BadFiction - a look at bad movies and worse politics: Dispatches From Birtherstan

So the last two days in Birtherstan have been interesting.

We have the expected fall out from the Supreme Court terminating life support on Keyes/Barnett v Obama. Sher Zieve really needs to drop the e-meters and get on some thorazine. World Nut Daily wants a second chance to lose to Esquire magazine. Dr. Orly's Indiana Birther Ballot Jihad doesn't go quite like she planned, though the answer she got wasn't unusual or unexpected.

Montgomery Sibley decides one dismissed case isn't' enough. Peed splashes past Kreep. Dr. Orly remains in 5th place. The State of Hawaii is showing a decided lack of patience with the birthers.

The biggest news seems to be World Nut Daily's favorite attorney, deadbeat dad Larry Klayman, and his Florida Birther Ballot Jihad. Complete with look alike affidavits from Joe Arpaio, Mike Zullo, and Jerome Corsi. And World Nut Daily seems to be pulling out all the stops for this one, including courtroom coverage by WND-TV.

11 June - The inmates at Birther Report take the news about the final death of Keyes/Barnett v Obama with the well-reasoned maturity and understanding we've come to expect from the birtherstani.

And she's continued her decent into madness.

12 June - Larry Klayman announces that Joe Arpaio has "authorized" a Cold Case Posse affidavit in his Flordia Birther Ballot Jihad.

I'm sure Dr. Orly is going to be screaming that Klayman got this from Arpaio when she can't get Arpaio to respond to any of her subpoenas.

"Attorney Larry Klayman has announced that Sheriff Joe Arpaio has authorized an affidavit by the Cold Case Posse to support allegations of Obama document fraud cited in the Voeltz v Obama FL ballot challenge case. This should undercut previous defense arguments that previous witnesses were not credible, although their qualifications and experience should be more than sufficient to establish that Obama’s alleged proof of eligibility is fraudulent."

By the way, they want money.

Interesting. Klayman (who is both an attorney for and a writer for World Net Daily), gets an affidavit "authorized" by Joe Arpaio (who has had money collect for him by World Net Daily, and who has been parroting claims from another World Net Daily writer), and Mike Zullo (who has also been working closely with World Net Daily.)

I think it's safe to say Joesph Farah is involved in this up to his pornstar mustache.

Up until this point, Arpaio's been careful not to place his Corsi-provided evidence anywhere where it would be cross-examined in a court of law. I'm wondering if this "authorization" is an attempt to place some distance between Arpaio and Corsi's claims, so that when it is dismantled in a court of law, Arpaio can claim that he was just going on what his CCP told him. (Not to mention that it allows Arpaio to give these claims some "validity" without doing such in his jurisdiction)

On there other hand, it does allow Corsi and World Net Daily's claims to be dismantled in a court of law and for their "experts" to be shot down in flames. Not that it would stop the birthers - they would just go on about "corrupt courts".

12 June - What a surprise. World Nut Daily appeals their loss to Esquire magazine.

"WND has filed notice to appeal a federal judge’s decision to dismiss its $250 million lawsuit against Esquire magazine

WND’s suit seeks damages for a report by Esquire’s website that falsely claimed the WND Books expose “Where’s the Birth Certificate? The Case That Barack Obama Is Not Eligible To Be President” by Jerome Corsi had been recalled and repudiated by the publisher.

“We’re confident that it will be reversed very quickly,” said attorney Larry Klayman, who is representing WND in the case."

Considering how long it took the court to dismiss the case, I wouldn't suggest holding your breath. Then again, it's Larry Klayman, so please Mr. Klayman, go right ahead and hold your breath……

12 June - Courtroom observers report that Dr. Orly heard a very familiar word in Indana today.

12 June - What a surprise. World Nut Daily pimps Arpaio's affidavit.

"Arizona Sheriff Joe Arpaio and his Cold Case Posse lead investigator have submitted sworn affidavits in a Florida case challenging President Obama’s eligibility for the election ballot of the crucial swing-state that decided the 2000 presidential election."

"Significantly, Judge Terry Lewis in Leon County – known for his rulings in the Bush v. Gore case at the center of the 2000 contested election – has confronted the White House for failing to support its claim that the term “natural born citizen” in the U.S. Constitution means something other than the offspring of two American citizens.

Lewis has scheduled a hearing for Monday at 9 a.m. at the Leon County Courthouse in Tallahassee to hear the Obama team’s motion to dismiss the case and determine whether it should go forward with discovery."

"Arpaio recounts in his affidavit how, in response to the request of Maricopa County residents, he commissioned a team “of former police officers and attorneys who have worked tirelessly since last October, looking into this controversy.”

