In today's dispatches, "The Daily Pen" comes up with yet another crazy theory. More conspiracy goodness in the aftermath of the Georgia Birther Ballot Jihad hearing. Van Irion and Dr. Orly both file their appeals of their loss to an empty table.
Birther Report exaggerates a bit. Dr. Kate continues to explore the bottom of Lake Conspiracy, where the water tells her things. Terrible things. Meanwhile, James Manning wants the birtherstani to please dig deep for Dr. Kate, Walter Fitzpatrick, And Terry Lakin for having sacrificed so much for their paranoid delusions.
Dr. Orly tries to get her birther on with Newt Gingrich. Dean Haskins continues to try and tell his fellow birtherstani that the Nitrous Queen has no clothes. Thomas MacLeran continues to show his islamophobia, while Padawan Pauly wants people to PLEASE pay attention to his Sacred Sperm of Citizenship theory. Because, as you know, the founding fathers only wanted patriotic, red, white and blue, flag-waving tadpoles to knock up American Uteri.
The aptly named Gary Kreep catches the office bug. The American Stinker shows some interesting racism. Kansas, New Hampshire and Missouri try for "Birther Bill 2.0 - Beyond Thunderdome". And Dr. Orly ratchets up the crazy to the point she's almost screaming for Obama's death.
9 February - Thanks to "G" for finding this piece at "The Daily Pen"
Problem #1 is that the writer seems to have taken the CDC guidelines for entering birth information on the national level for census work, and extended that into it being a certificate numbering format. The problem is that certificates weren't required nationally to begin with (Florida was the last state to mandate birth certificates state-wide)
Problem #2 is that the writer got the name of Hawaii's first territorial governor wrong. It was Sanford B. Dole.
Problem #3 seems to imply that Obama was an illegal alien from Japan. *rolls eyes*
Even for birther "research", it's pretty shoddy.
13 February - More conspiracy paranoia at the Farah / Floyd ran "Western Center for Journalism"
“This is an outrage, an absolute outrage,” Attorney Orly Taitz told a radio audience in Western New York. She believes Judge Michael Malihi, a Clinton era appointee, is from Iran which could have a bearing if he is steeped in Sharia Law. "
*Rolls eyes* Dr. Orly really hates the fact she was told no by a fellow Jew.
"But what Malihi did was unprecedented because he based his decision on the Arkeny [sic] v. Daniels case out of Indiana which was never cited by the defense! “A presiding judge cannot suddenly pull out of a hat some case,” Taitz fumed."
I'm trying to figure out why exactly it's such a surprise to Dr. Orly, Van Irion, and Hatfield that a judge can do his or her own research on a matter, and not just take everything given to him or her at face value.
"Trying to follow up on the Malihi Iranian angle proved very frustrating. Another blogger trying to trace Judge Michael Malihi’s background found virtually NO information on him, although other judicial search subjects presented much biographical data. She was able to find names of Malihi’s relatives, namely Mehdi Malihi, Masoud M. Malihi, Malie S. Malihi, Mahzad Malihi, and Lia E. Malihi. The street address given for his Westport, CT estate appears to list a house number higher than official records enumerate, so this is just another facet of the Georgia mystery judge."
So, despite the headline, you have no proof that Judge Malihi is Muslim.
And once again, the "Western Center for Journalism" shows they have absolutely no idea what "journalism" actually is.
"She said on appeal: “Obama never presented admissible competent evidence showing Obama to be born in this country, yet the judge considered Obama to be born here.”
Actually it was Van Irion who submitted that. Ooops.
"She also appealed for consideration the fact that there is “no valid Social Security number, and that the E verify test failed” for the number commonly given. But in spite of his verdict, the judge for the first time allowed evidence pertaining to the challenge of Barack Obama’s eligibility to run for U.S. President to be admitted into open court, thus paving the way for the appeals process. Obama’s Malihi victory may be a Pyrrhic one indeed!"
"….to dream, the impossible dream…."

13 February - I wouldn't say that "Birther Report" was misleading people, but…..
In a nutshell, on 12 February, Swiftboat liar Jerome Corsi published a fluff piece about the people at "Grassfire Nation" sending a support petition to Joe Arpaio with a claimed 100,000 signatures.
It's an on-line petition, so we already know they're not overly accurate. But "Grassfire Nation" only says it's "Tens of Thousands of Petitions". Somehow that got expanded by Corsi to 100,000.
More than that, the petition is very clear that it's in support of Arpaio's immigration policies, nothing else.
Somehow between World Nut Daily and Birther Report, it got changed to:
"100,000 Petitions Sent To Sheriff Joe Arpaio In Support Of Obama Eligibility Investigation"
That's a tad bit on the dishonest side, don't cha' think??
And in comments
"Ralph Swain said…[Reply] "The a**hole in the WH is a freaking fraud and we know it and you Obot losers will know it come March 1. Count on it!" Absolutely, AR925! Once Sheriff Joe release the truth about Nobama, I'm thinking there will be a day of stunned silence from the Obamanuts, and then little by little they'll start making excuses. We've got to make sure our voices are heard then, so that the Obot propaganda doesn't twist Sheriff Joe's words. By the time of the democrat convention (if they have one!) I bet Nobama will be gone, and come November, the real house cleaning will begin. Boy would I LOVE to be on one of the many juries that will be in place to bring Nobama enablers and stooges to JUSTICE!!! February 13, 2012 8:46 PM"

