In today's dispatches, Philip Berg has a date for oral arguments in his suspension. Dr. Kate loses more of her mind, while "No Nonsense Nancy" is courting a visit from the Secret Service.

The government moves to dismiss Dr. Orly's Affordable Care Act lawsuit. Larry Klayman continues to try and bilk the faithful. Dr. Orly seems to be hoping a courtroom falls on her in Kansas. Joel Gilbert's pack of lies continues to make the news.

Walter Fitzpatrick gets two martyr to the cause videos, which gloss over things like his military record, former rank, criminal record, court-martial, and general dingbattery. Birther ballot jihad cases get booted in Illinois and Vermont. Pixel Patriot shows the world that he can logically count all the way to potato.

Plus Dr. Orly has fun in Mississippi. By which I mean the judge warned Dr. Orly, and she completely ignored the judge. Should be fun.

Note - One of the things that was eaten by last friday's update was my noting that Michael Jablonski was President Obama's attorney in Georgia, and the author of the "let the birthers lose to an empty chair" strategy. I have NO idea why Gordon Epperly included him on the list of birther lawyers......

I saw that “flag” earlier today on another site. The site said the “O” stands for zero. I had no idea they were actually SELLING it! These people are insane!
This is more treason!! When are we Americans and other concerned people around the world going to have enough of this evil traitor and his cohorts? I used to think that if he were assassinated he would become a martyr but I’m not so sure anymore. I don’t think he would be. I personally want to see them tried and convicted of treason and punished accordingly. And they better not even think of life imprisionment. I’m quite sure that is still not the punishment for high treason. 20 September - In Dr. Orly's lawsuit against Kathleen Sebelius and the Affordable Care Act. the government files a motion to dismiss.

"Plaintiff Orly Taitz brings this suit to challenge the minimum coverage provision of the Patient Protection and Affordable Care Act (“ACA”) based on her unfounded belief that the law categorically exempts Muslims from its scope. Her understanding of the law is wrong, as should be clear from her inability to cite any provision of the statute even referencing Islam, Judaism, or Christianity. To that argument, she adds the latest in her series of ill-conceived claims that President Obama is not a “natural born citizen” as required by the Constitution to serve as President, and a far-reaching claim under the Racketeer Influenced and Corrupt OrganizationsAct (“RICO”) that she is already pursuing in other courts"

"Conspicuously missing from Taitz’s complaint and motion is any account of the cases she has previously brought to challenge the minimum coverage provision and/or the President’s eligibility to hold office. As another court has recognized, Taitz has engaged in a “Sisyphean quest to prove that Barack Obama is using a fake Social Security number and a forged birth certificate.” Taitz v. Ruemmler, Case No. 11-cv-1421, 2011 WL 4916936, at *1 (D.D.C. Oct. 17,2011). As part of that quest, Taitz has raised such claims both on behalf of clients and in her own name. With the limited space available here, a few examples are particularly worth noting."

And they note Dr. Orly's tendency to copy and paste in her filings.

In Mississippi, Taitz originally sued in state court on February 14, 2012, six months before filing this case. (The case was removed to federal court on April 24, 2012.)T aitz’s First Amended Complaint, attached here as Exhibit 2, includes RICO claims that mirror her claims here. As demonstrated in a chart attached as Exhibit 3, the RICO claim in this case is essentially a carbon copy of the earlier claim. The claims share allegations, defendants, exhibits,and even typographical errors, and despite their minor differences a final resolution in one case would have preclusive effect in the other. This is a classic example of a plaintiff trying to present identical claims simultaneously to different courts. As the second recipient of her claim,the Court should dismiss Taitz’s complaint."

20 September - Larry Klayman refuses to accept "dismissed" as an answer in his Florida Birther Ballot jihad.

"A California lawyer who earlier this week failed to convince the State Objections Board to keep President Barack Obama’s name off the Kansas general election ballot filed suit Thursday in Shawnee County seeking an emergency stay of the board’s action.

Orly Taitz, who wasn’t allowed to speak to the State Objections Board on Monday when it officially placed Obama on the November ballot, said her suit was filed on the behalf of a client she identified only as “Mr. (Roger) Walters, a citizen of Kansas.”

Oh, and they point out she WAS kicked out.

"Taitz attempted to present her argument to media gathered outside the hearing room at the Statehouse. She was ordered to leave by security officers after she became involved in a heated argument with another man. The verbal confrontation continued outside on the Statehouse grounds."

