Thanks again to Reality Check for having me on his Blog Talk Radio show last tuesday (21 August). Alas, Blog Talk Radio took a dump about an hour and 15 minutes in, and didn't archive it either. Bother.
Anyway in today's dispatches, the tribble-pated one plans an RNC surprise. Joe Arpaio plans to hang around with fellow piles of elephant dung. Birtherpoolza 2.0 gains some more attention. The "Special Operations Speaks" PAC has some rather interesting connections and more than one birther.
Lame Cherry is…..well, Lame Cherry. The US Attorney's office replies to Gordon Epperly. The judge in Van Irion's Tennessee case makes a decision on costs and sanctions. Some birther RNC humour. And a Washington State death threat against the President.
A judge in Texas seems to be just the one for the birthers. Dr. Todd House may have been less than honest with his DIY lawsuit.
And more and more tacit approval and winking by Mitt Romney and the GOP at the birtherstani vote and demographic, complete with seven known birthers or birther panders speaking at their convention. Expect more of that between now and election day.
19 August - Tribble mobility scooter and Romney surrogate Donald Trump claims to have a "surprise" role at the GOP convention.
"Convention organizers won’t say what he’ll be doing in Tampa or whether he’ll address the delegates there. But they promise the controversial billionaire and prominent anti-President Barack Obama provocateur will be part of their opening day schedule.
The move will undoubtedly generate headlines given the real estate mogul’s star power and his flair for the unconventional.
But it will also give Democrats an avenue to pound the GOP for giving a platform to a man who has relentlessly questioned Obama’s citizenship.
Mitt Romney has embraced Trump this campaign season, including attending a Las Vegas fundraiser in May thrown by the reality TV star.
Trump has generated some buzz with recent posts on Twitter saying he was planning a “big surprise” at the convention next week. But for the first time sources are confirming Republicans will indeed enlist Trump to be part of their opening day act."
The Romney campaign and the GOP may not openly be in bed with the birthers, but they certainly have unzipped the birthers fly and are slipping their hands down the birthers pants while licking their lips seductively.
20 August - Looks like Joe Arpaio is going to be speaking in Tampa during the GOP convention as well.
"Maricopa County Sheriff Joe Arpaio is scheduled to speak to delegates from western states on Aug. 30 during the Republican National Convention, the Arizona Republican Party said in a press release.
"Sheriff Joe is a good friend and a great Republican, a former member of the Electoral College representing Arizona, and he's wildly popular not just in Maricopa County but throughout the state and the country," said Tom Morrissey, Chairman of the Arizona Republican Party in the release.
In a tongue-in-cheek move, Arpaio will speak near the elephant enclosure at the Lowry Park Zoo in Tampa, Fla. The elephant is the symbol of the Republican Party."
21 August - Dr. Kate pimps Birtherpoolza 2.0 in Phoenix.
Oh, and dig deep.

I’m thinking more on the lines of attempted assassination games on Romeny/Ryan maybe RP–but definitely R/R. No way does barry want to lose, the election is to near and he is losing big time–word is out everywhere that he is a usurper, an illegal alien, a traitor, a fake, a sham, a kenyan born in kenya…and his GIG to take down America and us is too close — and I bet most of the rino congress is on to this as well–they will be called out when he loses in Nov and they will all be charged as co-conspirators – all full well knowing barry wasn’t legit to be potus. They are all in on it.

21 August - Looks like "Special Operations Speaks PAC" has more than one birther on board.
" Former Navy SEAL Ben Smith is often quoted representing OPSEC Education Fund, a group of former special operations members who accuse the president of allowing leaks about classified military operations and taking undue credit for the work of special operations forces, such as the May 2011 killing of Osama bin Laden.
The group claims to be non-partisan, although the New York Times has reported that several of its members have been involved in Republican campaigns or have been associated with the Tea Party in the past.
Smith, who is featured in OPSEC's 22-minute video "Dishonorable Disclosures," was not only a spokesman for the Tea Party Express, he has a long record of writings that seek to portray the president as a foreign-born imposter bent on driving a socialist-Marxist agenda. "
" Smith then wrote that Obama had used "some bad tan lotion because he looked like an old bruised Banana which made me think that Harry Belafonte was walking out to give his rendition of ‘Day-O' before ‘ole' suck and blow' was to come out and enlighten us with his blasphemous spew."

Smith then tries to get the stink of birther off of him. And then backtracks that.
"Despite having previously called Obama a Muslim, on Monday Smith took to his Facebook to claim he is not absolutely sure the president was born outside of the United States. "I am not a birther - I have my doubts like the rest of us," he wrote. Today, he added, "I AM AS MUCH A BIRTHER AS THE PRESIDENT IS A CITIZEN. This is in response to [Obama's] comment that we are birthers."
Well, since the President is a citizen, then you must be a birther.
21 August - Why am I not surprised Lame Cherry has an opinion about Rep. Todd Akin, considering that Lame Cherry has more issues about sexuality than the entire print run of Penthouse??