“Upon close examination of the evidence,” Arpaio states, “it is my belief that forgery and fraud was likely committed in key identity documents including President Obama’s long-form birth certificate, his Selective Service Registration card, and his Social Security number.”

Now bear in mind that the only "evidence" that the Maricopa CCCP considered in their "investigation" was stuff provided by Jerome Corsi that had already been debunked. They went out of their way NOT to consider any contrasting evidence or information.

"Zullo states in his affidavit that he advised Arpaio that the document posted by the White House as Obama’s birth certificate represents two crimes: fraud in its creation and fraud in its presentation to residents of Maricopa County and the American public as “proof positive” of Obama’s birth in Hawaii.

His investigators further determined, he says, that the Hawaii Department of Health has engaged “a systematic effort to hide from public inspection whatever original 1961 birth records the Hawaii Department of Health may have in their possession.

Zullo points to five videos the Cold Case Posse produced at a March 1 news conference to demonstrate why the White House document is suspected to be a computer-generated forgery.”

You mean the five videos repeating Mara Zebest's debunked forgery claims??

"Klayman also is submitting, as part of Corsi’s affidavit, a copy of the WND reporter’s book Where’s the Birth Certificate?”, which presents a detailed explanation and history of the natural-born citizen clause and its relevance to Obama."

Oh you have GOT to be joking!

Then again, Klayman publicly admitted that this is all political theatre.

Arpaio's Affidavit is here (PDF) It's all of two pages. What's interesting is:

"7. Upon close examination of the evidence, it is my belief that forgery and fraud was likely committed in key identity documents including President Obama's long form birth certificate, his Selective Service Registration card, and his Social Security number.

8. My investigators and I believe that President Obama's long-forn birth certificate is a computer-generated document, was manufactured electronically, and that it did not originate in a paper format, as claimed by the White House. Most importantly, the "registrar's stamp" in the computer generated document released by the White House and posted on the White House website, may have been imported from another unknown source document. The effect of the stamp not being placed on the document pursuant to state and federal laws means that there is probable cause that the document is a forgery, and therefore, it cannot be used as a verification, legal or otherwise, of the date, place or circumstances of Barack Obama's birth.

9. The Cold Case Posse law enforcement investigation into Barack Obama's birth certificate and his eligibility to be president is on-going. The on-going nature of the investigation is due to additional information that has come to light since we held the press conference in March, 2012. As soon as that information has been properly verified by the Cold Case Posse, I will release that information to the public."

A couple things come to mind:

1 - The State of Hawaii has stated repeatedly that nobody in Arpaio's office or the Maricopa CCCP ever contacted them to verify any of the information provided. Since the Mississippi Democratic Party could easily get such verification, and since even Arizona's Secretary of State could get it with a little help, it beggars the imagination to try and figure out why the Maricopa CCCP wouldn't have attempted likewise.

Unless they knew damn well that the information was legit.

2 - If the "evidence" presented to Arpaio was so convincing, then it simply defies belief that, rather than present this to to appropriate officials IN HIS OWN STATE to have official charges filed, he's instead sending this to a case clear across the country. (to an attorney with ties to Arpaio's appearant sugar daddy, World Nut Daily)

If a real law enforcement official had this kind of evidence, they wouldn't be doing press conferences and releasing information to the public. They would be arranging to file charges and and make sure the evidence collected was has airtight as possible,. The fact that Arpaio hasn't done this is speaking volumes that Arpaio, Corsi, Zullo, et al, know damn well none of their "evidence" would hold up in court.

3 - The way this is worded suggests that Arpaio is trying to give himself some wiggle room if this does blow up in his face, by giving him excuses to say "based on what I was told" or "based on the evidence I was shown". It's very weasel-worded.

4 - Arpaio's "affidavit" is pretty much 100% hearsay.

Mike Zullo's affidavit is here (PDF). It's three pages, the first page is almost a complete duplicate of Arpaio's.

"8. The Cold Case investigators further determined that the Hawaii Department of Health has engaged in what Sheriff s investigators believe is a systematic effort to hide from public inspection whatever original 1961 birth records the Hawaii Department of Health may have in their possession, including changing policies and procedures and denying valid Freedom of Information Act (FOIA) requests for information related to the 1961 birth records (said requests were not for any birth records)."

It's rather interesting he would make that statement, since the State of Hawaii confirmed that the Maricopa CCCP never once tried to contact them on this subject.

Not to mention that FOIA applies to Federal agencies, and not State agencies. And if they had bothered to research Hawaiian law rather than simply go "Corsi said it, I believe it, that settles it", they would have noticed that Hawaiian law prohibits the release of much of what the Maricopa CCCP was demanding.

