOING ON NOW, CHALLENGING OBAMA
Posted on | December 11, 2011 |
1. HI Taitz v Fuddy hearing scheduled Jan 6, 2012"
One of her "how dare you dismiss me" dead cases.
2. GA Farrar, Lax, Judy MacLeran v Obama, Executive Committee of the Democrat Party of GA, Brian Kemp, Secretary of State of GA- filed on behalf of a registered voter in GA and 3 Presidential candidates Pretrial order issued.Standing is great, as 2 of the presidential candidates are Democrats, running directly against Obama now in the primary election. First amended complaint and response to the Pretrial order sent. Trial set tentatively between January 9-16 Attorney for the Plaintiffs is Orly Taitz, Obama is represented by 2 private GA attorneys
And from the looks of what she's been writing, may just rank up there with her past efforts in Georgia.
"3. Petition to the Supreme Court of NH Taitz, State Representativeds of NH Rappaport, Accornero, Via, Villenueva, Vita; Presidential Candidates Lax (D), Judy (D), MacLeran(R) no date yet"
Ah yes, her trying to ignore the final decision of the ballot commission and get a do-over by the court. And notice she's tacked on at least two people that weren't part of the original ballot challenge. Tacky.
"4 District of Columbia Circuit Court of Appeals Taitz v Ruemmler (White House Counsel) no date yet"
Another one of her "how dare you dismiss me" dead cases.
"5. District of Columbia Circuit court of Appeals Taitz v Astrue (commissioner of Social Security ) no date yet"
And yet another of her "how dare you dismiss me" dead cases.
"6. 9th Circuit Court of Appeals Barnett, Keyes et al v Obama et al. This case was filed on inauguration day January 21, 2009 by attorney Orly Taitz. Her clients in this case are 40 plaintiffs, among them 2008 Presidential candidate from the American Independent party, former UN ambassador Alan Keyes, 10 State Representatives from around the country, 30 officers of the US military. 9th Circuit heard the oral argument on May 2, 2011. No decision yet. Taitz filed several supplemental brief and Petition for emergency Writ of Mandamus, no answer yet."
Docketed six hours after Obama was sworn in, and she didn't manage to achieve service until months later. Possibly her deadest of dead cases, but she still insists on parading around the rotting corpse.
11 December - Thomas MacLeran, aka "One Pissed-off Vietnam Vet", predicts rains of frogs and plagues of locusts should the American people not fall all over themselves to elect him God-Emperor of the United States.
"The chances that America will choose a President in 2012 who will stop this downward spiral into oblivion, an unrecognizable America, are so remote as to be nonsensical. That’s right, a Dark Horse who has made it as plain as the day is long that he will not take one red cent in campaign contributions from any source whatsoever to run for President won’t be elected because most of Americans don’t get it and never will."
I suspect it's more due to the fact that even in his addled, hate-soaked mind, he knows his chances are slim, none, and "oh hell no".
"Necks First! Jobs Second!” should be the campaign slogan for all of the candidates. That’s right, why waste time talking about jobs and healthcare when the chances are that you may not be around to see any of it anyway? We are at war with Islam, a Totalitarian system of government that wants America so bad they can taste it. "
"Necks First"??? What the hell is that supposed to mean??
"Deport each and every Muslim from the United States, including American citizens who want to play traitor. Give them a choice: leave or prison, because being a Muslim is tantamount to being a traitor: you either support the Constitution or you’re out of here."
So much for quant concepts like "due process" or "freedom of religion". And gee, stripping people of their rights and citizenship because of their religion?? Where did we see that movie before??
Oh, I'm sure he'll be happy to set up special prisons for those Muslims who wish to stay in this country. No doubt outfitted with the very latest shower and oven facilities too.
"And if anyone has a problem with that, you’re more than welcome to move: it’s what we call freedom."
It's my country too.
Dip.
"The word “illegal” has lost its punch; I say we put the punch back in. How? It’s really very simple: deport each and every illegal immigrant. Oh, you say the children are in high school but the parents are illegal, what then? Wax in your ear? It’s doable so let’s do it. If the parents don’t respect American law, I wouldn’t hold my breath to give out future citizenship awards to their illegal offspring."
So deport the kids as well?? So much for that pesky 14th Amendment……
"Johnny can’t read; hell, Johnny can’t even speak proper English, can’t diagram a sentence, and most likely doesn’t have, and never will have, a high school diploma.
Is it Johnny’s fault that he was raised on Gangsta Rap lyrics"
Racist much??
"Look, fixing the mistakes of the past may not be easy or popular, but if we don’t do it and do it NOW, we’ll have nobody to blame but ourselves when the green flag of Islam is raised over the White House."
Racist a lot it seems.
And in comments:
"Sidesaddle says:

Thank you! I totally agree with you.
“Deport each and every Muslim from the United States, including American citizens who want to play traitor.”
Here’s another one for you. Saturday I went to a US Army Surplus to buy a few preparedness/survivor things. When I entered the store 2 muslim men were the owners wearing their little white Kufi/kufiya/kaffiyeh hats!
Needless to say I backed out telling them I was in the wrong store! WHAT THE HECK IS GOING ON?
May almighty God have mercy on us.
"Eeeek!! How dare Muslims own a surplus business!! Now they'll get all their nasty icky Islamic cooties over all my survival gear!!"
The scary part is they really have no idea just how outstandingly stupid they all sound
11 December - Julie Driscoll of the "Chicago Liberal Examiner" (another one of the fake Examiner titles) pens an interesting article on the rise of the more extremist birthers.
"Most of us, of course, see the birther movement as a not-very-well-coded racial attack on the President. As Bill Maher noted, "If 51 percent think he was not born in America, I don’t know where that else is coming from except race. What more could [Obama] do to be the perfect family man?…There is nothing about this man that is un-American, except, to them, his color. I gotta think it’s coming from that place."
It is coming from "that place," and "that place" is the home of bunker mentality extremists who - such as with the recent arrest of birther Walter F. Fitzpatrick, a retired Navy veteran who doesn't mind breaking the law to accomplish his birther-driven goals - pose a clear and present danger to President Obama. The birther movement, like any other fringe movement with a singular target, bears watching. Closely. And conspicuously. "
And some of us have been staring into the birther abyss for a long, long time now.
11 December - Mario Apuzzo writes a rambling piece claiming that, among other things, Scholastic News is trying to brainwash young people and somehow compares this to Hitler Youth. The majority of it seems to be straight out de Vattel worship and how they're not teaching de Vattel's sacred word in the schools.
However, it's interesting to note one of his sources to back his claim.
"(4) Dred Scott v. Sandford, 60 U.S. 393 (1857): Justice Daniels concurring cites Vattel and The Law of Nations and provides his definition of natural born citizens and takes out of Vattel’s definition the reference to “fathers” and “father” and replaced it with “parents” and “person,” respectively, stated: “The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As society cannot perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their parents, and succeed to all their rights.” Again: I say, to be of the country, it is necessary to be born of a person who is a citizen; for if he be born there of a foreigner, it will be only the place of his birth, and not his country. . . .”"
Yes, he's actually citing the infamously racist Dred Scott decision as proof that the founders were de Vattel worshippers as well.
11 December - Dr. Orly publishes a letter from a "Army Veteran". (malware and redirect warning)
"Obama has!!! used 39 false SSN’s(A SERIAL FELON)!!!!. His good buddy Bill Ayers brags in his books HOW!!! he used to manufacture False SSN’s. Obama’s relatives in Hawaii had access to Social Security data bases. SSN’s are given to U.S. Citizens. Obama is NOT!!! Natural born…his dad was African. He is not Native Born either….he is an illegal alien. Your machinations regarding his SSN are pure B.S. YOU!! called Obama-on the steps of our nation’s capitol-a con artist and phony and transparent fraud. You are correct about this and DEAD WRONG about his SSN being legit. 042-68-4425 has been SEALED. Wake up and smell the coffee. You should work with Orly Taitz and not against her and for Obama…
Stephen Struk, 1/Lt. USMCR"
Actually the USMCR seems to state he's a Marine reservist. (Dr. Orly has a problem keeping the branch of services straight it seems). And has badly written as this is, I would suspect that if Stephen Struk actually is a reservist still (and not playing the stolen valor game), then he might want to check article 88 of the UCMJ. The part that says:
"Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct."
12 December - Lawrence Sellin doesn't usually get too obviously racist in his rants, but occasionally he likes to play the race card.
"The Occupy War Street movement was just a test of Obama’s chaos strategy. The weakness demonstrated by politicians nationwide has only encouraged future, larger and more violent confrontations to support the Obama agenda either to transform America by force or, if that fails, destroy her.
Expect Occupy Flash Mobs to increase attacks on businesses and Obama opponents."
Oh noes, those uppity 99 percenters are daring to voice their opinion!!
"Watch for the number of premeditated racial incidents to increase."
Ginned up by people like you, right?
"Spearheaded by Secretary of State Hillary Clinton and Attorney General Eric Holder, the Obama Administration is promoting policies that could make criticism of Islam a crime in the United States and erode our First Amendment rights.
Martial law could be an option under consideration"
Paranoid AND bigoted much??
"Unfortunately, Republican leaders have decided to maintain a protective shield of silence and dispense disinformation about Obama’s Constitutionally illegal Presidency and his crimes in order to hide their own complicity in the greatest fraud ever perpetrated on the American people.
The chaos is coming and those disgraceful politicians will have blood on their traitorous hands."
I see he likes to stick with his civil war binkie too.
12 December - Occasionally Leo Donofrio shows some decency, unlike most of his fellow birtherstani.
"I am preparing a comprehensive treatise on the natural-born citizen clause. And I want everyone to know my position as to the Dred Scott decision well before I publish.
Scott v. Sandford is the most horrific piece of racist garbage our federal judicial system has ever doled out. My arguments will not rely upon that case or its holding. I will only discuss the case in relation to Justice Horace Gray’s reference to it, since he discussed it in U.S. v. Wong Kim Ark. And I will not refer to Scott v. Sandford outside of examining Justice Gray’s own opinion of that case, since I cannot properly analyze Wong Kim Ark without discussing the precedents cited therein.
The Dred Scott decision is a damned blight upon this nation. The reasoning of the majority (if a majority can even be said to have existed) is in direct contradiction to the Declaration of Independence and to any true notion of liberty."
12 December - Zampolit Dean Haskins touts his involvement with the "Obama Ballot Challenge" blog and gives a "no, we really are doing a lawsuit, honest, anyway now, really, we're not just wasting our time with online petitions" update. (Reposted here as well)
"We are asked, daily, to release the information about the upcoming lawsuit in Hawaii, despite the explanation that we have been asked not to do so until counsel gives us a green light. As much as we would love to share all the details with the world, doing so could possibly endanger all of our efforts, and there is simply no way to explain that without revealing those details."
Translation - "We're still trying to figure out how to spin a loss as a win, and still get people to send us money."
"Please rest assured that everything is progressing properly, as we are merely fulfilling every necessary administrative procedure toward filing this successful lawsuit."
Why do I suspect the first step was "get lawsuit dismissed in hearing, then file an appeal???"
"The lawsuit that will be filed soon (we are on the last administrative procedure) will be unlike any other that has been filed in this arena."
I find that impossible to believe.
"Rather than the lawsuit dealing with numerous and varied claims that ultimately get lumped together and dismissed without actually being addressed by the court, our lawsuit will be extremely narrow in focus—so narrow, in fact, that the argument will ultimately rest upon one very small word in the applicable statute."
So you're not doing the Dr. Orly "throw everything against the wall and see if it sticks" tactic. Cute, but I suspect you're still looking at a failure.
"Having properly fulfilled every possible administrative procedure, we are confident that our argument surrounding that one little word in the statute will garner the agreement of the court, and we will win the lawsuit. "
Where have we heard that before??
12 December - Reader "Whodunit" provides a link to a birther forum where they don't bother hiding their racism. (title may not be safe for work)
You will forgive me if I don't provide examples. However they profusely links to sites like Dr. Orly's, the Pest and eFail, World Nut Daily, BirtherReport, etc…..