Unlike Arizona SoS Ken Bennett, the Kansas SoS office sent a polite letter citing all the legal requirements under Kansas State Law and Hawaiian State Law, and offered to pay any fees needed to expedite the documentation.

21 September - The support that the Alabama GOP chairman showed for Joel Gilbert's back of lies is coming under study.

"Armistead suggested that audience members see the movie '2016: Obama’s America,' a documentary by conservative commentator Dinesh D'Souza that is critical of the president.

“If you haven’t seen it, you should,” he said. “But I’m going to tell you about another movie. The name of it is ‘Dreams From My Real Father.’ That is absolutely frightening. I’ve seen it. I verified that it is factual, all of it. People can determine.”

The movie, not in theaters but available to purchase on DVD, claims that Obama’s real father is Frank Marshall Davis, an American labor activist and organizer for the Communist Party USA.

Armistead’s comment, which I tweeted on Wednesday, drew the attention of the People for the American Way, a Washington, D.C.-based liberal advocacy group."

21 September - Meanwhile, Swiftboat liar Jerome Corsi reports on Joel Gilbert's latest brainfart.

"His father taught him to love jazz?

So claims an email dispatched this week from the Obama campaign soliciting a donation for a chance to have “Dinner with Barack,” with airfare “on us.”

But the claim is not credible, contends Joel Gilbert, whose documentary “Dreams from My Real Father” has just been released.

“How is this possible?” Gilbert asked.

“Obama’s official life story claims he was with Barack Obama, the Kenyan, only one time, in the early 1970s, and then briefly, for a week or 10 days,” he explained.

“How was that enough time to teach 9-year-old Obama to love jazz music? Besides, jazz is uniquely American. Besides, what evidence is there the Kenyan dug Coltrane?”

Funny, but Jazz music was and is very popular in Europe, Japan, and other areas outside the US. When I was an expat working in the Middle East, I heard jazz at various venues, and it was more than just US expats enjoying it. For Gilbert to make this claim is both ignorant and incorrect. Yeah, i know, what a surprise.

So of course….

"Gilbert’s first reaction was to assume the Obama campaign was conceding to the major premise of his documentary: that Frank Marshall Davis was the real, biological and ideological father of Barack Obama, not Barack Obama, the Kenyan, who came from Africa in 1959 to attend the University of Hawaii in Honolulu.

As the saying goes, when all you have is a hammer, everything looks like a nail.

We've seen this with other birthers before. They get so wrapped up in their pet theories that when new evidence comes in to challenge it, they have to figure out how to attach it to their theory in an ever-growing and ever more unstable mess.

There's a problem with Joel Gilbert's claim this proves his theory. For example, this 6 December 2009 article

"Among the recipients was pianist and composer Dave Brubeck, a jazz musician who has a special place in the president's heart. "In the few weeks that I spent with my father a child -- he came to visit me for about a month when I was young -- one of the things he did was to take me to my first jazz concert in Honolulu, Hawaii in 1971. And it was a Dave Brubeck concert, and I've been a jazz fan ever since," Mr. Obama said. The president said Brubeck was being honored for the decades of joy he brought to jazz fans. "

Also, in Obama's book "Dreams From My Father, he mentions that his father came to visit for a month, and also specifically mentions going to a Dave Brubeck concert.

Which doesn't stop comments like:

22 September - Poor Walter Fitzpatrick. He must have graduated from the US Naval Academy with such high hopes, only to find himself eventually beached and retired after court-martial and being passed over for promotion three times.

Meanwhile his classmates went on to bigger and better things. They have honorable careers in the Navy. He has an arrest record in two states and an increasing disconnect with reality.

Is it a surprise he's a bit….bitter?

It starts with professional seditionist Sharon Rondeau sending off a demanding letter to Chief of Naval operations Adm. Jonathan Greenert.

"Is this why, in the partly-typed, partly-handwritten memo from Ernie Simon to “27HOST_DOM…” it is stated, “…if you can prove the forgery, it totally supports his 10 years worth of contentions and makes the NAV look really bad”? Is it why Fitzpatrick was “fended off” when he attempted to speak with someone about it?

You will also note that the closing paragraph of the memo from Zeller to Bitoff reads:

Since I don’t believe in keeping a file to cover this office when decisions are later questioned, there is no copy of this letter in my files or on my computer.