Oh, and swift boat liar Jerome Corsi's affidavit is here (PDF)

"6. At Sheriff Arpaio's request, I agreed to tim over to the Cold Case Posse all the research I conducted to write my book "Where' s the Birth Certificate: The Case that Barack Obama is Not Eligible To Be President," published May 17, 2011, as well as all relevant research I conducted subsequently."

So I think it's safe to assume that all the "evidence" used had been long debunked before Corsi ever talked to the Maricopa CCCP.

"9. Based as well on extensive research and investigation, I have written and published a book on the subject of Barack Obama's eligibility to be president of the United States and found that, at a minimum, there are significant issues of fact that are in dispute as to where he was born, Hawaii as he claims, or outside of the United States and its territories. I am incorporating into this affidavit the contents of my book: "Where's the Birth Certificate?: The Case that Barack Obama is Not Eligible to be President" which sets forth my findings, as Exhibit 1. I attest to the accuracy of my book."

You mean the accuracy of a book that was debunked and proven to be a pack of lies BEFORE IT WAS RELEASED???

I will also note that all three affidavits looked and sounded very much the same, right down to the same formatting. Wonder who on World Nut Daily's staff wrote them up....

12 June - Larry Sinclair's kilt-wearing incompetent disbarred attorney, fresh off his birther lawsuit's dismissal, files ANOTHER birther lawsuit!

"Montgomery Blair Sibley, the disbarred D.C. attorney and presidential write-in candidate, has not wasted time since the U.S. District Court for the District of Columbia dismissed his birther lawsuit on June 6.

"I immediately filed suit in the D.C. Superior Court against the D.C. Board of Elections [and Ethics]," Sibley told The Huffington Post on Tuesday.

This new lawsuit, filed June 8, asks that the Board of Elections and Ethics be compelled to "respond to investigate Sibley's Request challenging the eligibility of Barack Hussein Obama to be on the November 6, 2012, General Election ballot as a Presidential candidate."

12 June - Birther Report reposts (and watermarks as their own) a KPBS-TV interview with Gary Kreep

His comment about Dr. Orly's "lack of ability" is amusing. But the rest of it is standard birther lies.

One new twist, Kreep's claim that not only did President Obama's step-grandmother witness his birth in Kenya, but performed a "Zulu birth ritual". Which is weird, since Sarah Obama is a Luo, not a Zulu.

Maybe to Kreep, they all look alike……

12 June - Get the feeling that the State of Hawaii has pretty much lost all patience with the birtherstani??

"When asked in an email identified as being from WND if there ever was an explanation for Abercrombie’s not finding the documentation in light of its easy access to state officials a short time later, she refused to answer.

“What news organization are you with?” she demanded. “We get frequent birther questions and this would fall in that category.”

Subsequently, she refused to respond to email questions about the issue that the governor raised.

When WND called, a receptionist in the office responded to the same inquiry with “That’s been done” – apparently meaning president had released the birth certification image. But she indicated she would not respond to further questions, promising to take a message and have someone call back."

13 June - World Nut Daily announces that "WND-TV" is going to provide video coverage of Klayman's Florida Birther Ballot Jihad.

"WND-TV will provide gavel-to-gavel, live video coverage of the latest challenge to Barack Obama’s constitutional eligibility in a courtroom hearing that could deny him ballot access to this all-important electoral swing state in November.

Judge Terry Lewis, best known for presiding over the 2000 Bush v. Gore election dispute, will consider arguments from attorney Larry Klayman and attorneys for the Obama campaign. The hearing will focus on Obama’s claim to be a “natural born citizen,”” as required under Article 2, Section 1 of the Constitution.

Lewis is credited with making crucial rulings in the contested 2000 presidential election, when ultimately a Florida vote recount was halted by the U.S. Supreme Court and George W. Bush was declared the winner.

Wonder if it "WND-TV" is gonna be Dean Haskins and his "Vattelvision" again? And doesn't it seem rather…..interesting……just how much World Nut Daily is hyping this one. Almost like all the players on the plaintiff side are somehow involved with WND…….

Yeah, the entire FL case has devolved into nothing more than the latest WND political theater stunt.
WND has become awfully desperate to pimp Arpaio and Birtherism as its latest "Swift Boat" attempt. Too bad their ship has already sailed and quickly sunk on them...

WND knows they have zero chance of winning this lawsuit. They simply believe the old BS adage that any news is "good news" for them...and the daffydavits here are nothing but their latest PR stunt, hoping that it might cause REAL media to pay attention to them again...

(Answer - it won't. The Law of Diminishing Returns pretty much tells us this will get even less notice than the first EPIC FAIL puppetry of Arpaio that WND pulled back in March...)

I'd imagine that any bar association that does its' job would also have something to say about filing lawsuits as political theater, but birfoons are "special".