Remember Nuremberg? The “I was only following orders” WILL come back and bite you in the ass if you go to war with Iran or fight in Syria. That punishment won’t be as severe as that which you will receive from God."
13 February - Even Joseph Farah thinks his de Vattel birtherism is going to fail.
"Maybe I’m wrong. Maybe I misread the founders. Maybe my interpretation of the Constitution is too strict – too literal. I have little doubt the U.S. Supreme Court in 2012 would find I misconstrue history and the facts – in the unlikely event the justices even had the courage to hear such a case. "
That being said:
"But maybe – just maybe – we’re long overdue for a rational, open public debate on this issue, without the invective and the derision and the ad hominem attacks."
So he thinks it's doomed to fail, but he wants to talk about it anyway. And if he doesn't want the derision and the ad hominem attacks, first step would be fire Jerome Corsi and most of the rest of World Nut Daily's birther writers.
"I honestly thought Americans might like to take a look at this issue honestly, candidly and intelligently. For my trouble, I was blackballed, vilified, ridiculed and scoffed at by thoughtless people – and I wasn’t alone. "
Funny what happens when you start to spew unfounded conspiracy theories and discredited legal claims.
13 February - Dr. Orly may have just given the kiss of death to Newt Gingrich.
"Orly Taitz, an attorney who has filed a lawsuit claiming President Obama is not an American citizen, asserted the president uses a fake Social Security guard and demanded to know when someone would do something about it.
“That’s a project you should pursue,” Gingrich said. With the deficit at an all time high and other problems plaguing the economy, he added, “I have enough issues to debate Obama about.”
I suspect that by the time Dr. Orly spins it, Gingrich will have given her a big wet sloppy kiss, slipped her the tongue, copped a feel, and hailed her as the saviour of the country.
14 February - Dean Haskins continues to poke Dr. Orly with a stick.
"But, imagine even further that this surgeon had a blog, and on that blog were statements like, “I am, surgeon who does 99%, of work advancing medical, science,” and the posts were full of scientific falsehoods and medical impossibilities, and usually included pleas for donations so that the surgeon could “operate” on more unsuspecting patients?"
*Chuckle* Has the comma abuse down right.
"What if all of the deaths were the result of a completely false interpretation of proper medical procedures, and the patients all died during appendectomies—because the surgeon was convinced that the appendix should be removed through the patient's skull? And, not only that—the surgeon had a nearly endless stream of blog posts proclaiming that the appendix should be excised through the skull; so many, in fact, that a little army of followers who simply did not know any better started repeating the appendix/skull mantra."
You would have Dr. Orly's blog. Also Mario Apuzzo's blog and Leo Donofrio's blog, among others.
"Let me put it this way: if you are in a protracted Internet argument with an Obot, and you keep stating that Obama should open access for forensic document examiners to inspect his original hospital-generated birth certificate in a vault at the Department of Health in Hawaii, and the Obot ends up calling you an idiot? Trust him—he's right."
*Chuckle* Nice of him to admit that.
"In the numerous messages that were tossed back and forth, he repeated the falsehood he has read so many times on the Internet, that Obama should give permission for the vault copy of his birth certificate to be examined. In more than one email, I explained why that would be against Hawaiian law (and even provided him with the applicable statutes), and his repeated response was that it was only my “opinion.” I don't think he was ever able to grasp that the law is not my opinion."
He's a birther. They've been having problems with seeing the law as "just your opinion" from day one.
"The truth regarding birth certificates in Hawaii has been explained many times, yet there are still die-hards who cannot bear the thought that the lie isn't true, so instead of adjusting their understanding in the matter, it appears they believe that shooting the messenger will make their misinformation true. So, to them, 2 + 2 = tater tots, and I have “blinders” on."
*Chuckle* I usually say "2+2=purple", or "2+2=avocado", but "tater tots" works too.
"So, once the outright lies about “judge-issued subpoenas” and Obama being “ordered to stand trial” were being preached to the faithful followers, I arrived at a serious dilemma of conscience. Should I go along to get along, or should I say something? I knew there had to be a reason why most everyone privately condemned Orly's bizarre world, yet nobody dared even whisper the slightest public disapproval. Well, as far as I can tell, the reasons came down to two things—the fact that Orly will publicly attack anybody who exposes her, and she has a group of useful idiots who believe her utter garbage, and who will attack like rabid chihuahuas on a moment's notice."
Aka "Cavity Creeps"
"Believe it or not, I have heard rumblings from more than a couple of people that Orly is suggesting that she should sue me. As truth is an absolute defense against defamation, I would welcome such action."
Oh joy. Another front in the birther civil war.
"There are currently several state ballot challenges being mounted. Understand that, if you should decide to involve Orly Taitz in any legal action concerning them, you will be shunned by the others bringing challenges. Great lengths will be taken to assure that your case is removed as far away from the other actions as possible, and you will likely taste nothing but defeat for your efforts."
Mind you, you'll taste defeat even without Dr. Orly, but at least you won't have the taste of Taitz all over you when you're done.
"As for those very few members of the team who have such a problem dealing with the truth I have been sharing, I invite you to refute anything I have said. I have stated that there has been a steady stream of disinformation shared on Orly's website, that there are many pleas for donations based upon deceptive information and incompetence, that there is constant self-aggrandizement, and that it is very typical for Orly to trivialize, marginalize, and/or demonize others within our movement—for no other reason than her fear that they might receive attention for their efforts. And, because of what I think at least appears to be clinically definable, she believes she deserves all attention (and donations)."
Dr. Orly has NEVER played nice with others. Just ask Gary Kreep.
14 February - Looks like she didn't spin it as a win after all. (malware and redirect warning)
"Yesterday I addressed Gingrich and demanded answers, why a person, who is not eligible to pick tomatoes and clean toilets, is still sitting in the WH?
Posted on | February 14, 2012 "
"…not eligible to pick tomatoes and clean toilets"?? Wow. Could you be any more of an ugly racist Dr. Orly??
"I actually missed picture taking and the beginning of the speech, as I was busy making sure the Superior court in GA has all the documents for the appeal and I actually had to work with my patients prior to the event."