Why would a prosecutor make such a statement to the admiral in charge of a court-martial proceeding?

I would appreciate a response from your office at your earliest convenience."

And her response?

Crickets.

"We never received a response from Greenert or anyone in his office."

And then Fitzpatrick gets bitter.

"Over the last few days, Fitzpatrick discovered that Greenert was a classmate of his at the U.S. Naval Academy, graduating with Fitzpatrick’s class of 1975.

Fitzpatrick has stated repeatedly that the court-martial was held behind closed doors to frame him and push him out of the Navy. Despite the court-martial, Fitzpatrick received an honorable discharge and multiple commendations and meritorious service letters."

He was retired due to the "up or out" policy. The fact that he was beached and failed to be promoted past Lt. Commander despite being a USNA graduate speaks volumes about how the Navy saw his abilities to handle increased rank and responsibilities.

"Several complaints of treason have been filed by Fitzpatrick against Barack Hussein Obama, and Fitzpatrick is disappointed that none of his former Navy colleagues have exposed Obama. “They’re in the tank for this guy,” Fitzpatrick said. “You have the Chairman of the Joint Chiefs of Staff, talking to the SEALS and everybody, saying, ‘Shut up about Obama.’ Another guy is Bob Willard, whose last job was Commander, Pacific, and he retired in April or May. Willard was class of 1973 and would have been one of the guys who would have been able to stand up and say, Excuse me, Mr. Obama, Mr. Resident, you’re not legit; you’ve committed an act of treason. I’m here to defend the Constitution against all enemies, foreign and domestic, and Adios! Willard was a football player and top-notch fighter pilot, and he was actually in the movie “Top Gun.” There’s a scene in the movie where you have one plane flying on top of the other one, and the upside-down pilot is Bob Willard.”

"All of these people who are condemning me about my court-martial say that I “went anti-government,” but this is when I took a turn and went “anti-government-corruption.” This is when I was first betrayed by those people who were closest to me in uniform: John Bitoff. "

No, you went anti-government. Or at the very least, anti-UCMJ. And the betrayal came when you shamed your uniform and misappropriated your shipmates money while XO of the USS Mars.

And I'm sure your habit of wearing your uniform to your court dates and hearings, in violation of regulations regarding such, doesn't exactly endear you to them either.

"And now I see the betrayal being visited upon me by these fellow officers who I went to school with who lack the courage and intestinal fortitude to come forward and honor their oath and say, “Excuse me, but Obama, you’re a fraud!”

"The Tennessee and federal governments have used the court-martial against Fitzpatrick in a disinformation campaign which has labeled him a “Sovereign Citizen” but failed to say that Fitzpatrick has always contended that the signature on the letter was not his and that he received an honorable discharge."

Because he's just another person with a criminal record who's trying to claim "oh, I didn't do that, it was all someone else. I'm sweet and innocent!"

And it's hard to claim you're not a "Sovereign Citizen" when you hang around with them and spout their dogma in your court filings.

"And then you have these memos being circulated behind closed doors…it really hurts them badly, and I can’t think of a better time to hurt them badly when one of my former classmates is in a very high position. There is only one job that he could take that would be higher in position, which is what Mike Mullen did. Mike Mullen was a four-star admiral, Chief of Naval Operations, and he was moved into the Chairmanship of the Joint Chiefs.”"

And here we have the crux of the matter.

Fitzpatrick has a long history of being completely unable to accept responsibility for his own actions. Everything, from his court history and elected history in Washington State, to his actions in Tennessee, has shown that in Fitzpatrick's view, it's always someone else responsible for his misfortunes, not him.

I'm sure that when he was arrested on domestic violence charges, he blamed the victim there too. "She forced me to hit her! I had no choice!"

So now he's furious. A classmate is CNO. Other classmates went on to achieve bigger and better things. He's got an Lt. Commander's retirement pay, a criminal and arrest record, and an increasingly poor reputation as a nutcase. And he sees his classmates taking the rank and responsibilities that Fitzpatrick sees as his due.

He doesn't see that he was tried and found wanting. They weren't. And he wants to hurt them for it.