22 August - In Washington State, another death threat.
"A Seattle-area man was arrested Tuesday after emailing a threat against President Barack Obama to an FBI account.
According to KOMO-TV, Secret Service agents went to the Federal Way home of 31-year-old Anton Caluori immediately after the emails were intercepted. The nature of the threat was not revealed, but when authorities reached Caluori’s apartment, a local police spokesperson said, they got an unwelcome surprise.
“When the door opened, he was armed,” Cathy Shrock told KING-TV. “It was brandished at the federal agent and the federal police officer.”
Caluori was taken into custody and confiscated two weapons on the premises. A bomb squad was also called in to sweep the home for explosives following some comments by Caluori. "
22 August - The Swiftboat-style attack by the so-called "Special Operations Speaks PAC" may be running aground.
"The fall from grace began with Larry Bailey, a retired 27-year veteran of the Navy SEALs who founded the anti-Obama political group Special Operations Speaks. Bailey's military career placed him in a unique position to attack the president, but it didn't take him very long to get off message, as Foreign Policy's Josh Rogin found out. "I have to admit that I'm a Birther," Bailey told Rogin. "If there were a jury of 12 good men and women and the evidence were placed before them, there would be absolutely no question Barack Obama was not born where he said he was and is not who he says he is." In the interview, he also said Obama was a socialist who was raised by communists, which caught the attention of Obama campaign official Ben LaBolt who gleefully distributed the article to Washington reporters."
23 August - Lubbock County Judge Tom Head is banging the drums of civil war.
"Judge Tom Head and Commissioner Mark Heinrich told the station this week that a 1.7 cent tax increase for the next fiscal year was necessary to prepare for many contingencies, including Obama's re-election. He also mentioned to the station that the county needs a pay increase is needed for the district attorney's office and more funds to pay for more sheriff's office deputies.
"He's going to try to hand over the sovereignty of the United States to the (United Nations), and what is going to happen when that happens?," Head asked the station during a Monday interview. "I'm thinking the worst. Civil unrest, civil disobedience, civil war maybe. And we're not just talking a few riots here and demonstrations, we're talking Lexington, Concord, take up arms and get rid of the guy."
Head also seems to fear the retaliation of such civil unrest.
"Now what's going to happen if we do that, if the public decides to do that? He's going to send in U.N. troops. I don't want 'em in Lubbock County. OK. So I'm going to stand in front of their armored personnel carrier and say 'you're not coming in here'.
"And the sheriff, I've already asked him, I said 'you gonna back me' he said, 'yeah, I'll back you'. Well, I don't want a bunch of rookies back there. I want trained, equipped, seasoned veteran officers to back me."
22 August - Some people are unimpressed at birther report over Donald Trump.
Wow. It's amazing people still believe, and/or listen to, the sheriff and Trump. Worst, the sheriff milks the issue from people who continue to give. The problem is that on 22 August 2012, House told an interviewer:
"House said in the interview that he doesn’t believe Obama was born in Kenya but said that the president has not proved he was born in the United States."
So House stated something in his lawsuit he doesn't personally believe in.
23 August - Jay Bookman at the Atlanta Journal-Chronicle notes the GOP's dark side, and tacit encouragement of birtherism.
"The Republican Party has invested years of effort in trying to depict Barack Hussein Obama as unAmerican and far outside the mainstream. And while the notion lies at the very dark heart of the birther movement peddled by clowns such Donald Trump and Orly Taitz, it has been pushed hard by top party leaders as well.

How did that work?