I feel very sorry for your patients.
"I stated that I had Obama recently cornered in Georgia, where I issued a subpoena for Obama to show up and produce all of his records. The judge upheld the subpoena and Obama was in contempt of court, as he never showed up and never produced any documents, as he has nothing to show."
Except it's the judge who determines contempt of court, not you.
And you still lost.
"I asked Gingrich, why a person, whose papers wouldn’t qualify him to pick tomatoes and clean toilets, is sitting in the White House? (at that point a lot of people started applauding and cheering)"
What a surprise, you were with your fellow racist dolts.
14 February - The Associated Press reports on Gingrich's encounter with Dr. Orly.
"Gingrich edged out of a potentially embarrassing exchanged with Orly Taitz, a California dentist who pioneered the “birther” movement questioning whether President Barack Obama had been born in the United States and therefore eligible to be president. Taitz suggested to Gingrich that he should pursue the debunked birther agenda as a way to propel his campaign.
“Somebody who wouldn’t be good enough, who wouldn’t be certified to pick tomatoes or clean bathrooms is sitting in the White House,” Taitz told Gingrich, to gasps and some applause from the tea party audience.
Gingrich demurred and said, “I think I have enough issues to debate Obama with.”
*Chuckle* Maybe he didn't want the same endorsement Dr. Orly gave Bachmann and Perry....
14 February - Thomas MacLeran shows his racism again, and the Pest and eFail gives him a platform for it.
"Turning a blind eye to illegal immigrants and the growing Muslim population. Here’s a formula for you: Muslims = Islam; Islam = Sharia Law; Sharia Law = the total destruction of the country wherever Muslims immigrated to."
I think he's gotten to the point he's worried Muslims are hiding in his sock drawer.
14 February - Padawan Pauly is really fixed on his Sacred Sperm of American Citizenship theory.
"…our nation’s citizenship laws only recognized an inherited U.S. citizenship to occur at birth from only being born to a citizen father. You could not claim an inherited U.S. citizenship from a female U.S. citizen mother if your father was an alien. And if a U.S. citizen mother gave birth outside of the U.S. to a child of an alien father, then that child would not even be a citizen of the U.S. at all. "
O RLY??? Then why was it that the status of a slave was based upon it's MOTHER, even when the child bore an unmistakable resemblance to that mother's owner??
"So, the qualifications that one be a “natural born Citizen” is in Article II, in part, to secure a Separation of Church and State, so that the government will not usurp the authority of the Creator by claiming for itself the authority of God to declare who of those which are born into the society are natural sovereign political authorities."
*Blink….blink…..BLINK…….*
"Regarding these challenges to Mr. Obama being allowed on the ballot in the States: If any judge, as Judge Malihi has done, decrees that Mr. Obama is qualified as a “natural born Citizen” due to soil birth or a citizen mother, and a Secretary of State goes along with this, then the government will have usurped the authority of the Creator and the Laws of Nature that come from the Creator which are required under Article II to determine via inheritance who the natural sovereign political members of the society are, and they will have eliminated the requirement that the government obtain the consent of the governed, setting themselves up to be both the King and God. This establishes both a monarchy form of government and a religious state, in violation of Article II and the First Amendment separation of Church and State completely abolishing our Constitution and 200 years of history. This usurped authority from Nature and the Creator, would be akin to the government usurping authority to make it a law that the earth is flat instead of round, or that the earth is the center of the solar system instead of the sun, both of which are only determined by Natural Law endowed by the Creator. This is beyond Congress’s power and authority, as it is beyond their authority to define what a natural born Citizen is and decree that Mr. Obama is one, which by the Laws of Nature he is not."
So now he's claiming that his theory is based on RELIGIOUS law??
Isn't that a serious sign of mental issue??
14 February - Dr. Orly is already setting up excuses for her failure. (malware and redirect warning)
"orly taitz February 14th, 2012 @ 7:58 am I wish that would be the case, but she was a trial lawyer, most trial lawyers are big supporters of the Dem party, she is an appointee of the Democrat governor Zell Miller. It is extremely tough. We, actually, might have better luck with higher courts, I believe, there are more Republicans there on the panels, but then of course, those can be sold out establishment Republicans. We’ll have to wait and see. I can present the case and the evidence, after that, it’s not up to me"
14 February - In San Diego county, the aptly named Gary Kreep has decided he wants to become a judge.
"In a race guaranteed to produce snickering at the ballot box, Gary Kreep has filed paperwork to run against Deputy District Attorney Garland Peed for a seat on the San Diego Superior Court bench.
Kreep, who is based in Ramona, serves as the executive director of the United States Justice Foundation, an organization founded to "advance the conservative viewpoint in the judicial arena." Now, "conservative" might be a conservative way to describe Kreep's positions. He's also the volunteer general counsel to the Minutemen Civil Defense Corps and one of the main attorneys suing President Barack Obama on behalf of the "Birther" movement. "
14 February - Over at the American Stinker:
"Our legal system has evaded the question of Obama's constitutional eligibility, and even when legitimate attempts were made to force the issue, as in Georgia, Obama simply turned his back and walked away. And Georgia's judiciary and secretary of state apparently got the message.
Besides, according to the media, popular opinion has ruled that everyone born in the U.S. is a natural born citizen, and to argue otherwise is the stuff of racism or crazy "birtherism."
Academia shrugged. Congress paid no attention. Conservative pundits failed to acknowledge the importance of either the question of Obama's constitutional eligibility or his elusive past."
One would think this might be a clue that there's no there there.
"As documented by The Obama File, in the eligibility case brought by former presidential candidate Alan Keyes, the presiding judge had approved a subpoena for all records held by Occidental on Obama. Rumors were flying that Obama had registered there as a foreign student. At the very last moment, Obama's attorney obtained a quash, and none of the Occidental records were released.
The incident has not been forgotten around the blogosphere, however, and even Mike Huckabee suggested recently that Obama should be asked to produce his college transcripts and prove that he didn't receive foreign student loans."
Oh for pity's sake. The only place that appeared was in an April Fool parody story, and the birthers STILL take it seriously!!
And in comments: (Bold face mine)