One of the commenters at the blatantly racist website was reading the article written at the Examiner as he includes a link in a post here.
Link from racist site
The comment he wrote was very familiar in wording to a comment that was left on that article. Now, I can't find the comment left at the Examiner. I believe it was written by Steven Churchill.
And being a birther has nothing to do with being a racist. Riiiight!

These hate mongers finally found an outlet where they don't have to hold back their true feelings -- knowing they couldn't quite get away with that level of ugly on their regular sites. (though it hasn't been uncommon to see some openly racist comments on WND of which the only people to call them out for it were the so-called "obots" --- I imagine that's one of the reasons why WND has been employing forum supervisors lately -- they want to keep their "dirty little (racist) secret" somewhat in the closet...

Well, I see Orly keeps going from state to state with the same list of pretend "Presidential Candidates" that won't actually be a "Presidential Candidate" on that state's ballot.
I've pointed this out in the previous posts in regards to some of those early states mentioned, but since GA came up in this post, I will point out that none of these Birther pretend Presidential Candidates is registered to appear on Georgia's primary ballots either:

> “From what I understand, they have 30-45 days to answer our complaint,
So this is set up to be another EPIC FAIL where they will whine "we win by default because they didn't answer timely" instead of bothering to effect proper service (which isn't rocket science, after all).
Astonishing.
It's if they either fail on purpose or subconsciously want to fail (or to make an excuse which allows them to continue their belief that they can't lose except by "lawlessness" on the part of the judiciary).
They're like the big mouth boxers who claim "I'll destroy my opponent in the ring" for months, then just "happen" to break a finger the day before the bout.

> we are confident that our argument surrounding that one little word in the statute will garner the agreement of the court
This has the smell of "we will try a 'clever' interpretation which will turn the meaning of the statute into its opposite" - similar to what Wolf vs Fuddy tried (if that wasn't already the lawsuit they were talking about).
My guess:
They'll take §338-18 from Hawaiian law and claim that (6) applies because "We the People" are "legal guardians" of the President.
Anyway it will likely be as "creative" as Orly's claim that "verification in lieu of a certified copy" means "inspect the original in lieu of a certified copy".
Posted by: The Magic M | December 13, 2011 at 01:12 AM
The transcript in the Wolf v. Fuddy case is distressing. Why on earth would the Judge waste his time with all of that discussion about the Rules of Evidence?
OTOH, perhaps the Judge was just mocking the birthers. The comment to Ms. Nagamine at the outset regarding sanctions seems to be an inside joke, probably shared by the Judges and Nagamine regarding Taitz' lunacy. Nothing else explains it.