On the other hand, those who have been most adamant about Barack Obama’s lack of credentials as a real American — Republican candidates for Congress — are today considered mainstream by just 38 percent of their fellow Americans. 23 August - More about Anton Caluori.
"Molnar wrote that the e-mail, received by the FBI earlier Tuesday, said, "I will kill the president !!!!!" and "You can't afford to call my bluff."
The message said that dying "isn't frightening … it's peaceful … you will see…" and spoke of a "cop killing spree … just over the hill," Molnar said. The e-mail included an address and challenged authorities to "come and get me."
A database check confirmed that Caluori lived at the address in the e-mail," Molnar said in his affidavit, and the username of the e-mail account appeared consistent with his name.
Molnar said he and Federal Way police officer Andy Hensing went to the apartment complex at the address, where an employee told them Caluori was a "hothead" with a "temper" who lived with his mother.
The officers knocked on the apartment door twice with no answer. The third time, a man later identified as Caluori opened the door, Molnar said.
"Caluori was wearing a black bandoleer filled with 12-gauge shotgun shells around his torso. Attached to the bandoleer at chest level was a large black fixed-blade knife. On his ankle, Caluori was weaving a revolver in an ankle holster. Caluori's right hand was placed out-of-view behind his back," the affidavit said.
The officers commanded the man several times to "show us your hands."
At first he didn't comply. But then he "moved his right hand from behind his back revealing a stockless black pump-action shotgun with a pistol grip," the affidavit said.
After he raised the firearm, the officers scuffled with Caluori."
And this is rather scary:
"Caluori's mother, identified as R.B. in the affidavit, said Caluori "spends a lot of time on the computer" but she "does not know what he does on it."
According to the affidavit, R.B. said Caluori has "negative views of President Obama and in the last few days, most recently that day, has made negative statements about the president."
After reading Caluori his Miranda rights, Molnar asked him if he knew why the police were at the scene.
"I think I do, but I don't want to say it," he said.
He was shown a copy of the e-mail to the FBI and, asked if he wrote it, said, "possibly," Molnar wrote.
Asked if he had any "issues with the president," Caluori replied, "You don't have a high enough security clearance. Call the CIA or run it up the chain of command," Molnar said."
23 August - "Special Operations Speaks PAC" has an event planned for the GOP national convention.
"This high-energy tribute to the ment women of the United States military will feature former members of SEAL Team Six, Army Rangers, Gold Star parents and modern day patriots with a few surprise guests," reads the flyer obtained by BuzzFeed.
U.S. Senators, a few conservative Hollywood celebrities, and a roster of about half dozen former Special Forces operators are planning to speak, according to one of the event's organizers, Joel Arends.
"The thinking is very simple, we want to educate delegates to the RNC convention on two different issues," says Arends, who is also head of Veterans for a Strong America. The first issue, he says, are the "national security leaks have come out this White House are damaging the troops on the battlefield." The second issue is sequestration and planned cuts in the defense budget.
The groups involved — OPSEC, Special Operations for America, and Veterans for a Strong America — have been the targets of intense criticism in recent days from the White House and its allies. "
23 August - Sad to say, Andrew Sullivan has a point about Judge Head.

24 August - Looks like Mitt Romney is now playing wink-wink flirty games with the birthers.
"Mitt Romney made a joke about his birth certificate at a rally in Commerce, Mich. on Friday.
Speaking about his Michigan roots, he said, "No one's ever asked to see my birth certificate. They know that this is the place that we were born and raised."
The joke was received with hearty applause by the audience. Still, it was an awkward moment for the candidate to play on the birther conspiracies that have plagued Barack Obama since he ran for president in 2008, even after the president released his "long-form" birth certificate in 2011.
The Obama campaign quickly responded, with spokesman Ben LaBolt saying that Romney was embracing the most extreme elements in the conservative movement.
"Throughout this campaign, Governor Romney has embraced the most strident voices in his party instead of standing up to them," he said. "It's one thing to give the stage in Tampa to Donald Trump, Sheriff Arpaio, and Kris Kobach. But Governor Romney's decision to directly enlist himself in the birther movement should give pause to any rational voter across America."
I've commented before on Mitt Romney's continued use of birthers as surrogates (Donald Trump) or co-chairs (Arizona SoS Ken Bennett). The fact he's now openly commenting on it suggests that the birther blather may be ratcheted up.
Last tuesday, before Blog Talk Radio took a dump, I said on "Reality Check's" show that Romney would go birther if his polling numbers fell, or if he needs to shore up his base. I think we're seeing signs of this now. Furthermore, if President Obama does win a second term, I would not be surprised to see some court challenge from the Romney campaign or his surrogates.
Sen. John McCain had the class not to go full metal birther. Romney deciding to flirt with the birtherstani shows his complete lack of class and win at all costs mindset.

I think this was a calculated move. One of the only issues that will change the media's attention from Akin's rape comment is the birther issue. Romney has spoken to Sheriff Joe and he's fully aware of the situation. This will obviously get the leftist media in a frenzy and the rape comment will be history. Hopefully the media will demand to see his birth certificate and blow this issue up even bigger. It's a win-win situation for Romney.