Yeah, like John Boehner's gonna vet Obama. Boehner couldn't vet himself out of a paper bag. and I agree completely with Mrs.A -- Little Barry is the spitting image of his grandfather. But a prostitute? Perhaps Stanley Ann is still the mother. When all is said and done, this amounts to a national security threat. Personally, I find all this secrecy pretty frightening."
"SpiralArchitect 2 hours ago
The eligibility is is a valid issue and should concern every American. The more important and readily actionable issue concerns the usurpers treasonous actions, past & present. He should be removed from office. There are thousands of people in this nation, the Marxist aside, that have taken an oath to uphold the Constitution. They should remove him from office and end this fast-track toward communism through the Marxist tact of destroying the middle class via economic means."
"BobQSoss 4 hours ago
After reading articles written by Jerome Corsi and Jack Cashill questioning Obama's eligibility, I've come to this conclusion: Obama is legally qualified to be President. But morally and in his intent, he isn't fit to clean the kennels of an Army K-9 unit.
I doubt Barack Hussein Obama of Kenya was any biological kin of Stanley Ann Dunham's illegitimate son, Barry. That burden was more likely the sin of Frank Marshall Davis, Stanley Dunham's black drinking buddy and fellow communist. In 1960, allowing your middle-aged negro pal to boink your underage white daughter and photograph her nude wasn't yet mainstream democrat behavior. A black stand-in was needed to deflect suspicion of Davis, hence the Kenyan foreign student as husband.
Barack H. Obama never lived with Stanley Dunham's daughter and only saw Barry twice. Not exactly the family portrait our President paints in "his" autobiography. All this birth certificate subterfuge by Barry Soetoro is probably the flailing cover-up of sordid story about an even more sordid family."
"youfamissim 7 hours ago
Enter Bill Ayers, the man many consider the author of Obama's books. That places him in Obama's life in the early 1990s. Lets imagine Ayers is a man with vision. He sees Obama as his ticket to power. A black man can always cow investigation with racist claims. It's like a teflon shield that not only deflects, it also ruins the person making accusations. Obama largely enjoys immunity from investigation and the US Congress under Republican control wet themselves rather than perform their duties to protect the Constitution from Obama's excesses. We learned yesterday that Media Matters are the thugs who look for any act of "racism" and criticisms that stand to impact Obama. MM gets the dirt and passes it along to the MSM who report it without attribution. MM has been effective performing skin color character assassinations - they can see a racist everywhere they look. Or, they can create conditions that make a racist magically appear. Enough people repeating a lie is effective - enough. No white politician can behave like Obama and not suffer consequences - see Clinton; the first black President. Skin color laws today are worse than segregation. Guilt was once the motivation. No more. Intimidation and blatant power are the core elements today. It's the get out of jail free card that permits people like Obama a pass, and assure preference laws remain; and the careers attending those laws. These laws also scuttle the careers or any who dare challenge them - which is why no one will challenge Obama - save the few brave souls who were politely ignored and thought lunatics. Everyone in the chain that would remove Obama from office is exposed. Those in positions to advance a serious challenge, apparently, are unwilling to risk their careers abetting a challenge. This is the real world outcome of preferential race laws. "
"Mrs.A 8 hours ago When I saw the Dunham family photo in a Cashill article I was stunned that Obama is the spitting image of his "grandfather"! O has no resemblance to his Kenyan "father." It's not inconceivable that gramps is the father, and a red-light district woman in Hawaii, his mother. Anyhow, the above article is very interesting and I,too, am glad the author is keeping this issue alive. Someday we may know the truth."
"arcman46 13 hours ago
Having read Cashill's book, and coming to the conclusion long before the 2008 election that Obama's entire life story was based on a lie, I found it almost unbelievable that Obama got the kind of pass that he did from the MSM. Had he not been Black, and a left wing Democrat, the press would have been all over the story."
15 February - The birther reps in the New Hampshire state house try to pass Birther Bill 2.0 in that state.
"Deterred by the "circus" surrounding the issue, a requirement that presidential candidates submit certified copies of their birth certificates was panned in the House Election Law Committee yesterday.
House Bill 1164 was sponsored by Republican Reps. Susan DeLemus of Rochester and Larry Rappaport of Colebrook, both of whom signed on to an effort last year to challenge President Obama's placement on the primary ballot because they doubt his American citizenship."
Problem is that their past attempts have come back to haunt them.
"If this is to be considered at a future time, it could be considered on the basis of its merits alone and not any association with the controversy we've experienced," said Election Law Chairman David Bates, a Windham Republican, who voted against the bill. "Quite frankly, with the circus that ensued around this more recently it's really impossible to adequately, objectively consider the policy merits of this with the fiasco the press made out of it."
In November, Attorney General Michael Delaney requested an investigation into "unruly" conduct by DeLemus and other Republican representatives after the state ballot law commission denied their appeal of Obama's primary eligibility."
14 February - James Manning wants the birthers to dig deep for Dr. Kate, Walter Fitzpatrick, and Terry Lakin.
With Walter Fitzpatrick, the answer is easy - STOP BREAKING THE LAW. IDIOT!! Manning seems to think that Fitzpatrick was a POW in a North Vietnam prison camp, based on how he talks about Fitzpatrick's time in the Monroe County jail.