"Who is the person who is honoring his oath to the Constitution for the freedoms of this country? Is it Admiral Greenert or other military members out there who are doing what that guy should be doing? If you want to have a juxtaposition between two people from the same Naval Academy class… Greenert is a political appointee. He is there because he supports Obama. On the other side of the coin, you have another guy from the same Annapolis class who has described Mr. Obama in the commission of treason, and look at the dichotomy"

Yes. One kept his honor and his oath to country. The other lost his honor, betrayed the trust his shipmates had in him, and has since done everything to violate his oath to country.

"Take a look at all of the attacks that we find on our Constitution. Where do we find one senior military command or officer in a non-command position standing up and saying, “Mr. Obama, you’re not my president; you’re a fraud?” Paul Vallely is one, and Gen. McInerney is another, but they’re far and few between. "

Both of whom are long-since retired and haven't been in command positions for years. Like Fitzpatrick, they're civilians, and both have positioned themselves on the far-right fringe.

"I’m thankful today. I don’t know how I’d be able to live with myself if I were still in the military."

22 September - So I missed this rather overblown video posted 29 August about the "Persecution of Walter Fitzpatrick"

The narrator sounds a LOT like Dean Haskins.

It starts off with Fitzpatrick's treason nastygram, and then goes on to the grand jury ignoring him, and progresses to the so-called "corruption" in Tennessee, his attempted "citizens arrest", etc. (in other words, just about every streak of paranoia from Fitzpatrick that Sharon Rondeau has breathlessly repeated.

Oh, and at 4:20, it incorrectly gives his former rank as "Commander". Fitzpatrick was forced to retire as a Lt. Commander.

At 4:35, it mentions his post as XO of USS Mars. It doesn't note that he was relieved of duty and court-martialed due to misappropriation of ships funds. It then states his final "sea-going post" was to USS Carl Vinson.

He was relieved of duty as XO in 1989. His court-martial was in 1990. His court-martial conviction was downgraded to simple negligence in 1993. He was forced to retire in July of 1994.

The USS Carl Vinson entered the yards at Bremerton Naval Station on 22 September 1990, to spend two years in overhaul. It didn't depart the yards until February of 1994. And in the 21 April 1994 Seattle PI article, it said he had been beached since being relieved of duty.

Finally, his court records in Washington State show two Domestic Violence charges against Fitzpatrick in 1991, and one 1993 charge.

Quite simply, the only way he could have served aboard USS Carl Vinson during that time period was while it was in overhaul, and not while it was at sea.

Why do the birthers continue to try and give him a promotion that the US Navy didn't feel Fitzpatrick deserved or warranted??

At 5:30 it ends showing Fitzpatrick defaming his Navy Uniform again. And his shoulder boards still show LCDR rank.

22 September - A report on the Illinois State Board of Election's rejection of a birther ballot jihad there.

" Without the fanfare experienced elsewhere, the State Board of Elections has rejected attempts to remove President BARACK OBAMA’s name from the Nov. 6 ballot in Illinois, dismissing claims that the president is not a “natural born citizen.”

The board acted unanimously Sept. 13 on the three objections, clearing the way for Obama to appear on the ballot.

The objections were filed by AMANDA MARTIN of Atlanta, BENJAMIN FREEMAN of Decatur and MICHAEL D. JACKSON of Morton.

Among arguments from the objectors was that Obama’s father was a citizen of the United Kingdom, of which Kenya was a part when Obama was born; and that an investigator for Maricopa County, Ariz., Sheriff JOE ARPAIO found the Obama birth certificate released by the White House in 2011 to be “undoubtedly fraudulent.”

The bipartisan state board, in each case, found the recent filings to be an improper attempt to relitigate an objection that had been rejected before the primary election. It's rather funny how the voiceover doesn't mention any of this. It's also rather funny how the video seems to make the claim that the entire judicial system in Tennessee (which is a Republican-dominated state), is somehow completely controlled by Eric Holder and President Obama…….

At 1:09 it mentions Fitzpatrick's attempted "citizens arrest" of the Grand Jury foreman. At 1:50 it glosses over the planned "take over" of the courthouse, stating that people like Darren Huff and Carl Swensson were only there to "observe". (funny, that's not what they said before hand. Nor was it what Carl Swensson told the FBI. Nor was it what the jury decided when they found Huff guilty…..)

AT 2:20, it says that Huff was there to lend "moral support".

The article notes she was born in Sacramento, California to two parents who had been born in the US, but makes no statement at all that she was a natural born citizen due to those two reasons.

I hope "Pixel Patriot" limbered up, because if he continues to stretch like that, he's gonna pull a muscle.