24 August - The Daily Mail reports on Romney's flirtation with the birthers.
"The quip was an obvious reference to the theory propounded on the Right-wing fringe that Obama was not born in Hawaii, as a newspaper notice at the time and the long-form birth certificate produced by the White House show, but in Kenya.
For Romney, the subject is a perilous one because many independent voters view such theories as racist and an attempt to delegitimize America’s first black president.
Romney is more vulnerable on the issue than many other Republicans because he publicly accepted the endorsement of Donald Trump, the billionaire property mogul and reality television star, who is an outspoken proponent of Birther theories.
At the time, Romney said he did not agree with Trump on Birtherism. ‘You know, I don't agree with all the people who support me and my guess is they don't all agree with everything I believe in. But I need to get 50.1 per cent or more and I'm appreciative to have the help of a lot of good people.'
Kevin Madden, a Romney spokesman, immediately sought to downplay the comment, saying that ‘the governor's been clear on this issue many times before’ and viewed it as settled."
The fact that Mitt Romney is flirting with the birthers and using avowed birthers as his surrogates and campaign co-chairs without denouncing them for it makes it quite clear that Romney has absolutely no problems playing games with that "issue".
"Romney advisers said that his joke was unplanned. But many Obama supporters were quick to suggest that it was a dog whistle to racists and an attempt to whip up anger.
Republicans were quick to say that an Obama adviser had suggested Romney was a felon and a super PAC campaign ad linked him to the death of a woman who succumbed to cancer.
At best, Romney’s joke was a tactical blunder because it undermined his promise to run a substantive campaign about big issues and took the focus of the campaign away from what voters care about most – jobs and the economy."

"With his joke today that “No one has ever asked to see my birth certificate,” Mitt Romney moved down to the lowest rung of the Republican Party – the racist demagogues who know better.
I don’t forgive poor, isolated, ignorant whites their racism, but you can understand some of the cultural programming that’s embedded it. Romney knows Obama was born here. “No, no, not a swipe," Romney said. “I've said throughout the campaign and before, there's no question about where he was born. He was born in the U.S. This was fun about us, and coming home. And humor, you know – we've got to have a little humor in a campaign.”
I get the strong feeling this wasn't a bit of "humour", or anything like that. It was a trial balloon to see if the time was right to take a trip down birther lane, and a dog whistle to the base. IT WAS NOT A JOKE.
Expect a lot more "jokes" like that between now and election day.

" The Court holds that Defendants have shown that counsel for Plaintiff knew or reasonably should have known that the claims in this case had no basis in law. Specifically, counsel for Plaintiffs reasonably should have known that Plaintiffs lacked standing to pursue their claims related to Defendants’ efforts to certify President Obama as the Democratic Party’s nominee for theTennessee general election. First, the Court finds that the allegations of standing made on behalf of Plaintiff Maroney are particularly frivolous and without merit. When confronted with the standing issue in Defendants’ motion to dismiss, Plaintiffs’ brief failed to attempt to show that Maroney had standing much less cite legal authority to support such a position. The Court was left to presume based on the allegations of the Amended Complaint that Maroney brought suit in his capacity as a concerned citizen and tax payer. As the Court held in its order of dismissal, Maroney’s was an “undifferentiated, generalized grievance” that could not possibly establish standing to bring such claims. What is more, counsel for Plaintiffs should have realized as much before he ever framed pleadings and brought suit on behalf of Maroney. On this basis alone, counsel’s conduct lacked any reasonable justification."
"Second, the Court further finds that the allegations of standing made on behalf of Dummett and Volodarsky were almost equally without merit. Although the Amended Complaint alleged both of these Plaintiffs were declared candidates for President of the United States, Plaintiffs failed to address Volodarsky’s standing at all in their briefing. Plaintiffs did argue that Dummett (but not Volodarsky) had competitive standing to bring his claims, meaning that as a candidate, Dummett could challenge the qualifications of a competing candidate. As the Court has already concluded, (20) however, the Amended Complaint completely failed to allege any plausible facts showing that Dummett would ever appear on a ballot with President Obama or otherwise compete for votes directly with the Democratic incumbent. Unlike the political candidates in Drake v. Obama (21) Plaintiff Dummett did not allege that he was the nominee of any political party or that his name would appear on the Tennessee general election ballot. At best, Dummett attempted to show that the had registered with the Tennessee Secretary of State as a write-in candidate. Plaintiffs have (22) cited, and the Court is aware of, no legal authority standing for the proposition that a write-in candidate who was not a political party’s nominee for office could have competitive standing to challenge a rival’s qualifications. On the contrary, the Court noted in its order of dismissal that“[t]he allegation that an individual from California who is a merely declared write-in candidate inTennessee is, without additional factual support, too speculative to show injury-in-fact.” Under (23) the circumstances, the Court holds that counsel for Plaintiff should have known that Dummett and Volodarsky had no standing to assert their claims in this case."

Insofar as Defendants seek attorney fees incurred for the other motions to dismiss, the request for sanctions is DENIED"

"While the Republican Party gears up for its biggest event of the year next week in Florida, the conspiracy theorists among them are already looking forward to another convention of sorts next month in Arizona.
Some of the best known birthers in the nation are scheduled to take the stage at a star-studded event in Phoenix, where they plan to call for Congress to investigate whether President Obama’s birth certificate is real.
There will be singing. There will be speeches. Drinks will be available for purchase. The only question is whether the venue, which features seating in the round, will activate its spinning stage. Promoters are calling it “A Greater Phoenix Tea Party Patriots Event” but you can call it Birtherpalooza."