He also talks about Dr. Kate's "misfortune", due to her inability to find work in her field. (Amusingly enough, he says she "led a march on Washington DC", and fails to mention that her "Usurpathon" had three people attending it.)
I have to admit a lack of sympathy for Dr. Kate or Terry Lakin. In both cases they had careers that their respective hatreds and paranoia ruined. They both threw their careers away, and have only themselves to blame.
Bed. Made. Lie.
15 February - Dr. Orly continues to ratchet up the crazy (malware and redirect warning)
(redaction mine)
"IS OBAMA’S DECISION TO DESTROY 80% OF OUR NUCLEAR ARSENAL, A PAYOFF TO AN IRANIAN MUSLIM JUDGE, WHO HAD OBAMA CORNERED WITH NO IDENTIFICATION PAPERS AND LET OBAMA GOT SCOT-FREE???
Posted on | February 15, 2012"
So WHEN is her family going to have her committed??
"As you know, Barack Obama was cornered in the state of Georgia on January 26, 2012. I issued a subpoena for Obama to appear at trial and produce valid certified copies of his long form birth certificate, redacted application for the Ct SSN (redacted), which he is using, his passport and immigration records. Obama did not appear, did not produce any documents. According to GA law the candidate had to produce documents."
Funny, the judge didn't agree with that. Neither did the Secretary of State.
"Even if I were to produce nothing, the judge had to rule in my favor, as Obama did not produce anything to prove his eligibility"
Umm, no, no, the judge wasn't REQUIRED to rule in your favor. You lie like the rug on Donald Trump's head.
"I went further and produced 208 pages of evidence and at my own expense of over $11,000 flew 7 witnesses from all over the nation. I flew in another attorney and computer/projector tech support person, we conducted a mock trial a day before the hearing (some witnesses arrived late due to airport delays and did not participate in mock trial). I brought a senior deportation officer, who testified, that with anybody else, he would be seeking a warrant for an arrest and deportation considering fraud in use of identification papers, such as observed with Obama. "
And the judge ruled none of them were credible or believable.
"Obama not only was supposed to be removed from the ballot, he was supposed to be sent to prison at the very minimum. "
The scary part is that she might actually believe that.
"When I am saying prison, I am being very generous."
She keeps this up, and she's going to go straight into calls for Obama's execution, followed by a visit from some unsmiling Secret Service agents.
"The question is, who is judge Michael Malihi, does he still have ties with the radical Muslim government of Iran? Did Obama make a deal to destroy 80% of the U.S. nuclear weapons in exchange for Malihi keeping him on the ballot as a Presidential candidate and not sending him to prison for use of forged Social Security card, forged long form birth certificate, elections fraud, wire fraud, Social Secuity fraud and other related crimes?"
There's some really good private mental health hospitals in Orange County. Yosi Taitz really needs to look into them.
"This nationb is being destroyed from within. We have to act now, before it is too late."
O RLY???
"What is being done to this nation, is the highest level of treason, this has to be prosecuted ASAP."
I think that loss to an empty table has completely unhinged her.
15 February - And we have the first wave of Georgia Birther Ballot Jihad appeal documents.
First up, Van Irion's Pro Hac Vice application.
(Scribd link here)
Two interesting notes. He lives in Monroe County, Tennessee (wonder why he hasn't helped Fitzpatrick out any), and Georgia State Rep (and fellow birther attorney) Mark Hatfield is sponsoring his PHV.
The second is Van Irion's motion for Emergency Stay
(Scribd link here)
The third is Van Irion's appeal of Judge Malihi's and SoS Kemp's decision.
(Scribd link here)
Van Irion clearly subscribes to the "14th Amendment citizens aren't natural born citizens" school of thought. Not surprising, considering his Neo-Confederate leanings.
"Had the drafters of the Constitution intended all people born in the U.S. to be considered natural born citizens, the 14th Amendment would not have been necessary. Had the drafters of the 14th Amendment intended that Amendment to alter the Article II definition of natural born citizen, they would have clearly stated so. Yet the term “natural born citizen” is not found anywhere within the 14th Amendment. The Amendment also makes no reference to Article II.The OSAH ruling, therefore, violates rules of construction that the OSAH had itself relied upon just days earlier in the same litigation."
And this gem:
"Without the anti-majoritarian protection of the Constitution, Congress could legalize the killing of all Jews, for example, as was done in World War II Germany."
Is it possible to Godwin a legal paper??
Something else is that Van Irion only lists Obama as a defendant. Shouldn't the Georgia Democratic Party or Brian Kemp be listed as well??
15 February - In a remarkably short piece, World Nut Daily attempts to spin Dr. Orly's questioning of Newt Gingrich.
"Presidential hopeful Newt Gingrich encouraged California attorney Orly Taitz to continue her campaign to question Barack Obama’s constitutional eligibility to hold office in a Southern California campaign appearance."
He did??
"Taitz, who has filed several lawsuits aimed at securing Obama’s certified birth certificate and introducing evidence of his ineligibility for office, rose to her feet to address Gingrich in Pasadena. She suggested his lagging campaign could only be lifted by raising the issue publicly.
“It could help your campaign like it did Donald Trump,” Taitz said."
You mean it could turn Newt Gingrich into a gigantic laughing stock and punchline as well???
"Gingrich responded by saying Taitz was better equipped for the role.
“That’s a project you should pursue,” he said."
Because he doesn't want to openly get the stink of birther on himself.
And in comments:
"Bill RindTop 100
all the judges behind this scam about this frauds BC will be held accountable for treason when the time is ripe, we know who all the judges are and by name who sided with the liar in chief, and you will all be brought into contempt of the nation, for dishonoring of your oaths. keep drinking and laughing it up you black robe demons, the axe will soon fall on all of you who sided with criminality. may all of rot in hell when the day comes.
15 February - Kansas seems to be gearing up for their own birther bill.
"Politicians and conspiracy theorists, sometimes referred to as birthers, have sought to disqualify Obama from running for president, being sworn into office and running for re-election. They've claimed Obama isn't a natural born citizen and consequently ineligible to be president.
In 2008, Obama released documents from Hawaii regarding his birth. He also released last year a certified copy of his original certificate of live birth from Hawaii.
Rep. Scott Schwab, an Olathe Republican and chairman of the House Elections Committee, said the bill's origin was tied to anxiety about Obama's birth status.
He said the amended version had more to do with acknowledgment candidates for state and federal office in Kansas should be held to the same identification requirements applied to people casting votes in the state's elections."
15 February - And now we have Dr. Orly's appeal for the Georgia Birther Ballot Jihad.
First, the Pro Hac Vice
(Scribd link here)
Looks like Thomas MacLeran is off the Plaintiff list, and she makes the same mistake about the defendant that Van Irion does. She doesn't have a local sponsoring attorney though, and makes no mention about her past sanctions.
Second, the Civil Case filing
(Scribd link here)
And finally, the appeal
(Scribd link here)
It's pretty much typical "Wahhh! The judge DARED to TELL ME NO!!! SCREECH!! TRAITOR!! SCREECH!!!!!" Dr. Orly goodness.
"10. Petitioners provided testimony of 7 witnesses and 208 pages of exhibits, showing that the Respondent does not have valid identification records. Exhibit 4 Transcript of the proceedings. Per instructions of the court Petitioners submitted proposed summary of fact and law Exhibit 3."
Those would be the same witnesses and exhibits the judge said were not credible, right?
"The only thing Obama provided, was an empty chair. Did the empty chair testify under penalty of perjury in front of judge Malihi and told him, that Obama was born in this country? Did the empty chair provide Malihi with any evidence, with the original birth certificate or a certified copy?"
She is REALLY upset that she lost to an empty table,
"This behavior of judge Malihi was so outrageous, that not only his advisory opinion needs to be set aside, as not grounded in any fact or law, but state and county grand juries and the Attorney General of Georgia need to launch an investigation into actions of judge Malihi and possible direct or indirect undue influence by Obama. Decision by Malihi reads, as if it was entirely written by Obama's personal attorneys Robert Bauer and Judith Corley of Perkins Coie and rubber stamped by Malihi. It is noteworthy, that both Robert Bauer and Judith Corley need to be criminally investigated as well, as both of them were complicit in aiding and abetting Obama in presenting to the public on April 27, 2011 a computer generated forgery and claiming it to be a true and correct copy of Obama's birth certificate."
Accuse the judge of corruption. That will go over well.
"Similarly Malihi's reliance on a decision in Ankeny v Daniels, an obscure case in Indiana, brought by two pro se litigants with zero knowledge of law and without any input of any legal counsel, is erroneous.
Defense did not provide Ankeny v Daniels at the hearing. Malihi was supposed to base his opinion on what is in the record."
Again that weird idea that a judge can't do their own research and homework, but has to stick to the information provided.
"Plaintiffs had no opportunity to provide a rebuttal and explain numerous points, as to why Ankeny is erroneous and why it does not apply."
It was in the cases Jablonski cited in the pre-hearing paperwork. Not the judge's fault you failed to do your homework.
"A presiding judge cannot suddenly pull out of a hat some case, brought in a circuit court of another state by some truck driver, who could not even afford an attorney"
Snotty much Dr. Orly???
"As Obama did not provide any documentary evidence of his birth in the U.S. Malihi was supposed to rule in favor of the plaintiffs on the merits."
No, he was supposed to rule on the merits of the evidence provided. Not give you everything your wanted unquestioningly + a pony.
"They presented seven witnesses, which testified under oath and have proven, that not only Obama cannot be on the ballot, he needs to be criminally prosecuted for fraud and forgery."
She really, really, really though that hearing would end with Obama in chains, didn't she?
"First, not all of the witnesses needed to be qualified as experts, and ones, that testified as experts, were properly qualified. Malihi's statement, that none of the witnesses provided persuasive testimony, showed nothing but bias."
No, it showed that none of the witnesses you provided were credible.
"d. Kim Ark was not an unanimous decision. Chief Justice Melville Fuller and Associate Justice John Harlan dissented, pointing out that since the Declaration of the Independence, U.S. parted from the British Common Law doctrine of jus solis and followed the international doctrine of jus sanguinis, with offspring inheriting the nationality and allegiance of their fathers."
So she's claiming that Wong Kim Ark doesn't apply or be considered as a previous case citation because it wasn't a unanimous decision??
I suspect the appeals judge won't agree.
It almost might be worth seeing her get Pro Hac Vice simply so the judges can sanction her happy ass....again.
15 February - More about Missouri's Birther Bill 2.0
"Rowland’s bill would not take effect until 2016, when Obama would not be eligible to run if he wins in 2012. People testifying in support of the bill, however, believed the legislation should be used to target the current president."
"Why should we wait?? The scary black man is president NOW!!"
“Why do we have to wait four years? Why not start now?” said Hector Maldonado, who run for U.S. Senate in 2010."
Ah, yes. Bitter, party of one.
"Mitch Hubbard, a former candidate for Missouri Secretary of State, said it was very important to resolve the question of a president’s citizenship sooner rather than later.
“Our soldiers need to know there is no question he is the commander of chief,” Hubbard said."
Translation - "That uppity boy damn well better show us his papers, hear?"

Oily Tits isn't a natural born American citizen herself. She might be naturalized, but unless I was able to see the original documents I would highly doubt it...
The happy thing about this whole Birther thing is this. Oily keeps the conspiracy nutters entertained. They wouldn't accept Obama if there were a video of his birth broadcast live on CBS, with witnesses and high resolution photographs and if his mom and dad had links back to the Pilgrims.
Obama is Black. Period. "Yes, but..." as they wiggle to find something that isn't just overt racism. As long as Birthers are entertained, we all can sit back and laugh as we know they have no real power and everyone does their best to just ignore them.
Oh Oily, how little and stupid you are. But thank you!

Patrick, I think the reports for Birterstan are going to continue for decades to come. To this day their are moon landing deniers and flat earthers. The Birthers will be crying about the "usurper" for the rest of their lives.
Sadly, they'll pass their affliction on to some of their children, too.
Birtherism will never die. Mark my words.

Excellent post as always. One small correction, I believe it should be "Birther Bill 2 - Electric Boogaloo"
Birther Bill 3 will be Beyond Thunderdome.

The US Immigration Act of 1918 allowed for the deportation of aliens who, among other things,
"...advise, advocate, or teach opposition to all organized government;
[who] believes in, advises, advocates, or teaches:
(1) the overthrow by force or violence of the Government of the United States or of all forms of law, or
(2) the duty, necessity, or propriety of the unlawful assaulting or killing of any officer or officers, either of specific individuals or of officers generally, of the Government of the United States or of any other organized government, because of his or their official character, or
...write, publish, or cause to be written or published ... any written or printed matter, advising, advocating, or teaching opposition to all government, or advising, advocating, or teaching:
(1) the ovethrow by force or violence of the Government of the United States or of all forms of law, or
(2) the duty, necessity, or propriety of the unlawful assaulting or killing of any officer or officers of the Government of the United States or of any other government...
The radical Emma Goldman was deported from the US under this act *after* she had attained US citizenship.
Orly is damned lucky this law was repealed in the 1950s. Otherwise I and many others would be calling for her deportation as an alien who advocates opposition to and overthrowing of our government, specifically targeting our President.
She's a f*cking traitor and doesn't deserve to enjoy the privilege of her naturalized citizen status.

Another great recap, Patrick. Chock full of craptastic madness from all corners of Birtheristan!
Ahh...Gary Kreep attempting to run to be a San Diego judge... *most hilarious* of all the tidbits in this compilation! LMAO! You'll definitely have to keep that race on your radar and report on it as it develops...
Re: All the Birther Attorneys & their GA appeal attempts - These folks are supposed to all have law licenses. How can they be so incompetent as to *not* figure out that THE main defendant in their appeal *is* the GA SoS, as they are trying to appeal his ruling... The case (or cases if they are not combined) will be XXXX v. Kemp.
We're all used to Orly getting even the most basic filing detail wrong. We also all know that the Birther attorney's entire case reasoning is flawed too.
...But for them NOT to even identify the GA SoS as proper main defendant in their appeal... wow... just wow... *that* takes a special blend of utter legal incompetence to pull off!
Speaking of special blend of utter legal incompetence and Orly - as much as I too would love to see her face more long overdue santions, I find the odds of her Pro Hac Vice being granted to be quite slim here. It was GA where she got her previous santions, after all. More importantly, the *very* application form she had to fill out *requires* that all previous sanctions, etc. be indentified...which Orly *failed* to do... (no surprise there).
In fact, as Dr. Conspiracy pointed out in his recent blog post, Orly FAILED to respond to 8 of the 9 required questions on that application...
http://www.obamaconspiracy.org/2012/02/orlys-hack-pro-hac-vice-motion/
So, I can't see how the GA courts can accept her, when she can't even complete and file the application form correctly...

Hey, if they can cite De Vattel and Minor v. Happersett, why can't we just deport her based on that law anyway? We can just say its repeal was an insult to the Constitution.
Anyone for the Deport Orly PAC?

@ Another Patrick,
You'll never have to worry about wiggling on race. Your obsession stands out for all to see.
Isn't 0bumm0, your 'afro'-marxist muslim messiah, more white than black? Wasn't his black roots sullied with the blood of middle-east arabs?
Posted by: Rambo Ike | February 15, 2012 at 10:48 PM
Rambo Ike - You know, it's only right wingers that use the "messiah" term. I certainly don't.
The Luo tribe originated in southern Sudan and spread though East Africa, and is considered to be part of the Nilo-Saharan. There is no proof of major amounts of Semitic ancestry in that socio-ethnic group, and the Nilo-Saharan language and racial set is not considered to be Semitic in origin.

Birther progression:
He was born in Kenya! Or Indonesia! Or Canada!
He was born here but that's not good enough because his father wasn't!
He was born here but the father on his BC wasn't really his father. It was MalcomX! Or Frank Marshall Davis!
He was born here but his mother wasn't really his mother and his grandfather was his father!
Posted by: Glix | February 16, 2012 at 11:58 AM
Xyxox,
Like Bush Jr. had the 9/11 Truthers and their "hate minute", Obama has had to deal with the birthers - with the only exception that Obama had to publicly refute it.
And like 9/11 Truthers, the birthers have had their moment in the spotlight (let's face it, they had quite a following in 2006), only for things to come crashing down, leaving them with a hardcore group of people, spouting off arcane theories (you wouldn't believe some of the stuff the Truthers make up, it's as arcane as the "Obama was born in Japan" theory).
And, sadly, like the 9/11 truthers, the birthers will also be around for a long time. As long as there are people willing to bankroll them (former senator Mike Gravel made off with a few grand from the truthers recently), they will continue to spout their vile stuff.
Posted by: KDLarsen | February 16, 2012 at 01:20 PM
And Van Irion can add history to the list of things he knows nothing about. Nazi Germany kept most of their a mass murder programs secret (in the case of Aktion T4, the euthanasia program, it was mostly a public secret though, and the mass murders in Eastern Europe became public knowledge little by little as the war drew on), and they were thus never legalised. Hell, Hitler even had to suspend Aktion T4 for a period, as the public protests became too loud.
Posted by: KDLarsen | February 16, 2012 at 02:54 PM
Oh no, not again!
Patty has once again been caught spinning the facts on his beloved phoney marxist 0bumm0 who is illegally occupying the Whitehouse of We, the American people.
Associating the term "messiah' with 0bumm0 came from the anti-white Louis Farrakhan, a leader of your ilk. He believed 0bumm0 was 'The One' that had come to destroy the white race & America.
http://www.youtube.com/watch?v=srk18X804hQ
It might be true that there was no major amount of semitic blood in the Luo tribe. Still, from a number of reports I read, 0bumm0's ancestral clan within the tribe was infested. Many of them muslims, like their descendant 0bumm0 who knew Islam on 3 continents, they strongly worshipped the totalitarian political religion. Also, the names Barack & Hussein have been reported to be of Middle East & arab origin.
Were the African ancestors of your dear leader 0bumm0 slave traders/traffickers & owners?

According to the govt of Kenya Obama's records are SEALED... WTF does that mean? Maybe it is true, as his grandmother said, that Obama was BORN in KENYA!!!!!!!!
Get rid of this CRIMINAL

Rambo Ike - Farrakhan is no leader of mine. I think he's a gadfly and a jerk actually.
Actually "Barack" comes from the Biblical name "Baruch. "Baraka"is a variant you find in both Hebrew and Arabic.

@ Patty
I don't believe the book is closed on exactly what grandma Sarah said or meant to say.
We do know that many in Kenya have claimed it is 0bumm0's birth place, including Kenyan government officials. Also the Kenyan congress passed some type of legislation/bill confirming 0bumm0 as "Son of the Soil". During visits to Kenya, both 0bumm0 & his wife MOOchella have claimed it as his "home country".
@ Thomas BrownNose
Nice going. We now know where your station in life exist: at the bottom of the sewer.

@Rambo Ike - Your writing truly shows just exactly what intellectual capacity you actually possess - which is none. Only those with diminished brain power choose to demonize those they hate by playing stupid spelling games with their names. Just admit that you are a racist pig and get it over with. Your words mean nothing and you have done nothing but make a laughing stock of yourself.

"I don't believe the book is closed on . . ."
That's what Birthers always say, always have said, and always will say in response irrefutable proof of Obama's eligibility. They always have more questions because Birtherism is just an excuse for spew ugly insults.
Posted by: Bob | February 17, 2012 at 04:26 AM
I see that the deranged ODS sufferers out there are having an extra difficult time in dealing with all the endless Birther FAIL events and the increased liklihood of Obama's re-election. All they can do is sling poo by attempting to dig up the moldiest of long debunked Birther myths. In other words, a bunch of emotional infants are having another weak tantrum... *yawn*
@Rambo Ike - Again, your own words are proof that the only people that call Obama "messiah" are those who are his irrational detractors and not supporters.
Your other nonsensical point about Kenya is just stupid. All that nonsense has been debunked hundreds of times over the past 4 years. Who cares that there are a few stupid clowns who have said incorrect things in Kenya. All you've demonstrated is that stupid, ignorant people who say incorrect things exist in every country. *shocking* Heck, this country is full of them, as you are a perfect case in point.
Now obviously, we've got a new ODS clown posting around the blogosphere going by the monikor of "Dan Ackroyd", a famous comedian. Fitting for a cheap troll act, as everything he says is just a lame joke.
